Dear Mr Heawood and Mr Harris; Freedom of Information Request I refer to your Freedom of Information Request and apologise for the delay in responding. Your request asked for the following information: Your Requests 1. 2. 3. Will the Council attempt to overturn the Derbyshire principle and fund a libel action for the above-stated individuals? What legal advice has the Council sought in regards to the Derbyshire principle and whether your authority can pursue such an action? Has the Council funded the action on the basis that the defamation action is being taken through the Californian Courts and is therefore exempt from the Derbyshire principle? If the Council is not going to pursue a defamation action, have you or will you share the information disclosed by the Californian Courts with the individual claimants? If you will share or have shared this information, do you intend to reclaim from the individual claimants the costs incurred by the local authority in seeking this information? What are the total costs of this legal action, and has the Council taken out After The Event (ATE) insurance for this case?

Our Responses 1. The Council funded the discovery phase of the investigation and has passed the information so far to the four plaintiffs. Each plaintiff will now take their own personal legal advice on how they wish to proceed. The Councils legal advisors have considered the Derbyshire principle and are satisfied we can take the action we have taken. If the plaintiffs receive any damages respect of the libellous statements within the blogs, they have agreed to repay the legal costs incurred by the Council.

The costs paid to date are less than 75,000. At this stage, the Council has not taken out After The Event insurance, as there is currently no defendant to this action.
