TENANCY AGREEMENT

THIS AGREEMENT made this ……… day of April 2023

BETWEEN

…………….the owner of property situated ……………………….. Wakiso


District (herein referred to as the Landlord).

AND

………………………….. of Tel ………………… Minnesota, USA and


(herein after referred to as the TENANT).

WHEREAS

a) The landlord is the owner of residential house and the detached house herein
after referred to as “the property” located in …………………. Wakiso
District and the land thereon.

b) The landlord has agreed to let to the tenant, the property and the tenant has
accepted to take a tenancy for a term, at a rent and subject to covenants,
agreements, conditions, restrictions, stipulations, and provisions herein after
contained.

NOW THIS AGREEMENT WITNESSTH as follows:

1. The reserved rent paid under this agreement is UGX. ………………/= (One
million five hundred thousand shillings) per month. The rent payable shall
be reviewed in September 2023 and shall from henceforth be payable as
reviewed.

2. The Tenant has paid 5-months advance rent for the months of April, May,
June, July, and August.

3. The Tenant has paid a security deposit of 1,500,000 that is refundable at the
end of this tenancy agreement should the house be returned in the good
condition as handed to the tenant.

4. The tenant agrees and hereby grants right to the landlord to utilize the
security to undertake repairs, replacements and modifications on the house
due to damage caused by the tenant.

5. Starting 1st September 2023, the rent payable shall henceforth be paid
monthly in advance not later than the 5th day of each month.

THE TENANT HEREBY COVENANTS WITH THE LANDLORD as


follows;

a. To use the demised property for residential purposes only and keep the
same, in accordance with this agreement.

b. To pay all utilities and outgoings including electricity, rubbish, water


charges which may be assessed or imposed in relation to the property or
arising from the use of the property by the tenant and to fully indemnify
the landlord in case the said charges are met by her. Copies of receipts of
payment of these outgoings shall be furnished with the landlord
before the periodical payment of rent.

c. To permit the landlord or his duly authorized agent with or without


workmen and others, upon reasonable time to enter upon and inspect the
condition of the said premises and/or carry out alteration as the landlord
may deem fit.

d. Not to do or permit or suffer to be done anything which might be


reasonably lead to loss or depreciation in value of the property. The
tenant hereby undertakes to indemnify, for loss that may have been
occasioned to the property.

e. Upon termination of this tenancy, to yield up the demised premises in


such good repair and tenable condition, subject to the aforementioned
undertaking of indemnity, for loss that may have been occasioned to the
property.

f. Not to make any alterations to the premises without the landlords written
consent.

g. Not to do or permit or suffer to be done upon the premises anything
which in the opinion of the landlord may be a nuisance or annoyance to
or in any way interfere with the quiet and comfort of the other occupants
of the property and/ or neighbors. The tenant hereby undertakes to
indemnify the landlord against any liability, which he may suffer as a
consequence of breach of this clause.

h. To introduce guests plus all the people staying with you to the local
authorities (L.C) of the area.

i. The tenant agrees to take reasonable care of the property and the common
areas, and in particular agrees to take all reasonable steps to i) Not bring
any hazardous or combustible goods or material into the
accommodation; ii) Not to pour any oil, grease, sanitary pads, food
waste or other damaging materials down the drains or waste pipes.
j. The tenant must dispose of all rubbish in an appropriate manner and at
the appropriate time. Rubbish must not be littered anywhere in compound
and other common areas at any time.
k. The tenant must keep the compound clean and the hedges and grass well-
trimmed.

THE LANDLORD CONVENANTS WITH THE TENANT as follows;

a. To pay all current and future local taxes, property rates and outgoings
that may be imposed upon the demised property.

b. That the tenant paying rent hereby reserved and performing and
observing the obligations and conditions herein contained, and on her
part to be performed and observed, shall enjoy quiet possession of the
demised property during the tenancy hereby created.

c. To keep in repair the structure and exterior of the house.

PROVIDED ALWAYS

a. The tenant has no authority whatsoever to sub-let any part of the premises to
a third party

b. Either party may terminate the tenancy at any time by giving one month’s
prior written notice to do so. PROVIDED that either party may unilaterally
terminate without notice, in case of extraordinary situations, events, or force
majeure.

c. Any action under this tenancy shall be in writing and any notice to the
tenant shall be sufficiently served if left addressed to the tenant at the
premises demised or sent to her/him by registered post to his/her last known
address in Uganda, any notice to the landlord shall be served personally or
sent to her by registered post to her last known address in Uganda or served
on any agent authorized by her to receive rent.
