AN ORDER SETTING UP DIFFERENT MECHANISMS TO PREVENT AND RESPOND TO GENDER-BASED SEXUAL


HARASSMENT
THE BARANGAY ANTI-SEXUAL HARASSMENT (ASH) DESK,
DESIGNATING ANTI SEXUAL HARASSMENT ENFORCERS (ASHEs) AND
ESTABLISHING THE ANTI SEXUAL HARASSMENT REFERRAL NETWORK

WHEREAS, the state values the dignity of every human person and guarantees full respect of human rights and
recognizes the role of women in nation building;

WHEREAS, Republic Act 11313 otherwise known as the Safe Spaces Act (SSA) expands the law on sexual
harassment in the country to cover all of its forms including verbal, non-verbal and physical; and secure all persons
regardless of sex, sexual orientation and gender identity and expression from all kinds of gender-based violence and
discrimination such as sexual harassment, not only in private spaces but also in public spaces;

WHEREAS, Section 8 of the Safe Spaces Act mandates all LGUs to prevent and respond to gender-based sexual
harassment (GBSH) in streets and public spaces;

WHEREAS, duties and responsibilities of the barangay government are stipulated in DILG PCW Joint
Memorandum Circular No. 2020-001 re: Localization of the Safe Spaces Act;

NOW THEREFORE, I, ____________________________, Punong Barangay of __________________________,


Bohol by virtue of the powers vested in me by law do hereby order the Setting Up of Different Mechanisms to Prevent
and Respond to Gender Based Sexual Harassment (GBSH).

Section 1. ESTABLISHMENT OF THE ASH DESK


1.A Purpose and Location
The Barangay ASH Desk is established for the purpose of expediting the receipt and processing of complaints and reports
of sexual harassment. The ASH Desk is set up at the _____________________________________________ in the
Barangay Hall to ensure that the right to privacy of the victim-survivor is protected at all times. It shall have the
necessary furniture and fixtures such as but not limited to tables, chairs and separate filing cabinet where the logbook
and tools/equipment for documentation are stored.

1B. Designation of ASH Desk Officer


The Barangay ASH Desk Officer is the Barangay VAW Desk Officer _____________________________________, a
woman, who shall be directly in charge of the daily operations of the ASH Desk. For this purpose the ASH Desk
Officer/VAW Desk Officer shall be trained to develop her skills and capacities necessary in the performance of her
functions. The trainings shall include and is not limited to the following: 1. Gender Sensitivity Training, 2. Salient
Provisions of the Safe Spaces Act 3. Salient provisions of other laws protecting women, children and members of SOGIE
including but not limited to: Anti Sexual Harassment Act; Anti Violence Against Women and their Children (RA 9262);
Anti-Photo and Video Voyeurism (RA 9995); Anti-Child Pornography Act (RA 9775); Special Protection of Children Against
Abuse, Exploitation and Discrimination Act (RA 7610); Anti-Trafficking in Persons Act (RA 9208 and RA 10364); Provisions
of the Revised Penal Code which are related to gender-based violence, Relevant Provisions of the Family Code 4. Existing
services of the city/municipal government and those provided under the ASH referral network 5. Protocols in handling
gender-based sexual harassment

1 C. Functions of the ASH Desk Officer


The ASH Desk Officer shall have the following functions:
1. Receive, document and respond to complaints and reports of GBSH in streets and public spaces (see Annexes 2
& 4)
2. Facilitate the referral of cases and persons to appropriate public and private service providers for further
assistance such as legal, medical, psycho social, safety, security and other services;
3. Record the number of cases of GBSH in streets and public spaces received and referred to other agencies, and
submit a quarterly report to the DILG City/Municipal Field Office and the City/Municipal Social Welfare and
Development Office (C/MSWDO);
4. Keep case records confidential and secure and ensure that only authorized personnel have access to these
records;
5. Assist in the formulation/updating of policies, development of plans, programs, projects and activities, and
educational and awareness campaigns to address GBSH in streets and public spaces;
6. Coordinate with pertinent agencies in monitoring the status of GBSH-related complaints and reports;
7. Perform other related functions as may be assigned.

Section 2. DESIGNATING ANTI-SEXUAL HARASSMENT ENFORCERS (ASHEs)


2A. Names of ASHEs
Barangay Tanods, community brigades and community service units are designated as Anti Sexual Harassment Enforcers
(ASHEs). Together with the ASH Desk Officer and members of the Katarungang Pambarangay, the ASHEs shall be trained
on Gender Sensitivity, the Safe Spaces Act and the Protocols in responding to GBSH in streets and public spaces. The
following are the designated Barangay ASHEs:

2B. Functions of the ASHEs


The ASHEs shall have the following functions:
1. Receive complaints on GBSH in streets and public spaces;
2. Immediately apprehend the perpetrator if caught in the act of committing a crime;
3. Immediately bring the perpetrator to the nearest police station for appropriate action
4. Together with the Women and Children’s Desk of the PNP stations, keep a ledger of perpetrators for the
purpose of determining if the perpetrator is a first-time, second-time or third-time offender.

Section 3. ESTABLISHING THE ANTI SEXUAL HARASSMENT REFERRAL NETWORK


An ASH referral network is established to strengthen the coordination among public and private service providers in
addressing the needs of victims-survivors of GBSH in streets and public spaces.

An ASH Referral Network is a mechanism in the barangay established to strengthen the coordination among public and
private service providers in addressing the needs of victim-survivors of gender-based sexual harassment. It shall provide
safety, security, and other relevant services. It shall coordinate with the city/municipal Referral Network for legal,
medical, psychosocial services. Further, the members of ASH Referral Network shall receive and efficiently act on
referrals from the ASH Desk and ASH Hotline for the provision of services needed by victim-survivors and witnesses of
gender-based sexual harassment. Protocols in this connection shall be formulated through an executive order,
ordinance or memorandum of agreement among the service providers.
