Fundamental Rights of a State:

● Independence

- Sovereignty is the supreme political power inherent in a state by which a

state is governed. It has two aspects, internal and external. Internal
sovereignty refers to the power in its domestic affairs while external
sovereignty refers to the power to control its foreign affairs.

● Equality

- All rights of a state, regardless of their number, must be observed and

respected by the international community. Moreover, regardless of their
size or power, all states must be equal in whatever rights they are entitled
to.

● Territory

- The right to acquire territories as long as it is in accordance with the

generally accepted principles of international law and always it is
considerate to the territorial integrity of other states.
 WAKANDA TALOKAN

● Wakanda is considered a “state” ● They are hidden from the “surface

since they are recognized by the
international community.
● They have the right of
independence since their
sovereignty over their territories
and foreign policy and affairs is
respected by the international
community.
● Since they are a member of the
UN, they can enjoy the rights that
they are entitled to.
● Their claimed territories regarding
vibranium are well recognized by
the international community
world” which results in them not
recognized as a state.
● They have no independence in the
eyes of the international
community since they are hidden
underwater.
● They cannot enjoy such rights
since they are not well recognized
● Their territories are not “claimed” in
the eyes of the international
community since they are not
considered as a state.

In conclusion, Talokan is not considered as a state except in the perspective of

Wakanda. Legally, in the international community they are hidden from them
which makes them not considered as a state. Hence, any state can exploit the
Talokan claimed resources with any means necessary.
