The matter is listed today for plaintiff's evidence. It

is observed that earlier the suit had been dismissed in default vide
order dated 17.09.2018. Subsequently the suit was revived upon
the application of the plaintiff. Vide order dated 02.12.2021, the
issues were framed and the matter was put up for trial and the
plaintiff was directed to file the affidavit in evidence. However,
no affidavit in evidence was filed by the plaintiff. Vide order
dated 25.04.2022, another opportunity was given to the plaintiff
to lead evidence, subject to costs of Rs.5,000/-. On the next date
of hearing i.e. on 22.08.2022 again none had appeared on behalf
of the plaintiff and the matter was adjourned, subject to costs of
Rs.3,000/.
In the above scenario, even today none has appeared
on behalf of the plaintiff despite repeated calls. As a last and final
opportunity to the plaintiff, re-list for plaintiff's evidence on
12.04.2023.
