LEASE AGREEMENT

This Lease Agreement is made on and executed on this 16th day of February 2022.

By and Between

Mr. Surender Chahal S/o Sh. Abhey Ram ChahalR/o House No- E 44 ,2 ndFloor , Vipul
World Sector – 48 , Gurugram, Haryana-122018 (hereinafter called the “LESSOR” which
expression shall unless repugnant to the context shall mean and include his heirs,
successors, assigns, nominees and representatives) of the FIRST PART.

AND

Mr. Ajay KumarS/oSh. Dharmbir [ Relax Inn PG (Girls and boys) And Guest House]R/o
House No.- 229 ,Dabra , Hisar , Haryana - 125001 (hereinafter called the “LESSEE” which
expression shall unless repugnant to the context, include its heirs, successors, assigns,
nominees and representatives) of the SECOND PART.

WHEREAS the LESSOR has represented and warranted to the LESSEE that he possesses
and has clear, absolute, unrestricted and unfettered ownership right with respect to the
property bearing No Plot no – 170 , Vipul World Sector – 48 ,Near Vega School ,
Gurugram , Haryana-122018 comprising of of the on the premises (hereinafter referred to
as the “Demised Premises”)

And whereas the LESSOR also confirms that the Demised Premises can be utilized for
residential purpose and there is no prohibition from Haryana Urban Development Authority
or any other concerned authority for carrying residential activities in the Demised Premises.

And whereas the LESSOR has agreed to grant the lease of the Demised Premises and the
LESSEE has agreed to take the Demised Premises on lease on the following terms and
conditions which have been mutually agreed upon.
NOW, THEREFORE IT IS AGREED BETWEEN THE PARTIES HERETO AS FOLLOWS :-

1. Rental

The rental of the Premises shall be INR 45000/- (Rupees Fourty Five Thousand Only) per
month on account of rent inclusive of maintenance. (Hereinafter referred to as “The Rental”).

2. Payment Terms

The LESSEE shall pay rental of INR 45000/- (Rupees Fourty Five Thousand Only){ Feb &
march 2022 Rent After April 45000 } for every month in advance. The Rental for every
month shall be paid by 07th day of each English calendar month.

3. Period

The period of the Lease granted by the LESSOR to the LESSEE for the premises has been
agreed for 36-months commencing from 1stFeb 2022 to 30thJanuary 2025 and the rent shall
be effective from the same date. Further extension of lease after 30thJanuary 2025 will be
done on mutual agreed rent, terms and conditions. Lock-in Period 11 Months.

4. Security Deposit

That the LESSEE shall pay an amount of INR 90000/- as interest free Security Deposit. The
Security Deposit will be held by the LESSOR for the entire period of the lease and shall be
refunded to the LESSEE after handing over the vacant possession of the premises to the
LESSOR with all furniture, fixture and fittings in good working condition. However, normal
wear and tear (including painting & polishing), damage by acts of God, deterioration or
changes and modifications made with the LESSOR’s consent are exempted. Further, the
LESSOR shall refund the Security Deposit without interest to the LESSEE on expiry or early
termination of the Lease Agreement.

5. Use

The LESSEE shall use the Premises for the PG and Guest House purpose of Mr. Ajay
Kumar S/o Sh. Dharmbir [ Relax Inn PG (Girls and boys) And Guest House].

6. Notice

That it is agreed between the LESSOR and the LESSEE that the lease may be terminated
by the LESSEE any time before the expiry of the lease period giving clear One (01) month
advance notice in writing.

7.That the present agreement/deed shall not be extended under any


circumstances. It can be renewed After 2 years with a 10% or mutually agreed
increase in rent, with same terms and conditions.

8.Utilities
Charges for electricity, power & Lights, usage shall be paid by the LESSEE directly to the
concern department DHBVN /Uppal and copy submitted to theLESSOR.

That the LESSOR has already provided in the premises adequate power connection to the
extent of load sufficient for running the Electric and Electronic Gadgets & Appliances as
described in Schedule of Inventory.

9.Alterations
No structural additions or alterations shall be made by the LESSEE in the Premises without
the prior written consent of the LESSOR.

10.Maintenance

The day-to-day repairs and routine wear and tear to the Premises arising in the course of
normal use shall be undertaken by the LESSEE at his own cost.

In case of any major repair to the Premises including structural defects, leakage in electricity
or bursting of sanitary pipes, geysers, air conditioners, fixed and fitted electrical appliances,
seepage of water etc. other than by the willful damage to the premises by the LESSEE, shall
be attended by the LESSOR at his own cost.

In order to enable the LESSEE to have uninterrupted and undisturbed occupancy of the
Premises, the LESSOR shall on being notified of major defects required to be undertaken on
the Premises attend immediately with a concern to carry out and complete such repair. In
the event that the LESSOR does not undertake major repairs to the Premises immediately of
being notified then the LESSEE may conduct these repairs at the cost and risk of the
LESSOR. The cost incurred shall be deducted from the monthly rentals.

Miscellaneous Charge 5000 (Five thousand only) deducted from Rent.

11.Inspection

The LESSEE shall permit the LESSOR or his authorized representative to enter upon the
Premises for the purposes of inspection and carry out repairs at reasonable times, with prior
appointment.

12. Condition

On termination or expiration of this Lease Agreement, the Premises shall be handed over by
the LESSEE to the LESSOR in good condition, subject to normal wear and tear including
normal painting & polishing and damages by act of God or beyond the normal control.

13. Damage

The LESSOR shall not hold the LESSEE liable for any failure of damage to the Premises or
persons caused by burst water pipes, malfunction of electrical wiring and components, pests
(including termites), over flow of sewerage systems, flood or the interruption of water or
power supply, unless such failure or damage was caused by negligence or the willful
damage to the Premises by the LESSEE.
14. Warranty

The LESSOR represents and warrants that he is fully empowered, authorized and able to
make this Lease Agreement as the absolute and registered owner of the Premises. The
LESSOR will hold the LESSEE free and harmless of any losses, damages, claims,
paramount title, actions, encumbrances or proceedings by others in respect of the premises.

The LESSEE shall enjoy quiet, peaceful and undisturbed occupancy for the duration of this
Lease Agreement and any extension of such duration.

That the LESSOR hereby agrees to pay regularly and punctually all municipal and or govt.
rents and taxes and other out goings including ground rent, which are payable in law by the
LESSOR in respect of the demised premises.

Note : IF The Govt. Seems to be Again full Lockdown than Rent Will not have to be
Paid.( If the building is vacant )
