Juvenile justice is into two categories- Child in conflict with law


- Children in need of care and protection
To provide an alternate justice system for juvenile

The law relating to CCL ( when a child is arrested)?
Firstly they should be addressed by the SJPU(Special Juvenile Police Unit/Officer). Regular
police cannot deal with juvenile
Secondly then the SJPU will produce the juvenile to the Juvenile Justice Board(JJB)
Childrens Inquiry (S.14 of JJA)
S15 talks about prelimnary assessment (mental capacity and physical capacity) only for 16-
18 age and heinous crime.
Thirdly the child is kept in Observation Home.
Childrens are kept in Ibservation Home till the time the case is pending

For bail, Juvenile justice has 3 seggregation


On basis of age- under 16 and 16-18 childre
On basis of offence- gravity of offence- petty, serious, heinous offence
On basis of gender- male of female

Bail should be given as right for petty and serious offence only for al other condition if they
feel.

*16-18  age of Criminal Responsibility (they may be tried by the JJB or could also be tried
as adult)

The timeline for inquiry is 4 months however of not completed the JJB shall give in writing as
why the delay occurred and them be granted 2 more months.

Individual care plan and SIR is important for conducting inquiry
