STATEMENT / SYNOPSIS OF THE FACTS

THE INCIDENT:-
On May 12, 2044, at around 9:45 a.m., a brawl took place at the Brooklyn Street Metro
Station, where a mob led by a man named Stephen lynched another man named Robert. In the
commotion, a girl named Jessica was grievously injured when a knife slashed her throat. Both
the injured were admitted in the ICU at the Government General Hospital.

THE BACKGROUND:-
Robert Niro and Jessica Green were in a relationship since college time. Robert belonged to a
backward class family and Jessica came from a high caste family. Differences occurred
between the two when they moved to the city of Kanto on getting their jobs in Luthor
Enterprises, the company of Lex Luthor, as Jessica got a more handsome job than Robert.
Furthermore, Jessica’s best friend Stephen and other friends namely Rashmi and Monica
discouraged her to maintain her relationship with Robert. Stephen also had feelings for
Jessica. Jessica dreamt of becoming a air hostess and her dressing style also changed into a
more modern way. This ensued a fight between Jessica and Robert and Jessica decided to
break up with him by insulting him. Robert decided to resolve the issue by apologizing to her
at the Brooklyn Street Metro Station. Monica and Stephen also decided to join the meeting
and to remain at a distance. This is when the incident took place, when Robert took out a
knife to cut an apple in his hand and Stephen thought that he is going to harm Jessica and
throwed a stone at Robert’s head and started the fight.

AFTERMATH:-
The news spread like a fire on both the print and electronic media as both Jessica and Robert
belonged to different communities. The political leaders of both communities blamed each
other’s side for the incident and depicted a cruel communal animosity.

POLICE INVESTIGATION:-
Formal proceedings under Crpc took place where Robert was charged under IPC Sections
307 (Attempted Murder), 354D (Stalking) and 509 ( Word, gesture or act intended to insult
the modesty of a woman). Stephen was charged under IPC Sections 325 ( Voluntarily causing
grievous hurt ), 355 ( Assault or Criminal Force with intent to dishonor person, otherwise
than on grave provocation ), and 504 ( Intentional Insult with intent to provoke breach of
peace). Unknown persons who assaulted Robert were charged with Section 358 ( Assault or
Criminal Force on Grave Provocation ). The charge sheet was filed with the Sessions Court
and the magistrate committed the case for trial.
