THE PHILIPPINE CREATIVE INDUSTRIES

DEVELOPMENT ACT (DRAFT SUBSITUTE BILL)


• introduced by Representatives Victor A. Yap, Carlos O. Cojuanco, Christopher
V.P. De Venecia, et. al
• seeks to implement a long-term program for the development and promotion
of creative industry

CREATIVE INDUSTRIES

- involve persons, whether natural or juridical, that produce cultural, artistic, and
innovative goods, products, and services, where such goods, products, and services
originate in individual creativity, skill, and talent and that have a potential for wealth
and through the generation and exploitation of intellectual property.
• Creative industries include those directly or indirectly involved in the creation,
production and manufacturing, performance, broadcasting, communication and
exhibition, or distribution and sale of works and other subject matter, subject to
intellectual property rights protection.

CREATION OF THE PHILIPPINE CREATIVE INDUSTRY
DEVELOPMENT COUNCIL (PCIDC)

• - attached to the Department of Trade and Industry


• -composed of 17 members
• 8 ex-officio members- 1 member each from the DTI, DEPEd, DOST, NCCA, IPOPHL, CHED, DOT,
DICT
• 9 regular members- Private sector representative of the 9 creative domains
• Regular members (with term of 6 years) to be appointed by the President from a list submitted
by ex-officio members (3 nominees for every regular member seat)
-at least ten (10) years of experience in the creative industry domain which they belong
to and endorsed by a business support organization or creative association relative to the
creative industry domain sought to be represented.
MANDATE AND POWERS OF PCIDC

• define economic goals and key performance indicators for creative industries
• classification of the creative industries into sub-sectors
• issuance of guidelines and criteria for persons/stakeholders in creative industries
entitled to receive aid in times of national emergences
• issuance of guidelines for accreditation of business support organizations and
creative associations entitled to PCIDC programs
• generate and mobilize resources from domestic and foreign sources
• develop, sustain cooperative exchanges partnerships collaborations- local and
overseas
MANDATE AND POWERS OF PCIDC
• endorse to DTI prospective multi and bilateral international trade agreements beneficial to
creative industries
• enter into contracts, acquire real/personal property to carry out Act’s purpose, raise or borrow
funds (subject to approval of Monetary Board and Bangko Sentral, DOF)
• delegate any of the powers Council is lawfully entitled to delegate to the Executive Director or
deputy Executive Director
• create ad hoc committees, technical working groups representing and consisting of different
creative industries and appropriate government agencies to discuss specific issues relative to
each creative industry and recommend or advise policies or programs to the Council
• promulgate rules and regulations necessary to carry out Act’s purposes

DEVELOPMENT PLAN
• headed by Secretary of Trade and Industry in coordination with the National
Economic Development Authority (NEDA) and representative organizations of
the 9 creative industry domains
• plan containing three, six and ten-year plan submitted to the President within
1 year after effectivity of the Act

- economic goals and key performance indicators for creative industries
- review of existing governance and policy framework under which plan may be
implemented
- data and research on technological advancements, methodologies, distribution
models, product lines and value chains for the creative industries
- areas of possible strategic investments
- technical, technological, and financial assistance programs
NATIONAL SECRETARIAT
ON CREATIVE INDUSTRIES
• Headed by Executive Director with 2 Deputy Executive Directors- appointed by the
President from five nominees
- submits annual budget and necessary supplemental budget to Council for approval
-tasked with implementation of the Development Plan and recommendation of changes for
consideration of the Council
-reviews all existing policies, plans, programs and projects of government and formulate
and recommends to Council and other government agencies programs that support creative
industries
-establishes and promotes culture of continuing dialogue between government and
business support organizations and creative associations on proper planning, evaluation of
policies, programs and projects affecting stakeholders
STATE SUPPORT FOR CREATIVE INDUSTRIES
A. Infrastructure Support-

-Shared Services Facilities (SSF) from DTI and support programs under the Philippine Innovation Act; subsidized rental schemes for studios, venues, co-
working spaces and facilities

B. Research and Development and Innovation Support


-research and development support program of the DOST; accelerating the transfer and commercialization of generated technologies; high-speed
infrastructure and bandwidth from the DICT and NTC

C. Digitalization of the Creative Industries-

-digital services and digital training programs for MSMEs and stakeholders; technical and financial assistance programs for digital content distribution
platforms, high-speed infrastructure and bandwidth from the DICT and NTC for accredited MSMEs and stakeholders

D. Creative Voucher System

-support, aid and incentives from government agencies-issued to stakeholders from accredited business support organizations or creative associations

E. Creative Industries Investment Priority Plan (CIIPP)

-listing of specific activities in the creative industries that may qualify for incentives, the Board of Investments (BOI) to classify creative industry enterprises as
preferred areas of investment

F. Fiscal Incentives to Enterprises in the Creative Industries

- performance-based, time-bound, and transparent system of incentives under the National Internal Revenue Code
STATE SUPPORT FOR CREATIVE INDUSTRIES
G. Access to Credit and Financial Instruments

-government-owned and/or supported financial institutions to give priority to creative industries in providing credit assistance and guaranteed schemes

H. Creative Instruction and Education

-DepEd, CHED, TESDA involved in creation of Creative Educational Plan scholarship, training for student, entrepreneurs, workers, trainees, stakeholders

I. Data Information and Management

-satellite account for creative industries, data collection and management of data by National Secretariat in coordination with PSA

J. Creative Industry Development Fund


-Special Account in the General Fund with the National Treasury- for research and development, trade promotion, human resource development and for
welfare of artists, workers and stakeholders through accredited business support organizations and creative associations.

K. Engagement with Private Sector


-consultation with accredited business support organizations and creative associations on formulation and implementation of programs and policies
concerning creative industries; creation of public and private partnerships for infrastructure development for creative industries

L. Local Culture and Arts Councils


-all LGUs in coordination with PCIDC to establish Local Culture and Art Council (LCAC) to support, report to, plan with PCIDC and maintain database of
business support organizations and creative associations within their jurisdiction.

M. One-Stop Registration Center


-The Negosyo Centers in LGUs established under the “Go Negosyo Act” to extend its services as a one-stop shop to assist creative industry MSMEs or
entrepreneurs in availing government services that are applicable to the creative industries, including intellectual property registration, product and business
registration, loans, grants and benefits programs.
