MEMORANDUM OF AGREEMENT

SWIMMING PROGRAM

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT executed and entered into this _____ day of ___________
2023 by and between:

(RESORT NAME), a duly organized corporation, under laws of the Philippines with postal
address at (RESORT ADDRESS) by President/Owner ________. Herein after referred to as the
FIRST PARTY.

AND

MX LOZADA SWIMMING SCHOOL, A duly organized and registered Institution of


Swimming accredited by the DepEd of formerly known as the Department of Education Culture
And Sports (DECS), represents by herein President MICHAEL JONATHAN LOZADA, Filipino,
Single of legal age, with postal address at, No. 2 Ligaya Pascual St., BF Resort Village Las
Piñas City, herein after as the SECOND PARTY,

WITNESSETH:

WHEREAS, the FIRST PARTY is an organized Corporation tasked to handle operations of


The swimming pool facility with venue located at (RESORT ADDRESS).

WHEREAS, the SECOND PARTY proposes to conduct and implement a Summer Swimming
Program catering to the students and guests of (RESORT NAME)

NOW, THEREFORE, for and in consideration of the foregoing covenants, and of terms and
conditions set forth below, the parties have agreed as follows.

A. RIGHTS AND OBLIGATIONS OF THE FIRST PARTY

1. The FIRST PARTY shall allow the MLSS the use of its swimming pool facility for
the purpose of conducting a summer swimming program catering to the students and
guests of (RESORT NAME) as well as the general public. First Party shall likewise
provide an adequate space for the MLSS to entertain prospective enrollees of the
program.
2. Swimming courses are as follows:

BASIC COURSE - fundamental of the freestyle stroke,


Diving, threading, and crawling. This Stage is
preparatory to the competitive and advance level.

10 lessons - P3, 200.00

ADVANCE COURSE - individually medley strokes, butterfly,


backstroke, breaststroke, and competitive freestyle.

10 lessons - P3,500.00

INFANT DROWNPROOFING - babies ranging 6 months to 3 yrs. old

8 lessons - P4,000.00
B. RIGHTS AND OBLIGATIONS OF THE MLSS.

1. The MLSS shall be responsible for implementing a swimming program for the
students according to the corresponding courses enrolled in:
2. The MLSS shall be allowed to handle swimming lessons on the following schedule:

A.M P.M.

7:30 - 8:30 3:00 - 4:00


8:30 - 9:30 4:00 - 5:00
9:30 - 10:30 5:00 - 6:00

MONDAY TO FRIDAY
WEEKENDS CONSIDERED SPECIAL SESSIONS
(Depending on availability of the pool)

3. The MLSS shall be responsible for keeping an orderly peaceful program and ensure
safety of all participants throughout the duration of the entire project. They shall
maintain order so as not to hamper and cause disturbance in the area;

4. The MLSS shall coordinate with (RESORT NAME) for appropriate time schedule of
the said program without interruptions, and MLSS reserves the right to occupy and
adequate space suitable for this purpose, otherwise, a written memorandum must be
given by the First Party Management at least one (1) week prior to any cancellation of
schedule,.

5. The MLSS shall be allowed to hang streamers (Free of charge) along designated areas
as well as disseminate fliers and print ads in coordination with Administration Office,
provided further that no other advertisements from other entities engaged in the same
activities or programs that will be conflict with the existing event
shall be place with the vicinity of the establishments for the duration of this
agreement;

6. Upon completion of the summer program, the MLSS shall be allowed to stage a
Sports Fest of Graduation Exercises in order to develop unity, camaraderie, and
sportsmanship among the participants of the said event. The primary objectives of
which are to lure prospective guest and generate the interest of the public in the
business concern of (RESORT NAME).

7. The GROSS Receipt dereived from the program shall proportionally by the herein
parties at 70% in favor of the Second Party and 30% for the First Party. Schedule of
releases shall be made every two (2) weeks or on the 15 th there after.

8. The MLSS shall abide the rules and regulations, existing ordinance, and memoranda
set forth by the Administration and shall comply with same without reservation. (No
bringing of snacks, no Lozada ID no swim policy);

9. Distinct and Separate Entities


The first party and the second party shall, at all times, be considered as distinct and
separate entities.
The first party is not an employer, direct or indirect of the employees of the second
party, Consequently, the first party shall not be responsible for any act, omission or
obligations of the second party in respect of the latter are employees, nor for any
wages benefits, or any other amounts that may be due to such employees. The second
party is and shall an independent contractor responsible for all obligations and
liabilities.
C. DURATION AND EFFECFTIVITY OF AGREEMENT

This agreement shall be for a period of ONE YEAR commencing from


2023 up to 2024, to renewal at the option of the (RESORT NAME).
IN WITNESS WHEREOF, the parties hereto affixed signature and
signify their conformity to this Agreement on this _____ day of _____ 2023 at

This document refers to a MEMORANDUM OF AGREEMENT pertaining to the


SWIMMING PROGRAM executed by between parties herein and consists of four (4) pages
including this page whereon the acknowledgement is written has signed by the herein parties and
their instrumental witness.
