Thank you very much for your mail. The Council’s image would have been greatly
advantaged if you could be appointed in a senior position………….

We have discussed it before, but the industry is under severe strain and pressure
due to the fuel costs and competition out there who do not adhere to the Council
minimum requirements. It is liter5ally a question of survival. We hear daily of
companies in the industry that close down due to additional pressure being
placed on them by labour and related issues as well. This is understandable as we
are already so thinly cut to make money; it seems easier not to have a business to
supply employment to individuals.

It is extremely unfair to expect us to prepare for a meeting without us having all


the details to investigate and properly present our version. We have previously
sent our request for further particulars and this was merely ignored by your
colleague Agnes. To merely try to label this as a meeting is also totally dishonest
and misleading. At the arbitration, there is a possibility of an award, costs and
penalties against the company. We are of the view that arbitration should only be
left as a last resort for those companies, which do not cooperate. We cannot help
but to think that your colleague has a hidden agenda with this.

It is also highly questionable how she can unilaterally meet with the union
without us even being aware thereof, in anticipation to the arbitration but cannot
supply us with further particulars. We also have proof that we sent all the
required information to her previously but now it is reflected that not all the
information has been received???????????? In HDP Logistics there are no union
members in any event. The company is fairly new and it appears she wants to
keep other companies responsible for issues under our detriment.
We sincerely beg for your assistance in this regard. We simply cannot just go to
the council as Agnes feel like. She does not have reality on the fact that it will
extremely prejudice us. Besides the fact that staff and customers will be
neglected, it will simply cost a great deal of money. As already stated, the
company will be forced to obtain advise from Senior Counsel and apply for costs
against the council. I am sure nobody wants that. It is a waste of time and money
because one person abusing a position.

Please help!!!!

Even if you can sent us Agnes’ senior’s number so we can formally complain, this
can also assist. We will apply for further particulars again in the hope to try and
find out what is Agnes’ problem with us.
