(1) Each employer covered by the


provisions of the Standards shall:

a. furnish his workers a place of


employment free from hazardous
conditions that are causing or are likely
to cause death, illness or physical harm
to his workers;

(1) Each employer covered by the provisions of
the Standards shall:

of all safeguards and safety devices

(4) It shall be the duty of any person,


including any builders or contractor or
enforcement agent, who visits, builds,
renovates, or install devices, or conducts
business in any establishment or

Refers to any practitioner in occupational

Refers to establishment where work
operations and practices performed by a
worker in the establishment or workplace in

A part-time safety officer shall be


required to perform the duties of safety
officer at least six (6) hours per week
The employment of a full-time safety officer may not be
required if the employer enters into a written contract
with a qualified consultant or consulting organization
whose duties and responsibilities shall be the duties of
a safety practitioner as stated in these rule.
The employment of a consultant, however, will not
excuse the employer from the required training of his
supervisors or technical personnel.

Requirements for accreditation of a practitioner in


Occupational Safety and Health

1. The individual must have completed the


40-hours Basic Occupational Safety and
Health Training Course as prescribed by
the Bureau;

2. Must have at least (3) years of relevant


experience in occupational safety and
health; and

Requirements for accreditation of a practitioner in Occupational Safety
and Health

3. Must be duly –licensed to practice his/her


profession in the Philippines.
a.If the applicant is graduate of any 4 or 5 –year
college course without a license, he/she must
have at least four (4) year relevant experience in
any of the sub-components in a field of
specialization as enumerated in Annex “A” of the
Standard; and
b. If the applicant is a college undergraduate
he/she must have at least ten(10) years relevant
experience in occupational safety and health.

a.To develop, implement and promote


occupational safety and health programs
in the workplace.

b.To advise and assist the employer in

of the reporting requirements.

Rule 1965 - Duties of the First-Aider
1. Give immediate temporary treatment in
case of injury or illness, before the services
of a physician becomes available. If the
case needs a physician, the first aider
shall immediately call or refer the injured to
one;

2. Participate in the maintenance of


occupational safety and health programs, if
a member of the Safety Committee; and

3. Maintain medical services and facilities

Rule 1965 - Duties of the Occupational
Health Nurse
1. In the absence of a physician, to organize and
administer a health service program
integrating occupational safety, otherwise,
these activities of the nurse shall be in
accordance with the physician;
2. Provide nursing care to injured or ill workers;
3. Participate on health maintenance
examination. If a physician is not available, to
perform work activities which are within the
scope allowed by the nursing profession, and
if more extensive examinations are needed, to
refer the same to a physician;

required by the Standards

undergo physical examination:
a. Before entering employment for the first time;

b. Periodically, or at such intervals as may be


necessary on account of the conditions or
risks involved in the work;

c. When transferred or separated from


employment; and

rated as follows:

CLASS A – Physically fir for any work

CLASS B – Physically under-develop or with


correctible defects, (error of refraction, dental
caries, defective hearing, and other similar
defects) but otherwise fit to work.

At the completion of the examination, it shall be
rated as follows:

CLASS C –
Employable but owing to certain impairments or
conditions, (heart disease, hypertension,
anatomical defects) requires special placement
or limited duty in a specified or selected

evaluation.

An employee leaving the employment of the
company shall, if necessary, be examined by the
occupational health physician:

1. To determine if the employee is suffering from


any occupational disease;
2. To determine whether he is suffering from any

injury

Types and Composition of HSC


 TYPE “ E ”
When two or more establishments are housed under one building,
the health and safety committee organized in each workplace
shall form themselves into a joint Coordinating Committee to
plan and implement programs and activities concerning all the
establishments
CHAIRMAN – The chairman of the establishment committee
MEMBERS – Two supervisors from two diff. establishment
- Two workers from two diff. est. (union member)
SECRETARY – Appointed by Chairman (in high-rise, the Secretary
shall be the building administrator)

Rule 1042.06 : Membership Committee

 The membership as provided is the minimum


requirements and nothing shall prohibit increases
in the numbers as may be found necessary.

 Where the WORKERS are not organized, they shall


be slected by a simple majority of votes of the
workers.

Principal duties of HSC are:
– Plans and develops accident prevention programs
for the establishment

– Directs the accident prevention efforts of the

programs, safety performance and govt.
regulations in order to prevent accidents from
occurring in the workplace.

Principal duties of HSC are:

– Develops and maintain a disaster contingency
plan and organizes such emergency service
units.

safety and health inspection or other program

 Duties of the Safety Man:

The principal function of the Safety Man is to


act as the employers’ principal assistant
and consultant in the application of
programs to remove the hazards from the
workplace and to correct unsafe work
practices.

Personal Protective Equipment (PPE)

All employers must provide personal


protective equipment for all employees
needing such equipment. All other persons
entering the construction site must wear the
necessary protective equipment.

Section 7:
Safety Personnel

To ensure that a Construction


Safety and Health Program is duly
followed and enforced at the
construction site, each
construction project site is
required to have the minimum
required Safety Personnel
A. General Constructor must provide for

1. a full-time officer, who shall be assigned


as the general construction safety and
health officer to oversee full time the
overall management of the Construction
Safety and Health Program.

2. additional Construction Safety and


Health Officer/s in accordance with the
requirements for Safety Officer of Rule
1033, depending on the total number of
personnel assigned to the construction
project site.
3. one (1) Construction Safety and Health Officer
for every ten (10) units of heavy equipment
assigned to the project site, to oversee the
effective compliance with the Construction
Safety and Health Program at the construction
project site, in terms of heavy equipment
utilization and maintenance.

B. Each construction subcontractor must provide for a


representative, who shall have the same
qualifications as a safety Officer, to oversee the
management of the CSHP for the
subcontractor’s workforce and specific area of
work operations in accordance with the
requirements of Rule 1033 of the OSHS.
Section 8 : Emergency Occupational Health
Personnel and Facilities

The same provisions of the existing


Occupational Safety and Health
Standards(OSHS) is reiterated. The
provision for an emergency health provider
was allowed. All other requirement such as
emergency medicines, supplies, equipment

Section 10:
Safety on Construction Heavy
Equipment

A specific guide for testing, transport, erection and


maintenance of heavy equipment is formulated.
All heavy equipment operators must be tested and
certified by TESDA, while heavy equipment shall
be tested by DOLE accredited
association/organizations.
Section 11 :
Construction Safety and Health
Committee

All construction sites must have a general


Construction Safety and Health Committee
composed of safety and health representatives
from each sub-contractor. The construction
project manager shall head the committee.
Each subcontractor shall have its own safety
and health committee based on the existing
requirements of the OSHS.
Each site shall, at the start of the construction have a
construction safety and health committee composed
of the following personnel

 Project Manager or his representative as the


chairperson ex. Officio;
 General Construction Safety and Health
Officer;
 Construction Safety and Health Officers;
 Safety representative from each
subcontractor;
 Doctors, Nurses and other Health personnel;
 Workers’ representatives (minimum of 3,
union members if organized, not necessarily
from one employer
Section 12: Safety and Health Information

A detailed safety and health information system is


included in the guidelines.

These include orientation, instructions, and


training for workers; means of conveying safety
related information to all workers and specialized
instructions and trainings for specialty workers
and operators.

SAFETY FIRST
 The instruction, training and information
materials, shall be given in a language or
dialect understood by the workers. Written,
oral, visual and participative approaches
shall be used to ensure that the worker has
assimilated the material.

 Each Supervisor or any designated person


(e.g. Foreman, leadman, gangboss, etc.)
shall conduct daily toolbox or similar
meetings prior to starting the task for the day
to discuss with the workers and anticipate
safety and health problems related to every
task and the potential solutions to those
problems.
Section 13: Construction Safety and Health
Training

 The basic construction safety and health training


shall be a forty(40)-hour training course as
prescribed by the BWC. The training course shall
include the provision of Rule 1410 of the OSHS

 Every constructor shall provide continuing


construction safety and health training to all
technical personnel under his employ.
Continuing training shall be a minimum of 16
hours per year for every full-time safety
Section 14: Construction Safety and Health Reports
 Submit a monthly construction safety and health report to
the BWC or the DOLE Regional Office.
 Report shall include a monthly summary of all safety
and health committee meeting agreements, a
summary of all accident investigations/reports and
periodic hazard assessment with the corresponding
remedial measures/ action for each hazard.
 In case of any dangerous occurrence or major accident
resulting in death or permanent total disability, the
concerned employer shall initially notify the DOLE
Regional Office within twenty-four (24) hours from
occurrence.
 After the conduct of investigation by the ocncerned
construction safety and health officer, the employer shall
report all permanent total disability to DOLE Regional
Office on or before the 20th of the month following the
date of occurrence of accident using the DOLE/BWC/HSD-
IP-6 form.
Section 15: Construction Worker’s Skills

A Skills certificate shall be required for construction


related occupations which have been classified as
“Critical Occupations” by TESDA.
An occupational shall be considered as critical –
When it may affect and endanger people’s lives
and limbs.
When it involves the handling of hazardous tools,
equipment, supplies.
When it requires a relatively long period of
education and training.
When the performance of the job may compromise
the safety, health and environment concerns within
the immediate vicinity of the construction site.
Section 16: Workers’ Welfare Facilities
The employer shall provide the following
welfare facilities in order to ensure humane
working conditions:
 Adequate supply of safe drinking water;
 Adequate sanitary and washing
facilities;
 Suitable living accommodation for
workers, and as may applicable, for their
families; and
 Separate sanitary, washing and sleeping
facilities for men and women workers
Section 17: Cost of Construction Safety
and Health Program

 The total cost of implementing a


Construction Safety and Health Program
shall be a mandatory integral part of the
project’s construction cost as a separate
pay item, duly quantified and reflected in
the project’s tender documents and
likewise reflected in the Project’s
Construction Contract Documents
Section 18: Miscellaneous

 All provisions of the other existing


occupational safety and health guidelines
not inconsistent with the above guidelines
shall form part of Department Order No.
13
 All provisions of other existing
occupational safety and health standards,
rules and regulations not specifically
provided herein shall remain in full force
and effect.
Section 19: Violations and Penalties
 Violations committed by constructors
as determined by DOLE after due process
shall be considered as prima facie case of a
construction mal-performance of grave
consequence under RA 4566 as amended and
pertinent IRR.

 In cases of imminent danger situations,


the procedures/requirements of the OSHS and
DOLE regulations shall be applied.
