 Maintenance & Small Works Terms & Conditions

Price

1. Valid for 30 days from the date of issue.

2. Calculated on the basis of one continuous visit for works carried out during normal working hours, unless otherwise specifically stated.

3. Dortech reserves the right to vary the price or charges in the event of additional or increased costs, charges and/or expenses caused or attributable to:-
a. Any failure by the Customer/Main Contractor to provide Dortech with timely, appropriate, adequate, correct or complete information.
b. Any variations, extras or changes required.
c. Any change or alteration in specification or design details by the Customer/Main Contractor.
d. Any correction of any error made by the Customer/Main Contractor or other trades or
Company’s.
e. Any failure by the Customer to perform any obligation required that allows Dortech to properly carry out the works n a timely manner.
f. Supplier price increases.

4. Health and Safety and Welfare facilities to be provided by the Customer or Main Contractor/Customer as required and agreed with Dortech.

5. Access, unless otherwise stated no access is provided by Dortech, and all access costs to be born by the Customer.

6. For projects lasting more than one day suitable on site storage to be provided by customer.

Payment

7. Interim payments 14 days from month end.

8. Final payment 14 days from completion of works.

9. The Customer/Main Contractor will make all payments due to Dortech in full without deduction whether by way of set off, counter claim, discount, abatement or
otherwise unless the Customer/Main Contractor has a valid court order requiring an amount equal to such deduction to be paid by Dortech to the Customer/Main Contractor.

10. In the event of non payment to Dortech under the contract, then Dortech (having advised the Customer/Main Contractor in writing) will have the right to deem such
failure to be a repudiation of the Contract, and recover all costs and expenses associated with the Contract and works carried out, and service provided.

Scope of Works

11. The Customer to provide Dortech with all information, access, facilities, co-operation and support that may be required to enable Dortech to discharge its
obligations to the customer.

12. The Customer warrants to Dortech that it has the legal right and authority to enter into in order to perform its obligations under the contract, and will be responsible
for procuring and maintaining any third party co-operation reasonably required for the provision of the said works and/pr services.

13. Dortech warrants (subject to other provisions of these terms and conditions) that any works or services provided shall be carried out with reasonable skill and care.

14. Dortech liability will limited to re-performing any work or service found not to have been preformed with reasonable skill and care, provided that the failure, defect in
or malfunction of the products, works or services is notified within 72 hours from completion of the works or services; otherwise the works and/or services shall be deemed to be
satisfactory.

15. Unless specifically included in Dortech’s offer, checks on the design and conformance to the design are excluded

and are not Dortech’s responsibility by inference or default.

16. Only the works specifically undertaken/listed by Dortech are covered by any guarantee or warrantee.

17. Parts supplied come with their own manufacturers warrantee.

18. Dortech cannot accept responsibility for any design criteria or adherence thereto of works carried out by others, this includes but is not limited to;
a. Glazing in general, Windows, Doors, Curtain Wall, Roof Glazing, Cladding or interfaces with the building structure or services.
b. Barrier Loads
c. Thermal performance
d. Wind Loads
e. Structural deflections.
f. Structural, or acoustic performance
g.

19. Glass Door automation.

a. Dortech cannot accept any responsibility for any glass, installed or supplied by others that is broken during the performance of its works.
b. Where our works include the replacement of glass and/or film applied glass, and in the absence of specification details from you, we will attempt to match to the
existing as closely as possible within the parameters of what is currently available but we shall not be responsible for differences, particularly in appearance, which may arise.
c. Breakages due to undetectable inclusions is expressed excluded from any actual or implied guarantee.

20. Our quotes do not include, unless specifically stated any mechanical or electrical works.

21. Subject to the other provisions of these Terms and Conditions, Dortech shall not be liable for any direct, indirect or consequential loss (all three of these terms
include without limitation pure economic loss, loss of profits, loss of business, depletion of goodwill, and similar loss), nor shall any delay entitle the customer to terminate the
contract unless such delay exceeds 180 days.

Other Terms and Conditions

22. No works can commence until terms and conditions have been agreed.

23. Any contract undertaken is a stand alone contract and not linked to other contracts, works, design criteria, specifications, terms and conditions or contracts carried
out by Dortech or other non related parties.

24. Products supplied remain the property of Dortech until fully paid for.

25. These terms and Conditions to prevail.

26. Third party collateral warranties are not provided.
