Statement of CW4 has been recorded. Ld. Counsel for complainant that
there are no more witnesses to be examined. Hence, PSE is closed.
On the basis of the complaint and the documents annexed with the
complaint, the Court is satisfied that the complaint is filed within limitation period and
falls in the territorial jurisdiction of this Court. Accordingly, cognizance of the offence
is taken.
Arguments heard on point of summoning. Record perused.
I have gone through the complaint, list of dates and events, evidence and
the documents placed on record. The legal notice was issued within the prescribed
period and the complaint has also been filed within limitation period as pe the inquiry
made under Section 202 Cr.P.C.
In view of the above, I am prima facie satisfied that an offence under
Section 138 of NI Act against the accused has been made out within jurisdiction.
Let the accused be summoned on filing PF and through RC as well as
through Speed post and approved courier. Steps be taken within 10 days from today.
Summons be served by way of affixation in case of non availability /
refusal of the accused. Process be served through concerned SHO.
Put up for purpose fixed on 12.08.2022. A Shorter date is requested.
However, as the summons are to be executed outside Delhi and there are around 6000
cases pending in this Court, same cannot be allowed.
