AFFIDAVIT OF WITNESS
OF JUAN

This Affidavit of Witness of JUANITO was executed to constitute his direct

testimony in accordance with the provisions of the Judicial Affidavit Rule (A.M. No. 12-
8-8-SC) which took effect on October 10, 2022.

The questions were asked by _____________, with office address at Lanao del
Norte. Questions and Answers were made in Bisaya dialect, known, spoken, and
understood by the affiant, and then translated in the English language.

PURPOSE/S:
This Affidavit of Witness is being offered to constitute the direct testimony of the
witness. He will testify that there was no conversation between the private complainant
and the respondent.

Q1: Do you swear to tell the truth, the whole truth and nothing but the truth?
A1: Yes, Atty.
Q2: State your name, age, present address and other personal circumstances?
A2: I am Juan, 57 years old, gapuyo sa Bacolod.
Q3: Do you know that you are under oath, and you may be prosecuted criminally in
the event your statements are found to be not true?
A3: Yes, Sir.
Q4: Can you remember where were you on July 30, 2021?
A4: Trabaho mi ug coral mga alas syete kapin sa buntag. (I work a fence at around 7:00
o’clock in the morning.)
Q5: To whom did you work?
A5: Kang Teresa. Siya ang amo ko (To Teresa. She is my employer.)
Q6: How many months did you work from Teresa?
A6: Katong adlaw ra sir na naka coral mi uy, kay ge suhulan mi. (Only that day sir
because we are contract to do the fence.)
Q7: What is the instruction of Mrs. Teresa that you will do?
A7: Kana laging iyang balay ipa coral. Pugson man mi nya ug pabangag tong kanto.
Ingon ko nga “Di ko mubangag ana kay amoang trabaho mag coral. Kato ra
gyud na karaan ang sundon gyud.” (That we will put fence in her house. She was
forcing us to put dig to the adjacent area. I said that “I will not dig there because my
work was to construct fence. I will follow the last fence.”
Q8: Do you know Pedro?
A8: Karon pa gani mi nagkita. (I only meet him right now.)
Q9: Do you observe any confrontation between Teresa and Maria?
A9: Wala ma’y nahitabo nga ing-ana. (There was confrontation happened.)
Q10: What else you can say?
A10: Katong ilang ge kuan si sir nga gitiunay ug armas, wala. (Their alleged to sir about
the firearm, nothing happened.)
Q11: Are you there?
A11: Oo sir. Wala ma’y nahitabo. Nag-estorya ra sila ug kanang Kapitan. (Yes, sir.
Nothing happened. They only have conversation with the Barangay Captain.)
Q17: Do you have anything more to add or delete from your statements?
A17: No more, Atty.
