LEGAL OPINION:
1.According to my legal opinion under the perspective of prevailing
family laws in Pakistan, it is submitted that the marriage of the
Asia Zaheen was solemnized with Mahammad Kamran
Ehsaan in Pakistan under the relevant laws of Pakistan and under the
provisions of West Pakistan Family Court Act, 1964.
2.That I have examined the record of excise and taxation office
which shows that Més. Asia Zaheen does not possess any property
under her ownership in Pakistan nor she had received any benefit in
shape of dower from her husband Mohammad Kamran Ehsagn. So
she has nothing to return back to her husband any property or other
benefit in-lieu of Haq-ulMahr or dower.
3.That according to the prevailing laws of Pakistan and under the
principle of Islamic Law and Jurisprudence, a muslim wife who
claims divorce from her husband is not legally bound to return
her own personal property if any and if both the spouses have
dual nationality then in such matter the law and courts have
 jurisdiction to adjudicate the disputes where the NIKAH had
been performed and registered.
4. That I have examined the authentic legal documents of land
registry (i) Sale Deed No. 1894 dated 15-02-1989 Banglo
No.2524/G-4, Ward No.9 Muslim Situated at Shaad Maan
Colony Multan under the legal entitlement of Dr. Munawar Zaheen.
(ii) Sale Deed No.5312 dated 244-02-1981 Banglo No. 1, Ward No.9,
Situated at Nusrat Road, Multan with new address of 209- Nusrat Road
Multan under the legal possession of Dr. Munawar Zaheen currently
and (iii) Sale agreement deed dated 26-10-1988 Banglo No. 74,
situated Abdali Road, Multan (succession Property) all three
properties are belongs to ownership and possession of Dr. Munawar
Zaheen. So all above mentioned properties are still in the name of
Dr. Munawar Zaheen the mother of MkS Asia Zaheen and as yet
Dr. Munawar Zaheen is alive therefore, all above three properties
cannot be claimed as inherited property by anyone and sale
agreement deed also in favour of Dr. Munawar Zaheen not in
favour of NS. Asia Zaheen.
5. That according to international law and also prevailing family
laws in Pakistan the inheritance property is considered separate
property and is not subject to division under mutated property so
legally MOhammad Kamran Ehsaan have no legal right to ask
for a share of Mst. Asia Zaheen's inheritance.
In the above said circumstances, in case of divorce
either claimed and demanded by MkS. Asia
Zaheen or prouncement of divorce by the
Mahammad Kamran Ehsaan is not entitled to get
anything from her wife because she has no
property under her ownership in Pakistan.
