Fact - These are defined as information that can be verified. These are
based on direct experience or observation.

Key terms: STATISTICS,PERCENTAGES,TRUTHS

Opinion - These are statements that convey beliefs, feelings,


judgments, attitudes, and preferences. Unlike facts, opinions cannot
be verified because these are based on one’s perception

Evidence - It is the means, sanctioned by the law of ascertaining in a
judicial proceeding the truth respecting a matter of fact (Section 1,
Rule 128, Revised Rules on Evidence). But to put it in layman’s terms,
it can be seen as information that helps us prove or demonstrate truth
– or disprove something false.
A. REAL EVIDENCE (material, tangible evidence such as an
object, a tape recording, a computer printout or a photograph)
B. DEMONSTRATIVE EVIDENCE (photographs of an accident
scene, x-rays of an injury, and graphs or charts showing
underlying data)
C. TESTIMONIAL EVIDENCE (a statement made under oath.
An example would be a witness pointing to someone in
the courtroom and saying, “That's the guy I saw robbing
the grocery store.”)
D. DOCUMENTARY EVIDENCE (Examples of documentary
evidence include wills, leases, memoranda, reports, contracts,
promissory notes, ransom notes and checks. Documentary evidence
must be authenticated before it is admissible.)
E. ANECDOTAL EVIDENCES ( usually based on individual
experiences or observations, as distinct from probabilistic
evidence that gives estimates of how likely something is to occur
based on experience with large numbers of people)
F. STATISTICAL EVIDENCES (collection of information that is
aggregated and then summarized using some mathematical
representation)
1. Opinions are statements that are true and can be proven and verified
objectively.
2. A fact is a statement that holds an element of belief.
3. An opinion is not always true and cannot be proven.
4. Understanding the difference between a fact and an opinion is an important
reading skill that builds high-level thinking skills.
5. Your ability to know the importance of evidence cannot be overemphasized.
6. We live in a world where not everything that we see, hear, and read is real.
7-8. Evidence is NOT admissible when it is relevant to the issue and is not
excluded by the law of these.
