(2) Considering that the children were not born six months or
later after the marriage between the appellant and the B
respondent, the trial judge was right in holding that they were
the illegitimate children of the appellant and that the appellant
could not claim ascription vis-a-vis the children. Since the
appellant, under the Hukum Syarak, was not the lawful father
of the children, it follows that he had no locus standi to stake C
a claim to custody of the children. It follows further that the
trial judge was right in granting custodial right to the
respondent. The decision was consonant with the provision of
s. 85 of the Islamic Family Law (Federal Territories) Act 1984.

(3) The trial judge had adjudicated the case herein according to
procedure prescribed by law. Although this case was presided
over by three different judges, the two earlier judges did not
at all hear the case. They were only mentioning the case

which was very much part and parcel of what is termed as
case management.
Obiter:
The Hukum Syarak did not prohibit anyone who is not a nasab to F
visit the child of another. It therefore follows that there was
nothing wrong for the appellant to meet the children provided the
meeting is conducted in peace and with the permission and under
the supervision of the respondent. The respondent too should not
prevent the appellant from visiting the children if the visit does no G
harm to her or the children.

Hukum Syarak tidak menegah seseorang yang bukan nasab untuk
melawat anak seseorang yang lain. Oleh itu, tiada salahnya perayu
dibenarkan untuk bertemu dengan anak-anak tersebut dengan
syarat pertemuan hendaklah berlaku dengan aman dan dengan
persetujuan dan di bawah pemerhatian responden. Responden juga

tidak seharusnya menyekat lawatan perayu selagi lawatan tersebut
tidak mendatangkan mudarat kepada anak-anak atau dirinya.

[14] Merujuk kembali kepada kes rayuan ini, isu yang disepakati
C dalam kes ini sejak awal lagi adalah keputusan hakim bicara yang
memutuskan bahawa kedua-dua anak yang menjadi subject matter
dalam kes ini adalah bukan anak perayu. Mereka adalah anak tak
sah taraf dan menjadi nasab kepada responden seorang sahaja di
sisi Hukum Syarak.

[15] Perayu semasa berhujah mengesahkan hal ini dan tidak
mempertikaikan keputusan hakim bicara.
[21] Dalam kes ini perayu bukanlah bapa atau nasab keturunan
anak-anak tersebut dan memohon kepada mahkamah untuk diberi
hak untuk melawat anak. Perayu mengadu bahawa responden tidak
membenarkan beliau menemui atau melawat anak-anaknya. D
[25] Jawapan bagi persoalan ini adalah diharuskan atau boleh bagi G
seseorang yang bukan nasab untuk melawat anak seseorang yang
lain kerana tiada dalil yang menegah hal ini. Namun keharusan ini
adalah bergantung dengan persetujuan pihak penjaga anak
tersebut.

[26] Atas dasar ini mahkamah berpendapat tiada salahnya perayu
dibenarkan untuk bertemu dengan anak-anak tersebut tetapi
pertemuan tersebut hendaklah berlaku dengan aman dan di bawah
pemerhatian responden atau wakilnya.
