CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and executed by and between:

JENNIFER BATAYOLA , of legal age, Single, Filipino national and a resident of


Villacin Street,Cadiz City,Negros Occidental hereinafter referred to as the “LESSOR”;

MANUEL JR M. ORO, of legal age, Married, Filipino national and a resident of No


15, St Martin St, Suntal Villas II, Brgy Taculing, Bacolod City,Negros Occidental herein referred
to as the “LESSEE”.

WITNESSETH:

WHEREAS, the LESSOR is the proprietor of a residential house situated at Block 5 Lot
10, Pinecrest 3, Camella Subdivision, Brgy Mandalagan, Bacolod City.

NOW , THEREFORE , the parties have agreed, that the LESSEE shall lease the
properties hereunder described and specified from the LESSOR, and the latter by virtue of this
contract, hereby lets and leases unto the LESSEE the said property, subject to the following
terms and conditions to wit:

TERMS AND CONDITION:

1. SUBJECT MATTER OF THE LEASE. A Residential House and lot unit situated at
Block 5 Lot 10 , Pinecrest 3,Camella Subdivision, Brgy Mandalagan, Bacolod City with
a Lot Area of 88 sqm and Floor Area of 53 sqm.
2. TERM OF THE LEASE. The term period of this lease shall be for a period of 12
Months (1 year) and will commence on __________, 2023 - ________, 2024.
3. LEASE RENTALS. The monthly rental of the Lease shall be Fifteen Thousand Pesos
Only (P15, 000.00) Philippines Currency, per month; payable in every ___ of the
month. Exclusive of the monthly homeowner’s dues.
4. MANNER OF PAYMENT. The LESSEE shall deposit the monthly rental every ___
day of the month to the following Bank Account details .

5. SECURITY AND ADVANCE RENT DEPOSITS. Upon signing this contract, the
LESSEE shall pay an advance rental equivalent to one (1) month advance and two (2)
months deposit in total of FORTY FIVE THOUSAND PESOS ONLY (P45, 000.00).
This non-interest bearing shall serve as guaranty for liquidated damages, arrears and cost
of repairs chargeable to the LESSEE. The LESSEE agrees that the security deposit
cannot be in lieu of monthly rental payments. The LESSOR agrees to fully refund the
security deposit of the LESSEE upon successful inspection of the premises when
returning the house to the LESSOR. Any damages or missing items can be subtracted
from the security deposit. The LESSEE agrees to replace or refund at replacement value
any household item that is missing, damaged or broken.
6. GRACE PERIOD. If any monthly payment is late, a grace period of 3 days will be
granted. On the 4th day after the rent is due, a penalty of THREE HUNDRED PESOS
(P300.00) per day will be due in addition to the rent owed to date.
7. USE OF LEASED PREMISES. The LESSEE expressly agrees and warrants that the
leased premises shall be exclusively utilized for residential purposes only.
8. CARE OF THE LEASED PREMISES. The LESSEE shall keep the leased premised in
good and habitable condition and any damages caused by the LESSEE in the said
premises shall be to his account.
9. BILLS AND OTHER UTILITIES. All Charges for water consumption, electricity,
telephone and other utility bills in the leases promises as well as for the repairs in the
utility system and maintenance of the unit shall be for the sole and exclusive account of
the LESSEE.
A. Should the LESSEE fail to pay any monthly lease rental after one (1) month as it
becomes due and payable or the lease has been expired, the LESSOR shall have
option to cancel and terminate this contract and the LESSEE shall immediately
turn over possession of all the properties subject matter of the lease to the
LESSOR, upon demand, without need of any court order or action.
B. Should the LESSEE terminated the lease or vacate the premises before the
expiration of the period of this lease; they shall forfeit their security deposit to the
LESSOR, except in cases of natural calamities.
10. LESSEE’S LIABILITIES FOR LOSSES, DAMAGES, ETC. The LESSOR is not
any way held responsible for force majeure or anything beyond their control.
11. NON-TRANSFERABILITY OF RIGHTS. That the LESSEE is expressly prohibited
to sub-lease the lease premises to anybody , without the express consent of the LESSOR
in writing;
12. RENOVATION /IMPROVEMENTS .The LESSEE may renovate the unit at their
expenses .Any major improvement shall be requested in writing by the LESSEE and
approved by the LESSOR. Upon the expiration of this lease, such renovation defacing
the structure shall belong to the Lessor at no extra cost.
13. BREACH/ LESSOR’S RIGHT OF POSSESSION. That in case of breach such as late
rental or electric, water utilities payments, which should only be paid directly to the
LESSOR in Section 3 and 4 by the LESSEE of any of the terms and conditions or
expiration of the contract, the LESSEE agrees and bind themselves to immediately
vacate the leases premises without the need of any demand by the LESSOR and to allow
the latter to take physical possession of said properties without any criminal or civil
liability. The LESSOR has the right to padlock the leased premises with the use of
reasonable force if necessary: and to foreclose or sell all the LESSEE’s property in the
premises within one (1) month if it is not paid to settle his obligation with the LESSOR.
14. VENUE. In case of litigation, the venue of the action shall be the City of Bacolod only
and not before any other court or place.
15. LESSOR’S WARRANTIES. The LESSOR warrants valid title and absolute ownership
of the property and the Leased Premises and that the same is free from all liens and
encumbrances of any kind whatsoever. The LESSOR warrants the LESSEE shall enjoy
full, continuous and peaceful possession of the Leased Premises for the entire period of
lease including any renewal thereof; the LESSOR warrants top forever defend the
property/Leased Premises in favor the LESSEE, its successors and assigns against any
and all claims.
16. RENEWAL OPTION. The LESSOR reserves the right to renew or cancel this Lease
upon its termination. Renewal requests need not be made by the LESSEE if all rent
payment are current and if LESSOR has not given notice of termination to the LESSEE
thirty (30) DAYS before its termination.The LESSEE expresses to lease the premises for
60 Months (5yrs) thus giving them the option to renew the contract Annually.
17. ADDITIONAL SERVICE FACILITIES. The installation of additional electric, water,
telephone and other cable facilities in the Leases Premises shall be for the account of the
LESSEE within the Leased Premises shall be for its own account.
18. TERMINATION OF LEASE. The LESSEE agrees to return and surrender the Leased
Premises at the expiration of this leased in as good condition as originally found at the
beginning of the lease except for the reasonable wear and tear arising from normal use,
and without any delay whatsoever, devoid of all occupant’s furniture, articles, and effects
of any kind.
IN WITNESS WHEREOF, the parties have hereunto affixed their signatures at Bacolod
