AFFIDAVIT OF DESISTANCE

I, JOAN VIADO y CAYABO, of legal age, married, Filipino and a

resident of Calaba, Bangued, Abra, after having been sworn to, in
accordance with law, hereby depose and state THAT:

1. I am the complaining witness for a case of THREATS in relation to

RA 10591 against JULIO BURTON BAYLE docked as Criminal Case
No. 2015-134 pending before Regional Trial Court, Branch 1.
Bangued, Abra;

2. The accused Julio Burton Bayle is my neighbor and also my

maternal uncle for being the brother of my mother Gerina Bayle
Cayabo;

3. The filing of the instant case was prompted by a prior

misunderstanding between the two of us. After careful
retrospection, I have come to a realization that all of my
statements are not true in all respects and but mere product of
misunderstanding;

4. For this reason, I am formally withdrawing my complaint against

the accused and recanting my sworn statement on such date as
appearing on the case records;

5. This affidavit of desistance is executed by me, of my own free will

and volition, without promise of reward or consideration, duress
or intimidation but for the purpose desisisting and formally
withdrawing the case of Threats in relation to RA 10591 in favor of
the accused in the spirit of reconciliation and goodwill with my
maternal uncle. I further waive all my rights and claims against the
accused in the said criminal case.
