As Artificial Intelligence (AI) speedingly helps the creation of Computer Generated

Images (CGI), laws protecting citizens from the harm it can cause are important to put emphasis
on. There has been instances where Photoshop, and recently, artificial image generator such as
Midjourney has been used to create deepfakes of people without their knowledge and consent.
The Anti-Cyber Crime group of the Philippines describes deepfakes as, “Deepfake is a type of
Artificial Intelligence (AI) used to create convincing image, audio and video hoaxes. Depending
on the content, a deepfake may infringe copyright, breach data protection law, and be
defamatory if it exposes the victim to ridicule.”
These softwares has been used to generate images of nude photos using fully clothed
pictures off a individual by manipulating it. And because many advancements in the program
has been made, it has been increassngy difficult to distinguish if its real or not and thus can be
used to spread around revenge porn aand use it as a tool of identity theft andd defamation.
REPUBLIC ACT No. 9995 or "Anti-Photo and Video Voyeurism Act of 2009" has long
since been set in place to combat the crime these programs make possible. However, theree
arre only four sitations where the actis calleda crime; 1.) if someone takes photos or videos of
someone in a sexual position without their consent, 2.) to reproduce the photo or video, 3.) to
distribute the photo or video, and 4.) to broadcast or publish the photo or video.
Form my point of view, R.A. 9995 needs a much needed update in order to have the
instance of creating false pornographic content of someone without their content under its
clause of protection because it creates the following scenarios that the four situations above
does as well; 1.) can be sued as revenge porn, 2.) can be used as identity theft (seemingly
publishing your own nude photos when you dont know of the account publisihing it or the photos
themselves), 3.) violation of consent, and 4.) psychological stressors and social ridicule.
