1.

The Canadian government introduced mandatory minimum sentences to stop repeat

offenders from committing more crimes, prevent others from committing similar
crimes and to remove unfairness from sentencing.

2. Judges should not have the power over sentencing all offences because some
offences should have a guaranteed punishment to deter people is society from
committing them.

3. MMS does comply with section 718 of the criminal code because they actively
encourage they actively encourage respect for the law by ensuring those who break
the law are fairly punished.

4. There are many other countries that use MMS in their justice systems such as
Sweden, Australia and the United Kingdom. However, in many of these countries
such as Sweden, there are exemptions of MMS based on the unique circumstances
of the individual case.

5. My opinion of MMS is that it is an integral part of the justice system. Offences that I
believe should be used for are crimes widespread crimes such as gang offences, in
order to deter society from commiting them. Some offences in which the judge should
decide the appropriate sentence are theft, prostitution or assault because these
crimes have many differing circumstances. I beliee they should be used in the
criminal justice system because they are beneficial to protecting justice in society as
a whole.
