Subject: Legal Notice u/s 72A of IT Act 2000, For violation and
breach of data and disclose it which is likely to cause wrongful gain or
wrongful loss without the consent of the person concerned.

Sir,
Under instructions from my client Mr. Abdul Aleem Shaikh
proprietor Employment Hours residing at Golden Tower, Sector-24,
Plot No.15,Flat No.502,C Wing,Phae-2,Taloja,Dist-Raigad,
Maharashtra-410208.I do hereby address you as under;
1. My client states that, He is the proprietor of Employment Hours since
from 13/02/2017.
2. Further my client states that,you are working in the abovenamed
company as a position of operation executive since from 30/09/2021.
3. Additionally, according to my client, you have signed an agreement
with Employment Hours Corporate promising to abide by all company
policies and standards while providing services, regardless of any data
or company records.
4. My client states that,Despite the fact that you are aware of the
company's terms and conditions and have chosen to ignore them,that
you are breaking them.
5. Furthermore my client states that,Additionally,that you stole company
data, contacted the business's frequent customers, and formed your
own firm to control the act while being aware that you were doing all
of this.
6. My client further states that,In addition,that as a result of the data theft
you committed above, they have lost a significant portion of their
company's annual revenue.which is irreparable.
7. Now my client states that as per section 405 and 408 of IPC you have
done criminal breach of trust.
(Indian Penal Code: Section 405 and 408 – Criminal Breach of
Trust: As the employees are entrusted with the data/ information by the employer
during the course of their employment and if an employee dishonestly
misappropriates or converts to his own use or dishonestly uses or disposes of that
that data/ information, he/she may be charged under this section.)
8. Now my client further states that as per section 43,65,66 and 72 of IT
Act,2000 you have violated above section in which section 43 defines
as penalty and compensation for damage to computer,computer
system,etc.while section 65 defines that as tampering with computer
source documents,and section 66 defines as computer related
offences,section 72 defines as penalty for breach of confidentiality and
privacy.
9. My client also claims that as a result of the foregoing violation,
criminal breach of trust, and data theft that you committed, my client
has suffered a significant loss of revenue from your end and must
reimburse you with Rs. 5,000,000. Unless and until my client has the
legal right to bring both civil and criminal lawsuits against you.

In the view of above facts, and light of circumstances hereby giving you this
legal notice in an effort to get paid for the damages they have suffered as a
result of your actions. If this notice and instructions are not followed, my
client is fully authorised to contact the relevant authority for further action. If
this happens, my client will not be held liable for any costs or losses incurred
by you.
