There shall be an order of interim injunction restraining the

respondent/defendant from using the offending Domain Name

www.nalli.cloud/nalli.cloud after 10 days from the date of this order as

prima facie, the applicants/plaintiffs have made out a case as the previous

attempt of the respondent/defendant to register the Domain Name nallis.com

was successfully thwarted and the respondent/defendant was directed to

transfer the same to the applicants/plaintiffs by WIPO Arbitration and

Mediation Center by its Award dated 25.07.2009.

2. The next attempt to register the Domain Name nalli.org.in was also

thwarted by National Internet Exchange of India (NIXI) by its Award dated

19.07.2015 by directing the respondent/defendant to transfer the aforesaid

Domain Name of the applicants/plaintiffs.

3. The third attempt has been made to register the impugned Domain

Name nalli.cloud. Though, the applicants/plaintiffs had approached the

WIPO Arbitration and Mediation Center in Case No.D2021-1831, the

WIPO Arbitration and Mediation Center has directed the parties to approach

the Court.

4. Being satisfied with the reasons given in the original applications

and considering the fact that there are two earlier attempts were thwarted by

the applicants/plaintiffs by securing orders from WIPO Arbitration and

Mediation Center and National Internet Exchange of India (NIXI) as

detailed above, the attempt of the respondent/defendant to register and

use/transfer the offending Domain Name www.nalli.cloud/nalli.cloud is to

be restrained for a period of four weeks after expiry of ten days of

receipt/communication of this order. The applicants/plaintiffs are directed

to comply with the requirements of Order XXXIX Rule 3 of C.P.C.

5. List this case after five weeks for further orders.
