WORKS CONTRACT AGREEMENT

This works contract agreement is made and executed on this the……………..day of…………
At Hyderabad by and between.

M/S, Y.S. GAANA ELEAVTORS a registered from situated at

Represented and signed by Mr Y.Sreenivasa Rao Prorieter on behalf of the firm.


Here in after referred to as contractor, which term shall mean and include other partners execute the lift
works contract of the First part.

AND

Mr……………………………………………………………………………………………………………………………………………………………

referred to as contract is executed on the second part.
That the contractee or second part approached the contracter or first part and requested to install or
erect elevator system or lift (passenger lift) type, capacity, technical specifications, price, terms and
conditions, place of works were agreed orally. And now both the parties want to reduce it in writing.

HENCE THIS DEED OF WORKS CONTRACT WITNESS:

1. Technical specification : A separate sheet of paper constituting of this agreement annexcured


here to and signed by both contracter and contractee mentioned in detail all the lift parts-
brought from outside state or within state by the contracter to erect the lift is agreed by
contractee .
2. Labor Force : The contracter is agreed and bound to supply required man power to complete
mechanical erection, electrical wiring, testing, commissioning of elevator system and any other
petty missionary which ould be incidental to lift works contract.
3. General Arrangement Drawing(GAD) : The General Arrangement Drwaings in triplicate will be
forwarded to contractee by the contractor with in a period of 15 days from the date of recipt of
complete details of work place along with advance payment as agreed here. The purpose of
GAD is to clearly indicate to conctractee pertaining to dimensional details of the elevator shaft

pit, machine room, car and landing entrances etc.. The contractee can request for modifications
in GAD and can give more timer and co-operaion til contractee himself approves revised gad.

4. TOTAL PRICE OF THE WORK CONTRACT : The total price of the works contact is here with
specified and agree below

(Six Lakhs Ninty Five Thousand Rupees only)

Terms Of Payment : The contractee is agreed to pay the contractor as under

a. 40% of contract value as advance at the time of signing the agreement.


b. 50% of the contract value soon after dispatch of lifts materialss at work spot.
c. 10% of the contract value upon completion of installations.

In case of failure to pay the advance payment as per clauises 5(a) by the contractee to the contracter,
the contractor may give 1 week’s time or reminder if contractee does’t respond, then the contractor
may cancel this agreement. If the contractee fails the agreed amount of clauses 5(b), the contractor
after giving 3 days notice can shift lift materialss which are assets of contractor and may transfer to
suppliers or may sell to some one and there by for feiting the amount of clause 5(a) and if contractee
fails to pay the amount agreed in clauses 5(c) the contractor may not fitness certificate and the lift work
shall be the assets of contractor till the amount is paid.

Duration of the Contract : The contract period is agreed as 12 months from the date of this agreement.
The contractor is agreed to finish the lift work if everything agreed here in supplied by contractee and
installation place is made ready by contractee with in 03 months from their date of agreement. Title of
property : All materials is supllied, all works in progree, shall remain the property of contractor till the
final payment of contract work is reveived . The contractee in case of dissatisfaction of work done or any
defect in work may claim damages equivalent to the amount paid with penalty interest @2% on such

amount for the period from agreement date to the date of finding. Any how, the contractor may
demand in writing for clarificationof work on such cases of faults and rectify the same with own costs.

12) Scope of work: The scope of work as per the agreement by the contractor shall exclude

the following items and shall be the responsibility of contractee to arrange these works to meet
the requirements of the contractor.

a) Building works such as forming lift well, pit and machine room which shall be dry and
free from dust with necessary access according to local regulations and all minor
builders work, such as cutting pockets, grouting guide brackets, grouting landing push
boxes, indicatorss boxes providing bed blocks and buffer block etc.
b) Any type of wiring (including concealed wiring) what soever in the lift shaft walls are
strictly prohibited
c) Machine rook floor including any rainforcement necessary for load bearing .
d) Lifting beems/hooks in machine rooms wherever necessary .
e) Providing template land runner as per requirements size suitable to take lift shaft
plumb dimensions .
f) Landing wooden door frames for the landing Gates.
g) Guarding of entrance openings.
h) Scaffolding, planks and Ladders to our requirement.
i) Storage of materialss tools and clothing in a suitable locked, dry, ventilated and
illuminated storage space protected from theft and damage.
j) Working lights and temporary and permanent electricity supply.

k) Cleaning down, renewal or replacement of lift equipment damaged by dust due to dry
grinding of mosaic or other builders works.
l) Provision of safe access to the machine rook or lift well to our requirements.
m) Fees for inspection of lift by lift Inspector or electrical Inspector or any other fees
charged by the serveyor corporation or municipality or any other government agencies.
n) Wiring of main and earth from the source of supply to the machine room termination in
a MCB415V, AC3 phase and 2Nos. 6Amps,. single phase AC.

7. Delivery of materials: The lift materials shall be made available to the contractee for
the lift to works with in 60 days from the date of receipt of GAD approval and work spot
details, which shall be given by contractee. Any how the contractor is agreed to send his
team or depute himself to work spot with in one week from the date of advance
information on by the contractee. Any how the contractor may not accept responsibility
for the delayed delivery or delayed installation of the elevator if the terms of payment
not compiled with or if the preparatory building works of contractee is not finished or
necessary structure and support work which excludes the works of contractor, are not
completed by the contractee in time and the permanent three phases of power supply
with double earthing etc. is not given in time by the contractee to the contract.
8. Surplus materials: All consumable picking cases, surplus material, wings, tools,
tackles used or left surplus are the property of the contractor and can be moved by him
after completion of works with consent of contractee.
9. Handing over of the elevators: The contractor, after completion of work may give
work completion letter and contract is agreed to take over the elevator and settle any
amount of due to the contractor within a week period from the date of Completion of
work and can obtain acknowledgement of payments.

10. Guarantee : Unless other wise specified in agreement the contractor will carefully
inspect all machinery and equipment after completion of the work. The contractee may
testify or go trial under contractor’s supervision. The contractor is agreed to rectify any
defect which may develop under normal use with in a period of 3 months, the
contractor you cannot in writing the contractor does not agree to take responsibility
damages caused by wear and tear buy power defect accidents lighting lamp list
negligence misused or other abnormal condition resulting directly or indirectly beyond
control of contractor or natural calamity
Maintenance the contractor after the expiry of guarantee. Annual maintenance contract
which consists of regular examinations necessary adjustment lubrication works on the
direct supervision replacing Small thoughts etc the contractor made for AMC charge as
rupees 4% annually excludes the charges of replacement of Major ports which are abo
AMC the contract is agree to pay for Major replacement
