J- Justifying Circumstances-Is considered lawful free from both


imprisonment and damages and is civilly liable

- he did not violate the law

- the accused dean to have not transgress the law

E- Exempting Circumstances- there is one thing that is part of the will


that makes you commit a crime ex- is an insane person who committed
a crime he will not be criminally liable but he will be sent to an asylum
to be better

-the exertion is the criminal liability

M- Mitigating Circumstances- he will be both civilly or criminally liable


but they are going to be lower

Effect – Reduces the penalty of the crime but does not erase criminal
liability nor change the nature of the crime

A-Aggravating Circumstances- the criminal and civil liability will go up

- the penalties are increase


- Definition – Those circumstance which raise the penalty for a
crime without exceeding the maximum applicable to that crime.
- Basis: The greater perversity of the offense

A- Alternative Circumstances- It may go up or it may go down in


criminal and civil liability
- those which must be taken into consideration as aggravating or
mitigating according to the nature and effects of the crime and other
conditions attending its commission.
