CRIMINAL COMPLAINT AFFIDAVIT

1. Darryl S. Pagalan, the undersigned, of legal age and a resident of #8400 Nueva
street Surigao city, accuses Reynaldo M. Pabas and Welfrido Grace E. Cial of the
crime of Attempted Rape, commited as follows.

1. At around 1:35AM of Saturday, September 25, 2022, I, Darryl S. Pagalan

together with my girlfriend Lexi C. Lore was buying some food in a seven
eleven (7/11) store, near Marios restobar.

2. While I was inside in the store buying some food my girlfriend Lexi C. Lore
stays outside of the said store, she stays outside because she has no facemask.

3. That at Luneta Surigao Park, there are two men Hiding in a big tree and waiting
some opportunity to Rape my Girlfriend. When they’ve seen me buying inside
the store, they took that opportunity to rape my Girlfriend, the two men quickly
run towards my girlfriend and grab the arms of my girlfriend and trying rip her
croptop but suddenly there’s too many polis officer at that point and stop the
commission of a crime.

4. That immediately after the said incident occurred, I reported the matter to the
barangay councilor Sebastian Ric A. Nagas, who was the officer on that day
stationed on Brgy. Hall of Surigao. The affidavit of Brgy. Councilor Sebastian
Ric A. Nagas is hereto attached as annex D.

5. That on October 25, 2022, I went to the office of the prosecutor to file charges
against the accused Reynaldo M. Pabas and Welfrido E Cial.
