What is UAPA?
On July 8, 2019,Mr Amit Shah, the minister of home affairs, introduced the Unlawful
Activities Prevention Amendment Bill, 2019 in the Lok Sbha. The Unlawful Activities
Prevention Act, 1967 is amended by the bill. The Act, among other things, stipulates
unique protocols for handling terrorist activity.
The Anti-Terror Act's primary goal was to provide authorities for dealing with actions
intended to undermine India’s integrity and sovereignty. Constitutions should be
modified throughout time to correct insufficient provisions, adapt on new demands,
such as augmenting rights, and so on. A constitution's wording cannot otherwise
reflect social realities and political requirements throughout time.
Why did UAPA passed and where did it all went wrong?
The UAPA was effectively integrate in 1967 and permitted the government to declare
any organization unlawful in its original form. It also defined and criminalized illegal
actions. The Act was revised in 2004 to make terrorism a crime and to provide the
government the authority to declare and prohibit terrorist organizations. The 2004
revisions further increased police questioning powers and made it more difficult for
an accused individual to obtain bail by requiring the court to first be satisfied the
imprisoned person is innocent of the offence he is charged with.
