DECISION

This refers to the Petition for Correction of Entry in the Certificate

of Live Birth of Anikin F. Ruzgal filed by the petitioner Sultana F.
Ruzgal against the Local Civil Registrar of Quezon City.

After the establishment of jurisdictional facts (Exhibits “A” to

“F”, with submarkings), the petitioner was allowed to present her
evidence ex-parte before the Commissioner appointed by the Court.

The petitioner presented her own testimony, as well as

documentary exhibits “G” to “N”, with submarkings.

The petitioner testified that she got married again on September

3, 2012 to Hiroyuki Tsuji; that her previous husband, Anthony Ruzgal,
died on December 25, 2003 due to a vehicular accident (Exhibit “H”-
Death Certificate of Anthony Ruzgal); that she and her first husband
had two (2) children namely, Thea Mae F. Ruzgal and Anikin F.

Ruzgal, the same child subject of the instant petition; that Anikin was
born on December 22, 1999 at Gentle Hands Clinic, Project 4, Quezon
City; that she filed the instant petition because she wants to correct
Entry No. 2 of Anikin’s Certificate of Live Birth which wrongly stated the
gender of his son as Male and not Female; that she have several
proofs to show that Anikin is indeed a Male and not a Female (Exhibits
“J” to “M”, with submarkings); that she prays before this Honorable
Court that her son’s correct gender be indicated in his Certificate of
Live Birth from “FEMALE” to “MALE”.

Hence, this petition.

The Court, after considering the evidences presented, finds that

this is a proper case for correction of entry in the Certificate of Live
Birth of Anikin F. Ruzgal, particularly Entry No. 2–Gender from Female
to Male.

WHEREFORE, premises considered, the instant petition is

hereby GRANTED. The Office of the Local Civil Registrar of Quezon
City and the National Statistics Office are hereby ordered to correct in
their records Entry No. 2GENDERfromFEMALEtoMALE of the
Certificate of Live Birth of Anikin F. Ruzgal.

Let a copy of this Order be furnished the petitioner, her counsel,

the Office of the Local Civil Registrar of Quezon City, the National
Statistics Office and the Office of the Solicitor General with a copy of
this Decision.

SO ORDERED.
