PROBLEM

Janice’s boss has asked her to design an innovative and efficient program. But
pressures of her position keep her from setting aside sufficient time to do the
requested work, so she’s thinking of presenting John’s program to her boss

SOLUTIONS

1) Ask for more time


2) Negotiate with John to present it as a collaboration
3) Take it as her program
4) Take it as a program developed under her supervision
5) Give John full credit
6) Make a one-time purchase offer to John for the rights to the program.

Which alternative would provide the greatest benefit to the greatest number of
stakeholders?

Number five, because this way they wouldn't have to raise John's salary, although
that is very cruel, and there could be repercussions in the future, such as a possible
lawsuit.

Costs can be measured


quantitatively, in terms of how
much money they would give John
if they increased his salary or
bought the rights to the program.

efficiency of the program.

What is the value of the public knowledge of ownership?

It is a value that cannot be measured objectively, since it has to do with pride in


having created the program.

What rights does each stakeholder have?

They have the right to execute/use anything that has been created in office time (if
it is specified in the contract).

Who has the right of ownership for a program developed on company time?

The company

Which alternative distributes the benefits and burdens most fairly?

Option two, because in this way Janice and John establish a negotiation and discuss
the pros and cons so that they can reach an agreement that benefits them both.

If John receives the promotion and raise that he wants, are the benefits being
fairly distributed to him if Janice claims authorship of the program?

It depends if John is interested in receiving the credit, however from my point of view
it is not fair, since John can receive a better external job offer if he is known as the
author of the software.
