Legal and Social Aspects of Women's Empowerment in Nepal

All the activities to increase the capacity of women in terms of educational,


economic, health and reproductive health to be presented in a decision-making and
effective manner in various units of the state and society fall under women's
empowerment. If women's representation is only ensured but they do not reach the
position of decision-making and implementation, then it is not considered as
women's empowerment.
Women's Empowerment For the empowerment, first of all, women need to be
educated. Since only women trained in various ideas, ideologies and philosophies
can effectively present decision-making skills in political and social life and create
waves, the first step towards women's empowerment is women's access to the
educational sector. Another aspect of women's empowerment is women's economic
empowerment. When they rely on others to meet their daily needs, they are less
effective. Financial prosperity makes them self-reliant and gives them respect and
honour at home and in society. Therefore, to make women financially stronger and
stronger, they should bring appropriate economic development programs. And
their access to technical education should be increased.
Women's rights and women's empowerment will not be secure and secure unless
there is a systematic, effective and effective representation of women at the policy-
making level of state management. It is necessary for women to be established in
politics as only women can raise their voices in time regarding their demands and
needs. Women will not be empowered until women are empowered in politics. It is
only through politics that women's rights are established and steps are taken to
fulfil their needs. Therefore, women should be established in politics in order to
nurture the strengths of women, solve weaknesses, find opportunities and face and
solve challenges.
For the first time in Nepal, the First Civil Act of 1910 provided women's rights.
The Constitution of Nepal 2015 and the Constitution of the Kingdom of Nepal
2019 started efforts to provide constitutional and legal protection for women's
rights by providing for non-discrimination on the basis of gender and adult
suffrage. The Interim Constitution of Nepal 2063 has adopted international
standards by arranging women's rights as fundamental rights. At the same time, the
Constitution of Nepal 2072 has provided for women's empowerment and women's
rights to build an egalitarian society based on the principles of proportional
inclusion and participation and to end gender discrimination. Similarly, in the
application of the general law, there will be no discrimination on the basis of
origin, religion, caste, gender or any other basis. It is said that special arrangements
will be made according to the law for the protection, empowerment or
development of citizens, including socially or culturally backward women. It has
been arranged that women have the right to equal descent, safe motherhood and
reproductive health without gender discrimination. The Constitution of Nepal 2072
has ensured the rights of 33 percent of women, while the law of Nepal has imposed
a mandatory rule that there should be one woman candidate between the chief and
deputy chief in local-level elections. This shows that Nepal is far ahead in the field
of women's empowerment. This is only possible because of the voice raised for
women's empowerment.
In the history of Nepal, during the reign of Rajya Lakshmi Devi Shah, the whole
country and people supported it, it means that the people of Nepal are in favour of
women's empowerment. From the campaign to establish democracy to the anti-
Rana, anti-king movement, the women leaders of Nepal have made a great
contribution. Shailaja Archay, and Sahana Pradhan are vivid examples of this.
Finally, by empowering women educationally and economically, the presence of
women in the mainstream of state management and at the decision-making level is
women's empowerment in the true sense. Therefore, it is now necessary to remove
the feeling that women are of lower status than men in society socially and
traditionally, and raise public awareness that women should be equal to men and
there should be agreement and coordination with them wherever they are in society
and family.
