PETITION FOR RECOGNITION

OF A FOREIGN JUDGMENT

Petitioner BEA ALONZO, of legal age, resident of #31 Mt. Gambier

st. Fairmount Hills Subdivision, Malate, Manila, Philippines, being duly
sworn under oath, petitions this Honorable Court for an Order of
Recognition of Foreign Judgment based on the following:

1. That petitioner herein Bea Alonzo and husband John Lloyd Cruz, an
American Citizen, was legally and validly married on 24 June 2011 in
Baclayon Church in Bohol.

2. That one year into their marriage, they acquired irreconcilable

differences. Hence, John Lloyd Cruz, who was fortunately an
American Citizen decided to file an application for divorce in Hong
Kong, on 25 June 2012 recognized as valid here in the Philippines
under Article 26 of the Family Code which states:

“Where a marriage between a Filipino citizen and a foreigner

is validly celebrated and a divorce is thereafter validly
obtained abroad by the alien spouse capacitating him or her
to remarry, the Filipino spouse shall likewise have capacity
to remarry under Philippine law.” (As amended by EO 227)

3. That the Matrimonial Causes Ordinance of Hong Kong, entitles the Hong
Kong Court with jurisdiction in divorce cases. That a divorce decree was
thereafter issued by the Hong Kong Court, within its jurisdiction, dissolving
the marriage between petitioner and John Lloyd Cruz capacitating the latter
to remarry. Said divorce decree became final on 22 August of the same
year. A certified true copy of said divorce decree is hereinafter attached as
ANNEX “A.”

4. That the Hong Kong court had jurisdiction over the subject matter and
persons of the divorce proceedings; that there was no violation of due
process; that there was no collusion, fraud or mistake of law or fact in the
proceedings leading to the issuance of the decree of divorce.

PRAYER

WHEREFORE, all premises considered, the petitioner respectfully

prays the attached certified Decree of Divorce be granted recognition and
enforcement by this Honorable Court in accordance with the appropriate
provisions of the Revised Rules on Evidence.
