1. The petitioners are aggrieved that a proposed

rally/protest march of employees seeking

Dearness Allowances from the State, has been

declined by the Joint Commissioner of Police.

Three alternative routes have been suggested

which are not convenient for the petitioners.

2. Counsels have exchanged views in Court.

3. The petitioners shall hold their rally on May 6,

2023 between 1 p.m. to 4 p.m.

4. The route to be taken for the rally is from

Hazra More onward on Harza road, upto

Harish Mukherjee Road crossing. The rally will

take a right turn into the Harish Mukherjee

Road.

5. They shall proceed thereafter upto D.N. Ghosh

Road crossing and take a right turn and move

towards S.P. Mukherjee Road and converge

back at Hazra More.

6. The terms and conditions indicated in the

application at pages 29 and 30 of the writ

petition shall strictly be followed by the rally

holders.

7. The following persons shall be responsible for

the compliance of the said terms and

conditions of the holding of the peaceful rally,

Chandan Garai (iv) Sunirmal Das (v)

Subhashis Das (vi) Subir Saha (vii) Suparna

Chakraborty (viii) Tanmoy Gharui (ix)

Dhrupada Ghoshal (x) Shambhu Manna (xi)

Bhaswati Mukherjee and (xii) Bhaskar Ghosh.

8. It is expected that no inflammatory and/or

provocative speeches shall be made in course

of the rally. The rally shall be peaceful and the

petitioners shall conduct their program in an

orderly manner. The public at large shall not

be inconvenienced.

9. With the aforesaid observation, the instant

writ petition shall stand disposed of.

10. There shall be no order as to costs.

11. All parties shall act on the server copy of this

order duly downloaded from the official

website of this Court.
