AGREEMENT OF SALE

THIS AGREEMENT FOR SALE is Entered into at MADRAS this day of

between Hindu, aged about 47 years, both residing at

Flat No. , hereinafter called the

“VEDORS” which term shall mean and include wherever the context so

requires or permits their heirs, legal representatives, executors,

administrators, nominees and assigns of the ONE PART:

hereinafter called the

“PURCHASER” which term shall mean and include wherever the context so

requires or permits his heirs, executors, administrators, legal

representatives nominees and assigns of the OTHER PART:

WHEREAS the VENDORS herein represent that they are the absolute

owners of the land and house bearing PLOT NO.10-A in Layout No.9473

bearing Door No.28-A, Beach Home Avenue Besant Nagar, MADRAS – 600

090, (New Door No.27/8 of 560 sq.feet in SECOND FLOOR comprised in

R.S.No.108/1-A and 107/1 T.S.No.17/1 in BLOCK No.26 of USUR VILLAGE

more particularly described in the Schedule A hereunder given for the

respective Purchased of the undivided share in the aforesaid land at their

cost respectively.

WHEREAS THE VENDORS have offered to sell property (Land and

House) for sale for a price of Rs.2,40,000/- (Rupees Two Lakhs and Forty

thousands only) and the PURCHASER has also agreed to purchase the same

for the said price free of all encumbrances.

NOW THIS AGREEMENT FOR SALE WITNESSETH:

THAT the terms and conditions mutually agreed to between the

VENDORS and the PURCHASER are as follows:

1. The property hereby offered to be sold and agreed to be purchased are

in detail mentioned in the schedule to this agreement for sale and the

situated in Door No.27/8, with 560 sq.feet Flat in SECOND FLOOR

comprised in R.S.No.108/1A and 107/1, T.S.No.17/1 in Block No.26

USUR VILLAGE.

2. The price mutually fixed is Rs.2,40,000/- (Rupees Two Lakhs and

forty thousand and one only) for the said property (Land and House)

3. THE PURCHASER has this day paid a sum of Rs.50,001/- (Rupees

Fifty thousand and one only) as advance the receipt of which sum the

VENDORS do hereby admit and acknowledge.

4. THE VENDORS shall over all the title deeds relating to the property to

the Counsel for the PURCHASER and satisfy him about the title to the

property agreed to be sold.

5. THE VENDORS admits that they have borrowed Loan Rs.50,000/-

(Rupees Fifty thousand only) by Account No.111244, dated 16.4.82

from Housing Development Finance Corporation Limited, No.123

Marshals Road, Egmore, MADRAS - 600 003 and the title deeds are

given as Collateral security. Further the VENDORS accepts and

agreed to pay Rs.49,258/- upto 31.3.1991 being the balance amount

due to the Finance Corporation.

6. The sale shall be executed in favour of the PURCHASER or his

nominee or nominee in whole or in part as the PURCHASER desires.

7. The stamps and registration charges shall be made only by the

PURCHASER or his nominee or nominees.

8. THE VENDORS shall produce the Certificate under Section 230-A of

the Income Tax Act at the time of registration of the sale deed.

9. THE VENDORS shall give vacant possession of the property before the

completion of sale proceeds.

10. The entire sale proceeds should be completed on or before

30.6.91.
