UPON the Court handing down judgment in this appeal on 28 February 2023.

AND UPON the Court’s order of 14 March 2023, staying the proceedings until 25
April 2023.

AND UPON the parties reaching an agreement in respect of remedies but not in
respect of costs.

AND UPON the Respondent undertaking to the Court not to repeat words bearing
the meaning that Saini J found the Defendant’s TED Talk to bear, in his judgment
of 12 December 2019 ([2019] EWHC 3451 (QB)), namely “that on more than
one occasion Mr. Banks told untruths about a secret relationship he had with the
Russian Government in relation to acceptance of foreign funding of electoral
campaigns in breach of the law on such funding”.

BY CONSENT IT IS ORDERED THAT:


1. The Respondent pay the Appellant damages in the sum of £35,000 within 14
days of this Order.

2. The Court shall assess, on the papers, costs before the Court of Appeal and
before the High Court.

AND IT IS FURTHER DIRECTED THAT

3. Before costs are assessed, the Appellant may file and serve a written reply to the
Respondent’s written submissions on costs dated 8 March 2023. Any such reply
shall not exceed 10 pages and must be filed and served by no later than 4pm on
12 May 2023.
