RE: INQUIRY ON THE PROCESS OF BALLO BOXES PULL-OUT

Sir:

This is in reference to the Manifestation made by the Clerk of Court of Branch 65 RTC Jordan
Guimaras. Protestant-Appellant would like to seek clarification on the following points:

1. On the transmittal of the ballot boxes. - Since the Ballot Boxes are no longer in the custody of the
RTC of Guimaras as early as October 19, 2022 with Notice only having been furnished to the
Protestant-Appellant on October 20,2022 after the fact. Who between the RTC BRANCH 65 and the
Protestant-Appellant can order that the ballot boxes be turned over to COMELEC?

2. On administrative liability of the Judge or Clerk of Court of Branch 65 RTC Guimaras- Is there any
administrative liability which can be raised against the Judge or the Branch Clerk of Court of Branch 65
for failing to notify the Protestant -Appellant as to the fact that the ballot boxes had been turned over
to the Municipal Treasurer on October 19, 2022 when the Court has been made aware that the
Protestant- Appellant had perfected the appeal on October 17, 2022?

3. On the absence of stenographic notes of the entire proceeeding- Is there any administrative liability
which can be raised against the Court and its personnel for failing to include the transcript of
stenographic notes pursuant to the Order of the Second Division dated October 25, 2022 which
requires the submission of three sets of the transcript of stenographic notes of the entire
proceeding?
