Constitution of Three Oaks Middle School

Student Council
Preamble
As members of the Student Council at Three Oaks Middle School, we will strive to achieve our best
academically, be an asset to our school and community, and to plan and accomplish the goals set by
this group as outlined by this constitution.

Article I Name
This organization at Three Oaks Middle School shall be known as the TOMS Student Council.

Article II Purpose
The purpose of this organization shall be to assist the student body, the faculty, and the
administration of Three Oaks Middle School; to foster ideas of democracy; and develop the principles
of responsibility, leadership, personal growth, self-discipline, and good citizenship.

Article III Vested and Veto Powers


The Student Council will be a voting board of selected students who will follow school rules,
county/District guidelines, and state policy and procedures. The Student Council sponsor(s) and
administration shall have the right to veto any measure the Student Government Association may
pass.

Article IV Membership
Section 1
The membership of the Student Council of Three Oaks Middle School shall be any student who was
selected by the sponsor(s) from the sixth or seventh grade using the criteria of grades, behavior,
teacher nominations/recommendations. Sponsor(s) also reserve the right to add any qualified sixth
grade students following the first semester. The number of students may vary from year to year.

Section 2
The Student Council of Three Oaks Middle School shall have four officers: President, Vice-President,
Secretary, and Treasurer. Selection of these officers will be decided on through a ballot process by the
members of the Student Council. All officers will be eighth or seventh grade students who served on
the Student Council during their seventh grade school year as well. Only rising eighth grade students
may serve in the office of President.

Section 3
If the President of the organization is unable to fulfill his or her duties, the Vice-President shall
assume those responsibilities.

Section 4
If any member of this organization resigns or is dismissed, the sponsor(s) may, with the approval of
the officers, appoint a new member from the seventh or eighth grade of Three Oaks Middle School.

Section 5
If an officer of this organization resigns or is dismissed, the members may select from their ranks
someone to fill that position, if it is deemed necessary by the sponsor(s).

Section 6
Members shall maintain a 3.0 cumulative GPA and at least a B in all classes, unless otherwise
approved by the sponsor(s). Any member who fails to maintain this average will have until the
mid-term of the following nine weeks to improve these grades, and demerits may be awarded. He or
she will be on probation during this time and participation in any activity will require special
permission from the sponsor(s). If at the end of the probation he or she has not improved, they will
be removed from the Student Council of Three Oaks Middle School.

Section 7
Student Council members shall uphold high standards and set positive examples through their
behavior both in and out of school. Any referral, including those written by a bus driver, teacher,
and/or staff member, shall lead to an evaluation by the sponsor(s), administration, and officers of the
Student Council with the possibility of probation or removal from the Student Council.

Section 8
Demerits points shall be given by the sponsor(s) or officers for failure to comply with rules,
responsibilities and obligations of the Student Council. Members may be placed on probation and
removed for accumulation of excess demerit points.

Section 9
Merit points may be earned to eliminate demerits and will be awarded for work above and beyond
required by the Student Government Association.

Section 10
Attending meetings is an expectation for Student Council members. Students must let the sponsor(s)
know in advance if they will not be in attendance. If a member is absent from school that day due to
an illness or other excused absence, they are not expected to notify the sponsor(s), although it is
recommended.

Three or more unexcused absences from meetings will be cause for removal from Student Council.

Section 11
Any situation undefined by the constitution and/or discipline procedure shall be evaluated and
handled accordingly by the sponsor(s) and/or administration.

Article V Appointment to Student Government Association


Section 1
To be considered for a position in the Student Government Association, students must complete an
application, have an A/B average for their sixth/seventh grade school year, and have
nominations/recommendations from their sixth/seventh grade teacher(s). Classroom behavior,
unnecessary unexcused absences, and dean referrals will be a factor in the selection of students.

Section 2
The sponsor(s) will select members using the applications, nominations/recommendations from their
sixth/seventh grade teachers. Sponsor(s) may also conduct interviews of the candidates.

Article VI Meetings
Section 1
Business meetings will be held as often as necessary as determined by the sponsor(s) and the officers.
The officers will be responsible for arranging each business meeting.

Section 2
The officers shall prepare an agenda prior to each business meeting. The sponsor(s) will approve the
agenda prior to each business meeting.
Section 3
The President shall be in charge of conducting the business meetings, assign members to any task
needed, and any other activities as directed by the Student Government Association and/or
sponsor(s).

Section 4
The Vice President shall be responsible for recording the duty calendar and assisting the President.

Section 5
The Secretary shall be responsible for recording neat and accurate minutes at each business meeting.
These minutes shall be kept in an orderly manner and readily available to any officer, member,
sponsor(s), or administrator. The minutes of the last meeting shall be read before the start of a new
meeting and approved by the Student Government Association.

Section 6
All members shall be required to keep accurate minutes of each business meeting.

Section 7
The Treasurer will work closely with the bookkeeper of Three Oaks Middle School. He or she will give
an accurate financial statement once per month.

Article VII Amendments to the Constitution


Section 1
Any Student Council member who wishes to amend a section of the constitution shall do so by making
a motion to amend at a business meeting or at certain times set aside for constitutional review.

Section 2
Time shall be permitted for discussion of any proposed amendment(s).

Section 3
All proposed amendments shall be voted on by the Student Council members. The amendment(s)
shall receive a majority vote at the time of voting to pass and go into the constitution for ratification.

Section 4
The sponsor(s) and administration shall then approve the amendments.
