included within ‘Volume I’ ‘My Life Truths’ have been included, yet I cannot deny that
considerable portions may be, either incomplete or many incidents might have been
forgotten, which would for sure, be recollected in due course.
2 Few relevant points were also, missed which would, either be corrected or added to, as &
when, it is feasible.
3 More incidents are under recall, which always remains as such in memory process.

Eng Bhushan Kumar Nagpal was a resident of 3555 Mohalla Jatwara Darya Ganj Delhi
1 I knew him personally, since 1972/1973, when he got admitted to Kashmere Gate
Polytechnic for studying Mechanical Engineering 3 years duration diploma education.
Though he had been residing at given address 3555 Mohalla Jatwara, Darya Ganj since
birth. I used to collect empty soft drink bottles from that house many times, but never
ever interacted with him or others.
2 I had met him in premises of Kashmere Gate Polytechnic one day, when he had been
admitted to Mechanical Engineering stream, when I had already entered into second year
of Civil Engineering Diploma Programme of 3 years. We knew each other as ordinary
residents, but did not know that we were studying in engineering stream. Then, we had
started chatting almost daily in college as well as, at home.
3 He started being friend of our family gradually. I found within him an intelligent, sincere
& honest person, which led us to continuation f personal friendship. My sisters also,
started calling him Bhushan Bhai or brother & this continued for year together. I
qualified engineering diploma successfully in 1974 & he also, passed one year later his
Mechanical Engineering Diploma. He had no issues relating to shortage of funding for
him & for his education.
4 As I mentioned somewhere else, that he was a step brother to Professor Eng Mr. K L
Nagpal, my engineering education godfather. Same father, but different mother. We had
developed excellent social & family relations since then & this relation continued till
1989/1990
5 After having passed his Engineering Diploma, he started his work at NTPC in operation.
I also, visited his office once or twice, just to see about working of operations in power
stations. It was Thermal Power Station, which technology uses coal for fuel. I had not
started my IEI Section ‘A’, but he being excellent n Mathematics started that while I was
very much busy on my MCD & Later, DDA works for years.
6 We often used to meet daily at our home. I also, used to visit him in his home, but not
frequently. His sister Ms. Geeta, his brother Mr. Ashok. His other brother Mr. Babbal /
Vinay & his one other brother all were then known to me. His step brother Professor Eng
Mr. K L Nagpal was very much known to me, for he had acted like my god father. His
one more step brother Mr. Gopal employed by Indian Air Force was also, known to us,
for he also, had been our one of customers. One Mr. H L Nagpal his extended cousin
also, working at Polytechnic was known to us. His father used to run a confectioner’s
business Halwai work at Delhi located at Pahar Ganj area. I could never understand
language spoken by his mother.
7 I often used to study at shop, where we used to work in our earlier life. It was now closed,
but I used to sit at that premise to study & to work, if so required. We often used to meet
there & talked a lot about various issues. My 2nd sister Ms. Madhu used to work in some
garment factor that time. She had befriended one girl named Geeta from Nepal. Eng Mr.
Bhushan had asked me to select that girl for me for alliance. I started thinking
affirmatively, but that proposal failed to work. There was no meaning & I had not
planned anything for my matrimonial issue, because, I was just new personnel in
 government & I required good funding for my family for my sisters 4 in number. Father
had just expired in 1974 & it was just 1975/1976/1977 etc. However, we were known in
our neigbourhood as good friends. I supported Eng Mr. Bhushan for his issues related to
house & he supported ours for miscellaneous purposes. One time, he certainly did some
concealed electric wiring in our one room old house, where all wires had been hanging
from walls / ceiling. I did curing work on plaster applied on wiring. He did PVC conduit
work & drawing wires. It was done nicely & room was converted into high Lux
illumination, which enlightened me, because it was now a good room for all us to sit &
study or work, as & when tubes were required. Eng Mr. Bhushan knew very well that I
had not generated any inclination towards undergoing further studies, for I had got a good
job & I looked pleased & satisfactory with that. He had been studying that time & already
he had passed few papers of Section ‘A’, which I never ever dreamt about. IEI Delhi state
centre was situated at ITO crossing. Whenever, I used to pass by that area, I used to look
at IEI building & thought that It was like a mountain for me to pass. I never ever planned
for studies, though it was a requirement to be named Bachelor in Engineering. He started
teasing me about not being capable to pass IEI examination, for I never ever talked about
studies, but job & other issues pertinent politics & news. I was very fond of news that
time & never ever missed evening 0800 hours bulletins & comments relayed by experts
thereafter. I never ever had gotten any interest in chitrahar or a list of film related songs
etc.
8 It was because of his teasing me that he knew about my not being serious in further
studies & may not be able to complete post diploma IEI degree studies scheme that he
had already started & passed some papers as well. He was very good in Mathematics. He
was very interested, if I could have married at an earliest. IEI Section ‘A’ contained ‘9’
mandatory papers, while Section ‘B’ contained ‘5’ mandatory papers & ‘3’ optional
papers. Once one passed Section’A’ that candidate had to pass mandatory Referred
review of candidate through IEI enrolled referee. Once cleared from it at least
undertaking of ‘6’ months, candidate would be eligible for Section ’B’ examination
appearance.
9 Based on his challenge, I also, started these studies & completed, before he could
complete his post diploma engineering degree. It is my soul related weakness, if someone
challenges me about something I cannot digest that challenge & can do that successfully,
come what may. I discovered this property within me at a later stage. Still, I have same
kind of conduct or character. Though no one challenges me, but I challenge self & start
doing something, which I never ever planned. It has become my habit to accept
challenges of whatever sort.
10 I did not tell anyone & started studies, though my name had already been enrolled with
IEI as student S 140642. I had decided to study first for making a professional career.
Eng Mr. Bhushan understood, because I started remaining busy in studies at shop & also,
I joined some private coaching centre located in Connaught Place Delhi for learning few
subjects like Mathematics I & II, Modern Physics, Element of Electrical Engineering,
Applied Thermodynamics, Engineering Drawing etc. Social Sciences & other 2 subjects,
I studied self without any input from professors.
11 Eng Mr. Bhushan was first employed by NTPC & used to work in BTPS, Badarpur
Thermal Power Station, based on his having earned engineering diploma qualification
12 Eng Mr. Bhushan later joined DDA, because of avoiding transfer to other power stations,
located all over India Bharat. He just wanted to stay in Delhi for caring his mother &
other issues
13 Eng Mr. Bhushan Had passed Section’A’. He was planning for admission to Section ‘B’ I
did not pass by that time. I appeared in first examination for 6 subjects, despite being
Black cough patient at that time. I passed IEI Degree before he could pass. Eng Mr.
Bhushan was really, astonished, when I told him that I had qualified IEI equivalent
degree named AMIE.
14 He knew very well that I had a concrete plan to leave DDA & joining some overseas
assignment, for which he too was supportive to me. In my absence in 1981, he acted like
my brother to fulfill engagement formality of my sister Ms. Sangeeta Saini. I was located
in Iraq at that time.
15 We used to inter chat & interact together almost daily & also, used to eat together at our
home. We had converted to say family friends. My family members including my mother
had been all open with him in discussing family issues & offering food to him, whenever
he used to visit. It was almost a routine. In fact, without meeting often, we could not feel
pleased
16 We often used to go to some astrologer or other type unnamed occupation persons like so
called Tantric. I knew nothing about such Tantric, but he had good knowledge, perhaps
from his family background. Once he took me to one such person, who had declared my
marriage date & surprisingly that date appeared to be fruitful or furtile. But, that Tantric
did not tell me consequences. For me, Tantric was a remotely acceptable occupation in
my understanding, but that time, I believed in learning lower level of Palmistry. He
always boosted about his own handling of his relatives & disclosed all issues to me
during our regular chatting activities.
17 No discussion about any girl or bad aspects of life, but just social & professional related
issues. We talked general issues. He knew me well that I had good command on English
& could write well. He was also, not interested in marriage, but then, he told me that his
elder brother’s friend, Mr. Vinod bhappa ji had convinced him to lead a normal life like
everyone does.
18 He had married earlier in 1986, when I was located in Doha Qatar. He was well settled
after his marriage. We had generated unexplained friction / ignorance past my marriage,
due to unknown reasons. No contact could be made with him after that time. I tried many
times to search on face book page, but failed in discovering anything related to him.
19 He had developed a habit of undergoing work of properties dealership, though he had
been employed in NTPC & later, in DDA. His interests were always involved in buying
plots in approved areas & then disposing all, when prices rose / hiked. He many times
told me that in Faridabad plot rate had fired immensely. He often used to sit with
Stockbrokers for handling his cash funds. His mind had always been immersed in
handling cash & dealing with sales & purchases of plots. In fact, he was a broker
businessperson. He was funded by his elder brother Eng Mr. Ashok, per his owns
statements. His elder brother had been employed in KSA on a regular permanent job.
20 Politically, Eng Mr. Bhushan had been virtually, RSS & BJP supporter & also, perhaps a
member of these bodies. He used to state always that BJP or past Jan Sangh for his family
were like a religious body. RSS for them was also, a religious body. But, we never ever
conferred on any political ground. We were just very good friends.
 21 In fact, post marriage in 1989, I was present in Doha Qatar on my long regular
assignment. In those days, communication was too poor. No mobiles, no computers were
available. Some misunderstanding occurred among family members including my newly
wedded wife. I had also, written some under evolved emotions, mischief against my
mother. Then, my wife acted against my mother offensively. My friend Eng Mr. Bhushan
failed to tackle this issue in a positive way. Then, I had to resign & come back for good. I
could not make that lost good for new good. I could not understand till today about, why
my friend Eng Mr. Bhushan could not handle my personal nuclear family issue
positively?

Architect Ms. Prema Kundra of Delhi
1 Architect Ms. Prema Kundra my Divorced wife, a permanent resident of B5/195
Safderjang Enclave, Delhi, who mentioned on a case petition filed against government
that her husband has expired, using title Late husband Suraj Singh. This beauty of her
mind, I knew, when I searched some item on internet & by chance, her case file appeared.
I laughed after reading her petition, related to her dispute with education department.
2 She had father & mother, two brothers, one elder sister, when I first time met her through
Mr. Abdul Salam alias Gopal.
3 I met her on 16.10.1988. She had already qualified architectural diploma & undergoing
further studies to complete architect’s degree that was required to be registered with
Architect council roll to use title architect in Bharat India
4 I deliberated with her about her capacity to digest prevailing circumstances & control
over expenditures. She responded that whatever resources we would have she may be
able to manage. She looked fine. Moreover, my requirement was to marry a reliable
equivalent qualified professional.
5 I searched only for professional candidates for marriage. Though Prof Mr. K L Nagpal
was not free in supporting this alliance, yet, I agreed for it against Professor Mr. K L
Nagpal & against my mother & sisters wishes.
6 I had clearly told my in laws, when her mother required to know about details of
properties, which I might have had. I did not have any property till then, which
information had been given to them, without having any degree of hesitation. It was up to
them whether or not, to accept me. Professor Mr. KL Nagpal had already told her that I
had undergone lot struggles in my life, yet, it moved on.
7 Day 18.10.1988 had been fixed for ceremony in one Arya Samaj temple & it was done.
8 No transactions of any money conducted or no gifts or no property of any kind was taken
from them.
9 I did not even accept gold finger ring.
10 We just completed marriage formalities.
11 My part was represented by mother, elder sister & one younger sister. One younger sister
could not be invited & also, youngest one could not be called in such shortest time. She
had been busy in her medical studies. My friend Eng Bhushan, Mr. Abdul Salam alias
Gopal, Eng Mr. M L Chauhan had been present.
12 From bride’s end, her parent, one brother & other family members, which I did not know
had been representing.
13 Marriage was concluded. Shifted for one night to Janpath hotel. Roamed to Nenital for 3
days. I then flew to Doha on 23.10.1988.
14 She got passport. I applied for visa. It failed.
15 I was upset, as she used to call me frequently & I had been disturbed.
16 Mr. Abdul Salam alias Gopal & my mother used to call me for complaints.
17 I used to be severely disturbed. Many writings from there & here started pouring in &
being sent. I could not digest. I was around 34 years that time.
18 Some issues happened with work due to undue tensions. I could not take any risk to an
extent disturbance caused on works of construction. I resigned & came back for
permanent reaching certain reliable solution.
19 I was asked by my sister that since, she could not stay with family members peacefully
therefore, I should have rented one accommodation & get experience of life. I agreed &
we got one rented accommodation in an apartment in Indira Vihar near Kingsway Camp /
Guru Teg Bahadur Nagar.
20 But, attempt failed due to daily heated arguments that she stormed on to me because of
my youngest sister Ms. Mala, who had been studying MBBS. My elder sister had been
staying there alone to help her, because Ms. Mala had failed in her first session, due to
having no concentration on studies. She had also, fallen sick.
21 Whereas for Mala / my family deliberated & reached a conclusion that elder sister should
hire certain accommodation & take out Mala from hostel. But, this management, my wife
did not accept & used to order me in heated voice to remove rented house & let Mala
reside in hostel. I did not agree with her. It happened & again happened & I do not know
about, how many midnights, I had to undergo such heated exchanges from her mouth. I
had no right to spoil career of Ms. Mala at that time, even at cost of destroying my family
life. Our one professor Mr. Surinder Singh was also, known to them like their respective
verbatim family member. He also, represented as a witness, when our marriage was
registered in registrar of marriages in Delhi, which had been a mandatory requirement for
an application for Qatar Visa.
22 He visited us many times & tried to settle scores, but all attempts resulted futile. Many
times she attacked my physically using her fists & palms & of course, kicked me. I had
become mad. She frequently used to criticize & use slang language for my elder sister &
other members. I had taken her to Vaishno Devi located in J & K one time. I had also,
taken her to my younger sister located in Punchkula / Chandigarh, just for a visit. She
also, complained to her about all these issues.
23 There used to be no dispute & quarrel between me & her to an extent or personal &
private relations had been concerned. Later, she started embarrassing me by stating that I
had no capacity to lead family. I was not like good husband. Sometimes, her conduct was
like a woman, who might have attacked brutally. I had already visited her sister &
respective family of her elder sister. I had also, visited some of her know relatives. She
always used to force me by words that I never followed her, when she used to visit her
home on Saturdays & Sundays. I used to go to my mother at our permanent rented home.
My mother used to cook for me & arrange all requirements. In evening, I used to go back
to my rented location, when wife Mrs. Prema stayed with her mother. I used to occupy or
shop to work on my writings about structures & engineering issues, because I had a
desire to disseminate knowledge among professionals.
 24 I had even, reported to local police about her bad conduct. Police joked with me & asked
you beat her. Well, it was going to be closed chapter sooner.
25 We vacated that rented accommodation in her absence. She got highest level anger as, if
sky had fallen. She filed a police complaint & FIR under IPC sections 498A / 406 had
been registered, leading me to land in jail lock up. I was admitted to bail. My ‘4' more
family members including Abdul Salam alias Gopal had been booked. I was sent to Tihar
Jail. All had been admitted to bail. My dream home had shattered into immeasurable
pieces. We had to face trial court up to 1995.
26 Also, dissolution of marriage petition was moved by me through Advocate Mr. R K
Saxena. That too had been moved till 1995, we paid alimony to her in Hon’ble Judge’s
presence & all households had been left to her forever.
27 FIR quashing petition was filed in High Court Delhi per law requirements, but she
ignored her undertaking signed in civil court. She did not receive any summon, which
had been sent to her through court, through police & through her polytechnic principal.
28 Ending those circumstances, High court ordered to quash FIR, after Public Prosecutor
one female advocate declared her having no objection for quashing FIR in high court
hearing.
29 We appeared in trial court, whose judge consigned FIR case file & freed us.
30 She had been very shrewd, because I later, received many requests from her through Mr.
Surjit Singh, a known one to our family in certain distant relation. He requested me that
my divorced wife had genuine intention to reunite with me. It happened many times.
31 That messenger personally requested me that for his reputation sake, I should accept to
live with her again. I told him that it would never happen. My professor & my soul would
never permit me this relation. Gone has gone. No way that I would make repetition of
mistakes in life. Fact remains that I never met her since 1994. Last meeting had been in
court, when I paid to her alimony in presence of Judge Mrs. Rekha Sharma. Practically,
we had separated since day I had been arrested by police.
32 Really, I admire her power to write my name as Late husband in her job oriented petition.
Well, it is her own soul, if she remains pleased with that. I am not going to loosen
anything on this account.

Supplement to this My Life Truths Supplement Part 5D Updated 06.05.2023

1 I did not know anything about Tantric actions or so called soul applications for making
use of powers inadvertently. None of our family members had acquired any knowledge
about such actions. Though our mother’s sister family members used to go to some Imam
or Maulvis for obtaining certain Tabeezs / Soul Tablets for having some soul benefit to
recover from diseases or for some commercial good. My father never ever believed in
such illogical soul actions. Same situation applied for my mother. But, all were not same
in society. I even never ever visited any temple for worship. I was fond of viewing
buildings, but that always remained exclusively only from structural viewpoint.
2 My spouse took me to one female Tantric from Bengal in south Delhi area, after a couple
of days from marriage, when we had returned from Nenital. I had work a Topaz ring that
time. I just sat in a chair, when that female Tantric viewed from distance that my Topaz
stone had developed cracks. I was not happy to see that female, which fact was known to
Ms. Prema Kundra. She told Tantric so called Guru Mata that I would not come to her.
 She told her that I would visit him & she had achieved a power to call me there. In fact, I
never ever visited that Tantric again.
3 There used to sit one Sadhu dress worn Tantric at near Hanuman Temple in Connaught
Place Delhi. I met him once, when I visited Hanuman Temple in Delhi located at
Parliament Street. I noticed one Sadhu type person sitting on a platform at tree. He used
to read palm & narrated future. In fact, he charged too little for that work.
4 Once, when we were tighter, I had taken my spouse to that Sadhu Swami. He told good
about her. After case, when I met him & asked him about, why he had told good about
her. he responded that she might be having some handkerchief with her empowered with
some soul power, which might had misled her to speak in her favour. He tried to justify
all that. Well, I had undergone stresses & could not analyse my bad fortune self.
5 I had met him suddenly, when once I was returning from Delhi Teez Hazari Court, after
attending criminal case date. He was sitting at Netazi Subhash park footpath at Edward
Park. I was very tense due to my being involved in criminal case. I with my 4 family
members were also, involved. I recognized that Sadhu being same person, whom I had
met at Connaught Place hanuman Mandir long back. He read my palm & told that I
would be involved in a case & go to prison. I was surprised on his forecast, but I had
already visited Tihar prison for 2 days on 4th December 1989. I trusted him & told him
facts. He asked me to see him at his tenancy resident located in Dakshinpuri in South. He
told me that he would charge rupees 10 for examination of my case. I could not
understand about what he means was. However, under stressful mind, I had to find some
solace with permanent solution from impact given to me by my matrimonial relations.
6 I visited him at his residence. He worked upon one activity, named Kriya. He told me by
reading certain black prints received on a white paper, which was kept underneath a
Shiva small statue kept under cover of a black curtain. He informed that there were many
persons involved in my case. They had all played with me. I had to get precaution from
those adverse impacts by conducting certain methods through that Sadhu alias Tantric.
He asked me that he would call me three times at week’s frequency to operate to perform
some spiritual actions. I had to pay him rupees 2500 ^ a list of material was given to me
to arrange before that performance could be commenced with. I was also, requested to get
some English quarter bottle for that purpose. That bottle shall be kept for that Tantric
operator’s soul, which would work for me I this case. I agreed upon, what that Tantric
advised me. I had to arrange funds as well, s all materials listed by him. He also, gave me
back something to throw on certain intersection or cross section on area, while leaving
for my Delhi Gate home.
7 I asked my mother & my friend about this issue. I asked someone to get me a bottle of
English Whisky per list. All materials were arranged & were handed to that Tatric along
with required funds. He started doing what was necessary for him. He did that long
sessions for three times. He asked me that I had to forget that woman for ever, because he
would leave her nowhere soul wise. However, I could not understand anything about,
what he meant was, but I continues doing what he asked me to do. He also, at late while
ending session asked me not to think about her & forget her forever, as if someone dies &
cremated like. I had been in interactions with him & us to meet him in Connaught Place
Hanuman temple location. I also, used to take him to my home & to other relatives. I
later, could understand that he was a Tantric, who often controlled some soul or doing
such actions to know facts about others. He also, told me that his reading palm was just a
 fiction, so that people could trust him, but in fact, only controlled soul that remained with
him always used to tell him about what answer should be given to person, whose palm
was under his eyes. He in fact just acted upon, but controlled soul had to work all
functions. To be very frank, despite being a highly academically qualified & experienced
person in profession of engineering, I started thinking & accepting him as a competent
soul scientist or professional. He often used to name him like a God’s Man. he had his
classmate Chandra Swami as well, who had been in prison that time. In fact, under
influence of such severe stresses, I had become mentally foolish, because of criminal case
ongoing against me & my family members for many years
8 In those, days I had been working on my design, drawings & town planning activities. I
involved him to my shop office to show him certain drawings & requested him to tell me
if these projects could be realized, which he responded affirmatively. I promised him, if I
had been successful in getting that project move, I would get him a house for permanent
ownership based residence. It was a long ongoing connections & interactions with him.
My mother also, visited his residence to know about, what I had been doing about my
case. This tantric also, visited our residence many times. It was like existing of a long
relation, but fictitious one ultimately, these resulted in at outset. This Tantric could not
help me successfully to have a start of that project through one promoter. I started
unbelieving that person or so called Holy Guru. I started strongly disbelieving him &
ultimately, after court case had been over, I started my job assignment journey for GCC
countries per my routine professional work. I restarted my works & continued to improve
my career & earnings, which had been stopped for continuous period of more than 5
years. God helped me & I cleared all borrowings in just a period of one year assignment.
9 I realized by experience that Tantric actions could help someone bodily, whereas could
harm someone detrimentally, but these could not help thrive business or else. One should
avoid such foolishness to use such Tantric powers, because all these are based on fictions
only. From that time onwards, I started thinking only for purpose of analysis & voided
such road/s that leads to delusions of such powers. One should use logic & mind & based
on determination hard work, one should move towards certain success, though success
may come after failure is attained.
10 Later, also, he tried to meet me in dreams, to ask me to extend my support to him, but I
started disputing with him seriously. In fact, I had been attracted towards Kalka Devi
through my dreams & I had become very well associated with that Devi Kalka for long.
Even currently, I have been her part for years together & she always helps me move
further. I fell mentally & soul wise extremely active & powerful even, living single. I do
not feel any problem in my life & also, I do not find any problem being single & having
no personal family. Kalka is my family in person. I represent nature & power of nature
per my contemplation. Kalka has uplifted me to azimuths in all respects. I feel very
powerful even, while I think for her! I become very powerful during my dreams to
oppose & succeed over my opponents or enemies in that soul power world.

Tantras / Secret Spiritual Acts

1 My general experience related to all those, who often, use Tantras for respective
development or for harming others. This experience has been based on my observations
& for sure based on, conducting interactions with those persons. I never ever believed in
all such issues, but society all over world has made me know that these practices do exist
 in word & these have no relations to specific faith or religion. In every so called known
religion, these good or bad practices are conducted. Person, those who do not intend to
work hard, intensively, but do have intention to get more & more easily for a comfortable
living use such practices. In our family, such talks were never held as I have pointed out
earlier.
2 But, now I feel that in society, these bad actions do occur & impact all others, so called
person, who do sincerely respective works. I have seen many nationalities, who are
indulged directly or indirectly to conduct such practices. I often, view faces of those, who
intend to harm me or my known to. These views are scene in pictorial forms. It is
sometimes very difficult to analyse these indications to reach certain conclusion. It is
also, true in majority cases that known relatives do these acts, either to harm others or to
draw undue benefits from others using power of soul or so called abusive Tantras.
3 In year 1981, when I had to go to Iraq for first time, one person was sent to my home by
my mousi or mother’s sister. That person told us that he was friend of our cousins. He
knew that I had to leave in a couple of day. He asked me, if certain assistance is required
for my protection, while working overseas, which offer, I failed to understand. He tried to
explain to me that everywhere, certain people would be hostile to you or would not
support you for survival. I did not believe that type of non sense. On what basis, one
could forecast as such & could protect from such impacts, if at all these had been
possible. I ignored all such advices & took that very normally. I had got job based on my
own capacity & of course, I had always been work oriented, without having any kind of
sluggishness. I had full confidence that there would be no enemy for me during
assignment tenure. But, that was also, true that during dreams I used to see many times,
horror scenes, which many times frightened me, but I least cared for such dreams.
4 I still remember one foreman from Bangladesh, who used to do out plumbing works on
site. If someone died, he used to go to mortuary. One day I asked him about, what for he
used to go to mortuary, I was astonished to know that he used to keep his palms on eyes
of dead body & got such impressions with him all times for certain useful strength. I
could not understand his senseless talk.
5 I was also, told by some person Eng Mukul Gangal about, impact of such forces! I could
not respond, but stated that everything could be possible in universe. In fact, one Kerala
safety personnel in a senior position Mr. Satish used to work in AJES, who was annoyed
with one administration officer of company. That person had warned administration
officer that he would spoil his life & career, had he not listened to what help he had
sought from him. That Arabic administration officer was also, little rigid in his working
approach. He least cared about that warning by Mr. Satish. I was told that that
administrative officer faced lot problems in his assignment & health & ultimately had to
leave job for ever. Nobody knew what had happened to him secretly.
6 I met one Arabic female from Lebanon once in Abu Dhabi. She used to work at
Consultants office. I had good contacts with her for purpose of submissions & also, often,
she used to talk to me friendly. She had married twice. She told me about her husband &
self that she could go to one religious type person, who had given her some item or cloth
to keep within or behind door reveal for purpose to control her in laws. I could realize
that it was not just confined to Bharat India. Many others told me similarly, such stories,
but I never ever believed all these. However, one could also, not discard such impacts,
because people good & bad both types are available all over.
 7 Later, I tried to search on Internet & also, materials from religion viewpoint visited. I got
information about many such issue & topic. One such item that amounts to topmost
significance is Yoni Puja, which means worship of females’ private organs. I am sure that
that worship mode must be very powerful, because, that organ works like generator for
universe, through which, humanity is brought or transported to Earth. May, be due to
having domination by male over females, such acts have been suppressed from
disseminating or sharing from time to time, but technically & scientifically considering,
this part of Tatra seems to be logical from every consideration. But, powerful males
would not like to accept such acts & also, females may not like to adopt such approach,
but facts cannot be denied. Female is only that body, which has been gifted by God to
have a chamber for generation & also, granted with a small automatic plant farm for
producing readymade fast food for newly born baby. Such facilities’ existence within
human body cannot be declined by anyone. Facts cannot be challenged. If something is
considered per existence of system & per science, these facts must be accepted rationally,
but who cares!
8 I have some kind of understanding about soul flow through human body, based on my
numbers science or Theurgy, if it cannot be called science. I consider my numbers related
calculation in relation to Theurgy or exponential work, never ever done earlier in known
history. According to this consideration, soul enters human body through respective
organ. Soul is already available in whole environment. Having entered human body, it
passes through seminal store & also, through womb in case of female, then it goes to
navel portion & after that, it reaches card area or heart zone. This much movement
remain self operative for purpose of survival of everyone. From heart onwards to reach
mind, it is human self to take it by application of efforts related to work. Those, persons,
who think a lot & work using mind a lot remain very powerful in keeping soul in mind ^
that soul is very difficult to be exhaled from mind. In fact, that power of soul or its
potential from mind can be distributed to other parts of body also for replenishment of
whatever loss is felt.
9 What is meant to state in above paragraph is that those, who use minds extensively,
cannot be harmed to full extent by stupid & abusive Tantric. Tatric cannot attack on
mind, but on organ. If mind is weak, it can be attacked for losses. If mind is strong &
organ is also, strong, no Tantric can immediately ham person. It is therefore, useful for
keeping sound mind & good physique that organ must be powerful along with mind. If
human organs are kept vibrated or in action mode, flow of soul entry keeps ongoing
passing through it to heart zone & then can be applied on to mental work at mind. Tantras
cannot be used by mind by Tantric. Concentrations & further concentration work can be
sequences similarly, as if it creates positive Tantra, rather than destructive Tantra. I
would always suggest all processionals & all those, who have some orientation in
whatever profession must adopt work based on deep thinking / sequence of concentration
& led to success in sequence of seraial numbers, because there exists no direct success in
any work.

DDA / Delhi Development Authority Assignment
1 In May 1975, I was transferred on deputation to Delhi Development Authority, where I
worked up to June 1981.
2 In DDA, I was posted on a housing scheme in Wazirpur Phase III, Ashok Vihar
designated supervising engineer for 180 MIG apartments for sanitary & water supply site
installations. MIG means Middle Income Group
3 I was very much involved with relevant items, respecting which, I requested my senior
officer AE in our department Eng Mr. Arora to buy for job supervision relevant codes. I
was allowed to buy relevant codes. I myself visited Manak Bhawan located near ITO in
Delhi & purchased related IS Codes to make sure that materials were of specified
standards.
4 I examined various contractors' procured materials & rejected many consignments to be
used on sanitary pipes, due to being of substandard quality. These pipes were installed
substandard on site by contractor Uppal Construction.
5 I also, raised observations on item of Lead filling / caulking in SCI Sand Cast Iron soil
pipes joints.
6 Substandard works measurements & certification was entered on official measurement
books, which created havoc in division.
7 I was asked by my senior engineer to tell name of colleague, who had misguided me in
writing all this rejections in measurement books.
8 I frankly told that I did not consult anybody due to fact that there was no requirement as
such. I maintained that on my own consideration, I had decided to reject materials. I
proved that argument, while referring standard codes.
9 Then, I was asked to tell contractor, from where he should buy products that complied
with requirement of code.
10 I answered that it was responsibility of contractor & not mine. Either senior/s had to
guide contractor.
11 I also, raised about missing competency of plumber as contractor, who being a qualified
engineer, claimed that he was degree engineer, quiet competent to do plumbing works
himself to which statement, I did not agree contractually, as contract conditions required /
mandated presence of a licensed plumber to prosecute & supervise all sanitary &
plumbing items.
12 My senior had sought opinion from DDA management regarding plumber issue, who was
responded by Executive Engineer to ask contractor to refer license of plumber per
contract & bye law requirement
13 In a while, consequently, I was transferred from that project. All wanted to get rid of my
association on site. Executive engineer supported to transfer me to some other project.
14 I was posted on a Convenient Shopping Centre construction project for supervision in
another area in Ashok Vihar locality. Project was located just adjacent to Laxmi Bai
College for women
15 There, my senior Eng Mr. V P Soni was to an extent cooperative, but aim of that engineer
too was to make money as much as, possible.
16 I worked there successfully, since contractor Mr. Bajaj was delivering good work & used
to listen to DDA engineers. Mr. Bajaj had got good construction knowledge.
17 I also, supervised another shopping centre during that time in same area. I experienced on
various construction projects, where my friends & colleagues had been deployed to
supervise that no one was concerned with quality controls & even, no serious
 consideration was made on workmanship, though that too should have been a part of
quality system. Significant point was that brick walls were raised first & then only, two
sides formwork was erected for RCC columns. I asked my colleagues that it was wrong
practice. One Junior Engineer Mr. Goel told me, if I also, do that way, contractor would
pay to you something. That was contemplation within minds of DDA engineers in those
days. In those days, cement & steel reinforcing bars used to be in short supply &
therefore, DDA had a policy to hoard these items & then issue to contractors, per
requirement & respective recoveries used to be made from valuations or so called bills.
Often, 25% of cement received from DDA stores used to be diverted on its way to site to
some other locations, but DDA engineers indicated right quantity per delivery notes. An
amount was fixed for DDA engineers to be paid by contractors as an inducement.
Consumption statement respecting cement was also, shown per theoretical requirement.
Same policy used to be applied for reinforcing steel bars. A high profile indirect
corruption method used to be conducted by generally, whole DDA & possibly, in other
government construction bodies. Engineers were also, paid certain commission on
whatever running bills used to be approved by department. Generally, DDA engineers
used to call this type of transactions equal to ‘Salt in Wheat Flour’ or in Hindi ‘Aaate
Men Namak’
18 During these projects construction currencies, there was a government declaration of
imposition of national emergency in year 1976.
19 Certain rehabilitation schemes in districts were taken up by government in surrounding
areas of Delhi.
20 Resettlement colonies in trans Yamuna areas, such as Khichripur, Kalyanpuri, Gajipur
etc. were taken up to develop for those people related resettlement, who were removed
from Delhi slums areas like Ajmeri Gate, Turkman Gate & these homeless had required
to be rehabilitated in those new dwelling colonies.
21 I was posted therein intermittently for supervising works of drains, brick on edge floors
& paths, earth filing activities in massive volumes.
22 No quality control was effective there as well, excepting considering progress quantity.
Payments to vendors were being made by various government engineers fraudulently,
irrespective of real number of trucks of earth fill material delivered.
23 During monsoon rains, Dhansa dam in West Delhi overflowed, where I was also, posted
as one of contributors for flood control for few days.
24 Thereafter, a period of three years, I was transferred to another department called JJ &
Slums.
25 In year 1976 during national emergency time, my younger sister Ms. Madhu Saini, who
had passed / graduated school, was proposed by Mr. Ranbir Saini of Delhi Gate locality.
My younger sister used to work at certain part time jobs like milk in some local
organization & also, at some readymade garments company. Sister was married with Mr.
Ranbir Saini. They started living separately from their parent, because his family
members did not join this marriage, despite his father had agreed to conduct participation.
Reason being that we were too poor to organize such marriage, yet considerable expenses
were spent on this marriage. Mr. Ranbir Saini cooperated very well to solemnize his
marriage with my sister Ms. Madhu Saini. They had to struggle for many years to settle
economically. Celebration of marriage was organized in DAV School premises located in
Darya Ganj, Delhi
26 I was also, allotted one supervision job for Village Wazirpur in Ashok Vihar area for
storm water drainage system over entire village. This job was awarded to a local
contractor. I supervised that job successfully for a couple of months. No structures were
involved in this job, because it amounted to providing ordinary utilities. My main activity
was to ensure that works were carried out per specification. I had to prepare work done
valuation bills for purpose of making payments to contractor. This project was delivered
successfully by contractor.
27 Once, I was also, given charge of Wazirpur JJ Colony area works store, located on main
road leading to Ashok Vihar area. This was a maintenance assignment. Requirement was
that low profile colony from resettlement profile required its day to day maintenance for
general public. Activities were defined as all hand pumps must work efficiently. All tube
wells must work efficiently & water supply to that area must be given chlorination. Id
certain disease like fever spread, information from public must be given to medical
officers. Roads if required, repairs that must be done. If some works were required, for
maintenance or small level area development, arrangement must be done based on funds
available with municipality or authority. Related estimates were necessary to be
formulated or charted out & submitted for sanction for execution purpose, when funds
approved by department. Procedure was, if some complaint received from community or
individual members, these were required to be attended & facilities kept normally
running / functional. I never ever waited for compliant, rather I used to visit area with
assistance or mates & noted out whatever deficiency in operations existed immediately
noted down & instructed these to be reinstated immediately. If spare parts were not
available, estimates were drawn for procurement of same. I never ever considered it right
that we should wait for people to come for registering complaints, for it was our job as
government body to take care of facilities. Many chlorinators were also, installed there
for purpose of water treatment for direct supplies to all homes. I did not find this job vey
cumbersome, because it was not related to project construction, but annual repair &
maintenance. Daily, almost whole day residents from that colony used to come to me for
asking or requesting for one item or other. I did not let them wait for nothing, but
remained serviceable to solve whatever issues lied writing my jurisdiction.
28 I started my Section ‘A’ IEI studies in 1978. Used to attend few subjects classes in
Connaught Place area of Delhi. Math ‘1’ & Math ‘2’, Modern Physics, Elements of
Electrical Engineering, Applied Thermodynamics, and Engineering Drawing were
subjects for which, I attended one private college.
29 In year 1978 in slum & JJ, I was posted at Mangolpuri colony to supervise works of
development, but since I had to appear in IEI Section ‘A’ examinations, I left works in
name of medical illness, as I suffered from dysentery. This works store was a difficult
case for me because it had enrolled hundreds sweeping workers to be controlled on
Muster Rolls in addition to general category of maintenance & development works. I
decided that it would disturb my studies, because Mangol Puri colony was located at
considerable distance from my home as well as, control of many hundreds sweeping
workers could be a difficult assignment.
30 I did not go to site works for about one month. DDA JJ & Slumps representative also,
visited my residence to investigate whether or not, I was really sick or I had applied false
request. In fact, I was factually sick in due course & not only sick, but also, had been
suffering from black cough for long.
31 I appeared in examination for six subject papers & passed five.
32 I could not pass Applied Thermodynamics in first attempt. I got just 20 marks out of 100.
33 I was then posted for an environment improvement works in slums, which I carried out
for many months. I conducted environmental surveys in area covering Jama Masjid to
Delhi Gate localities, so that Katras that did not have any toilet or WC facilities could be
provided with. Katra was defined as a private house with 5 families. These houses were
to be provided with environment improvement programmes. I used to work in day time,
while studied during late night. Area was in my residential locality, which permitted me
do job rapidly, for I had to travel nowhere, except to report to office located at
Jhandewalan Cycle market. This assignment helped me to invest some hours on to my
pending studies
34 Just for reference- During this period, my elder sister left to Tamilnadu to join our family
friend, but no formal marriage was solemnized, due to religious complication. I stressed
many times to both that this shall not work, but our mother & all family members were in
consent of this conduct. It was told by my sister, when I visited her in Madras that I
agreed for this relation conditionally that no religious conversion shall affect.
Unfortunately, that family had a plan that my sister should convert, but this was not
accepted at any cost. Dispute occurred, but family friend was supportive in every respect,
except this condition. He helped our family a lot during my overseas stay to take care. He
too visited Saudi Arab one time for some assignment. That unbecoming unofficial
relation between him & my sister did not work smoothly & cordially.
35 I passed IEI Section ‘A’ in Winter year 1978.
36 Later, I was transferred back to DDA General Wing in year 1979.
37 Meanwhile, after resuming my job, I requested Superintending Engineer Mr. Jindal to
post me in Planning & Coordination or in planning only.
38 He was surprised & asked about, why I was not interested in projects.
39 I plainly requested him that I was doing my studies of IEI Section ‘A’ & ‘B’, for which, I
required time for studies.
40 He was pleased & therefore, agreed to post me accordingly.
41 I worked in that posting successfully.
42 I was then posted in survey of works departments, where I worked to scrutinize tenders /
related cost & engineering justifications, related to tendered rates.
43 Many design works, discussions & review etc. though on smaller scale were involved. I
used to join private college run by Professor Ramamurtham, located on Karol Bagh /
Patel Nagar Road, Delhi. I availed this posting opportunity, since my evening office was
located at Jhandewalan, distance hardly 2 Kms from evening college. I used to go on
class day by walking from office to college. My studies were going on very fine, as I had
passed already eight of nine Section ‘A’ subject papers.
44 Simultaneously, I had been attending Section ‘B’ classes.
45 I passed IEI Section ‘A’ in Winter year 1978.
46 I had to appear in on a ‘6’ months’ observation by IEI referee, regarding my professional
working & learning, which was a mandatory requirement to appear in Section ‘B’
examination. I had been referred by my own choice one MIE, who had army related
experience. I & other ‘2’ students also, joined his guidance. He also, raised many
interview questions about RCC works & other items. He tried to examine our general
knowledge. He asked about some slab that had collapsed in Delhi during that period. I
 replied to his satisfaction. He advised all us for working based on self & avoid support
from others to an extent, maximum possible. I was required to write a diary or works &
reasons pertinent our decisions making. This diary was handed over to him for evaluation
after a period of ‘6’ months. Well, after that, I received my Section ‘B’ examination roll
number, which means that I was declared successful by referee.
47 I passed IEI Section ‘B’ in Winter’s examination session year 1980 just in ‘2’ attempts.
First I failed in optional subject pre stressed Concrete. Later, I changed my subject to
Water Resources, if I correctly recall. In Section’A’ I got 60% average & in Section’B’
65% average. Only subject that I got maximum was Applied Thermodynamics in Section
‘A’ being 80%
48 During my IEI degree studies, I had in my mind to find an opportunity to leave for
overseas assignment to Middle East. I had applied to DDA for issue of NOC for passport
application. I had filled required PP form, supported by MP Mr. Bhiku Nath Jain from
Chandni Chowk constituency, who without raising any question & problem, signed /
supported my form, when I visited his villa, located at civil Lines Delhi. I still remember
his simple personality & cooperation. DDA did not approve application for NOC, but just
sent back application requiring that it should have been applied on standard form. It took
many months for concerned official to return application with such comments. In those
days, Mr. Vajpayee was foreign minister, who had ordered issue of PP for government
servant had respective department failed to issue NOC within ‘15’ days, when demanded
by PP officers. I had applied for issue of PP, which was later issued to me successfully. I
had applied for emigration clearance by depositing my degree certificate, which I had
obtained in year 1981 & PP was issued.
49 I was interviewed by Continental Construction Company limited for Iraq assignment,
where during very difficult interview, I had to face rejection as well as, embarrassment,
due to fact in those days, DDA was ill reputed, whereas certain RCC overhead tanks
constructed by department had failed / collapsed.
50 I was shocked to be asked a question about my contribution to that tank’s collapse. Very
high profile site practical concrete questions were raised, which I failed to reply
satisfactorily, because I just worked in supervision capacity in DDA. At that time I
started feeling that I was not a competent engineer to an extent, site production & quality
remained concerned. I thought that I shall have to get / acquire more knowledge, when I
get an opportunity to work overseas. I was asked many other concrete mixing questions
that I could not successfully reply & felt ashamed of my low practical knowledge or
experience proficiency.
51 Later, in summer 1981, I was successfully selected as Junior Project Engineer by M/S
Ansals Properties Overseas with a salary 210 ID +10 ID. I proceeded to Iraq within a
couple of weeks.
52 Left DDA job for good.
53 Many of my colleagues had advised me not to give up government jobs, but my
conscience pushed me away, reason being I needed short term earning to meet imminent
expenses towards my father’s survivors / family members. Also, my cousins advised me
not to go leaving government job, but I least bothered. Fact remains that to get something
one has to leave something else / other something.
54 Though DDA job was good one from financial viewpoint, for I used to get 1200 rupees
monthly salary, but engineering technicalities were not considered on merits, even in
 dreams, whereas I intended to be an Engineer & not a technical billing clerk. All my
colleagues, who got recruited along with my recruitment group, were surprised about my
leaving government position. They all enjoyed their livings per DDA bungling customs
in those days.

18.4.2018, but due to ROW issues involved, impacting certain delays on contract
progress, revised contract practical completion date has been virtually considered to be
appointed 30.04.2019, which date has so far been taken as an existing understanding,
 reached between Contractor & Owner for all practical purposes to consider it as Practical
Completion date
2 According to communications transpired, between Contractor & Project Engineer,
records evidence that two schedules were received by / Client, One schedule defining
practical completion date 30.04.2019 named Crash Programme Schedule by an own term,
used by Contractor
3 Second Schedule defining practical completion date 15.12.2019 named Impacted
Programme Contract Schedule by an own term, used by EPC Contractor
4 During meeting conducted on site on 10.04.2018 between / among / Client, Contractor &
by presence of TPM team members, Contractor did not agree to honour contractually
schedule referred to Crash status, due to its intention that, there exists no contractual legal
obligation, owned by Contractor to this date.
5 According to Contractor, for all Contractual purposes, Impacted Schedule indicating
practical completion date 15.12.2019 is assumed an agreed / implied practical completion
date, between / Client & Contractor
6 Contractor contended that it has been moving project progress accordingly
7 Contractor further declined to accept Crash Schedule, as a document to be relied upon by
both Contractor & Client, reason being that it was just worked out to meet request made
by Client, if it could be possible to carry out all activities by or on this date, whereas, all
liabilities would be covered under consideration of practical completion date, in line to
Impacted Schedule exclusively
8 Moreover, seriously, Contractor raised a point that so far / Client has not communicated
any formal approval of any date, which date must have been agreed upon for whatever
Extensions of Time period
9 Upon asking about validity of Practical Completion day 30.04.2019, Contractor
expressed its unwillingness to admit any promise & declined to mandate it for any
contractual purpose
10 Contractor pleaded that first Client should declare / notify approval of Extension of Time
& Practical Completion date
11 And accordingly, All others issues would thereafter, only be conferred with
12 At one time, Contractor even threatened to stop / cease working on site from next day,
but later, withdrew that contention, when crossed upon to refer to, under what article on
contract, it was intended to claim & challenge about
13 After having deliberated during meeting, there was left no other meaning to continue
meeting for progress monitoring purpose, because project practical closure is Unforeseen
& Unforeseen status cannot move project
14 Progress health has suffered & further shall be suffering every day
15 Considering this a very serious issue on this contract, / TPC conferred with JDA / Client
Project Engineer, so as to have resolve this issue on an urgent basis, respecting, which
consequently, an urgent mail was communicated by / TPC from Project Engineer’s office
to Hon VC / Client on same evening of 10.10.2018
16 Keeping abreast foregoing descriptions & real circumstances, / Client is requested to
seriously take up this issue & conclusively, make decisions whatsoever / Client deems fit
in project delivery interest

Site Progress Status Quantity wise

 1 Site progress has so far not been satisfactory, keeping off schedule line considerably,
which is unacceptable state on behalf of EPC Contractor
2 All areas involved, which are / were required to be progressed efficiently have lagged
behind comparatively, more than that / what is expected in normal circumstances
3 Project progress has not even crossed half mark
4 So far, progress evaluation is being done to Crash date 30.04.2019
5 No optimism exists that project can be delivered by this date30.04.2019
6 Project progress is in perils & requires ICU treatment for every purpose of recoveries of
lost contract time / duration

Site Progress Status Quality wise

1 Progress should move in consonance with work quality for specified delivery of good
works
2 Quality demanded from Contractor has suffered heavily, due to not being inline to project
specifications / General specifications conformance, impacted upon with intolerable
deviations from defined ones
3 Defects have been noticed at all locations horizontally / vertically & observed by bare
eyes, giving a very bad impression of non professionally delivered products
4 Defects amount to such nature that even remedial actions shall be too difficult to carry
out, certainly constituting another project within a project & to be time & cost consuming
5 Required consistency on products remains absent & nobody knows about, real reliability
of such works to give service satisfactorily, during life cycle of product
6 Concrete product cannot be taken for granted from quality management organization
viewpoint, but this site is an exception to produce unacceptable works
7 Honeycombing, porous surfaces, cracks formations, failure of verticality, when seen by
plumb, out of lines structures, lack of vibrations, lack of work standards, no controls on
joints, formations of cold joints & many more points / and in many locations, failure of
concrete mix reaching below post tensioning cables & somewhere, even reinforcing bars
seen exposed
8 Contractor staff on site was also, notified one time, during our visit, because it was using
for permanent activities set cement, which can nowhere be allowed
9 Quality performance on this project can be defined, as completely unbecoming from
structural engineering viewpoint

1 Contractor does not look to be very serious to deliver required quality work

10 Progress achieved so far is unsatisfactory in each & every respect of progress related

11 It evidences that EPC contractor has not prosecuted project execution to required degree
of diligence & seriousness, as should have been expected of an experienced EPC
contractor on such a Mega project of public infrastructure utility interest
12 Owner / Authority Client has many times brought to Contractor’s notice, about weak
execution speed
13 EPC contractor has not applied required diligent potential care to accelerate progress
pace, which could have been possible by augmenting available resources to meet
additional requirements
14 Current Project status suggests that completion milestone 30.04.2018 may not be
achieved at current moving speed, if such as slow contract work pace continues
15 Per Contract Provision Article 8.14 Delays during Construction covers issue of Recovery
Plan, which EPC contractor must propose ‘lost schedule recovery plan’, giving all details,
pertinent augmentation on all required resources immediately for approval
16 EPC contractor may upgrade its speed by working in shifts round clock, if feasible, with
prior required permissions and during this accelerated work prosecution pace, frequency
of progress review visit must be increased for better monitoring

Major Issues Involved on Works Quality

Observations related to EPC Contractor Performance
Serious Attention Required!
1 Observing whole site generally, indicates that quality & workmanship are too poor at
various locations, at all levels of work vertically & at all locations horizontally
 2 Honey combing, porosity on surfaces, lost control & cold joints formations at various
vertical junctions, lack of plumbs control, which in some locations are unacceptable
3 At so many locations, forms were not fixed to design lines that missing workmanship has
been responsible for deviation on lines
4 Form bulging is also, seen as if it happened normally, with no protective measures
adopted by EPC Contractor
5 Some portions of suspended slabs show, hollow areas, where to concrete mix failed to
reach, due to conducting bad supervision. This hollowness at soffit or near slab soffit
indicates that it missed vibrations as well, as different mixes of concrete batch gapped
supply time, excessively
6 Central batching plant is located distant, which is quiet good to delay concrete delivery
by truck & in many instances, transport time could be more than one hour, which is not
acceptable, due to reason that initial setting time does not permit this gap
7 Overall picture tells that no site controls have been maintained & pouring activities not
done in a harmonious uniform way to achieve a near uniform concrete production
8 Rebars storing is also, unacceptable. Also, rusted bars have been included on permanent
works, which act goes against specification, convention & durability of concrete
9 EPC Contractor devastated quality requirement & site controls to a level that is
unacceptable / unbecoming of such a value mega project
10 It looks likely that EPC Contractor employed key personnel do not have adequate top
management required support to prosecute site works in a professional manner
11 EPC Contractor failed to establish & maintain required documentations for various
processes applicable on various activities
12 Conclusively, it can be contended that a failure remains dominant on whole project on
behalf of EPC Contractor to consider this project, as if it played with a kid’s toy, which
does not require any seriousness, if broken
13 Defective concrete works have been repaired by EPC Contractor, without even referring
to knowledge of Project Engineer & its team
14 EPC Contractor has broken project strength & reliability / durability in all respects
15 On areas located near berm of Main High Road exists pedestrians cross over bridge,
which transfers its loading actions on to existing soil, which is not well retained & can
subside any time, possibly resulting in accident. This point had been notified to EPC
contractor a number of times, but no seriousness demonstrated by EPC Contractor to
resolve this issue
16 Work related to retaining wall is too slow & equal to nil that can cause heavy sliding on
side by sudden sliding of earth & certain seismic horizontal shear may damage current
stability of soil

Observations related to Project Superintendence & Overall Control on Contractor’s

1 It has been too seriously observed that Project Engineer acts in a professional manner
completely & remain heavily stressed, due to drawing / getting no sound & solid
cooperation from assistances, such as AEEs
2 Project Engineer must be provided professional right support to manage controls in an
efficient manner or else, quality & progress shall be further adversely impacted upon
 3 Project assistance at senior level must be charted over for a professional deployment, so
that site head Project Engineer termed in Contract ‘Engineer’ is well supported to control
& monitor EPC Contractor’s lapses
4 An example is referred to that EPC Contractor has carried out remedial measures at
various locations of defects, without even site control engineers being aware of it. which
non control inactive state is out of our understanding about, how it could be affected
5 No work of remedial measures can be carried out, without technical & engineering
proposal method statement submitted by EPC Contractor & sequential approval is
granted, prior to prosecuting such remedial actions, but this working principle has been
ignored by EPC Contractor & Project Controllers

1 Financial Damages caused due to completion delays can be operated by imposing on
contract progressive interim valuation / billing, per included EPC Contract Volume Part 2

1 Per contract requirement EPC Contract Article 8, Quality Plan document is a mandatory
requirement, which if not approved so far must be demanded to be proposed by EPC

2 Quality Plan is also, a part on Project completion Dossiers to be packaged & approved at
completion time
3 Quality audit required to be conducted by Owner, whether or not, effected per contract
under this provision
 4 Past progress has reported that quality has been impacted upon / lagged behind standards,
at various locations of buildings & other components
5 EPC contractor has been notified many times on record that adequate steps must have
been resorted to, to remedy bad quality works, wherever indicated

1 Site looks untidy for various temporary / preparatory used materials & various materials
to be used for permanent inclusions were noticed lying here & there around in a
haphazard manner, brought to notice of site safety representative to maintain safety intact
2 Such materials could hamper on working of personal, leading to unsafe site environment /
activities
3 No protection to earth has been applied from being subsided, on areas, exposed to free
standing earth, which would not resist seismic actions, for it is zone I, whereas, this issue
was also, notified on TPM 5th visit records
4 No improvement is seen on application of shotcrete, as observed during last visit as well

Materials
1 Contractor was asked to keep acceptable storage of materials particularly, new steel to be
used for permanent works
2 Reinforcing bars were noticed rusted with loose particles tinting finger touch & rust
powder drops observed
3 Protection must be conducted to avoid moisture that can spoil bonding surface
4 Observed relative humidity is more than 60% currently in month of October, which is
good enough to corrode surfaces of steel reinforcement, if steel remains exposed to
weather
5 Wherever, rusting has occurred, sand blasting on to rebar surfaces should be applied,
regarding which, contractor responded that they apply that method, prior to shifting
rebars to cutting & bending machine
6 But, certain locations on site, did not witness / corroborate about, what Site
Representative has stated
7 However, necessary precaution must be adhered to, both on site as well as, in rebar
cutting & bending working areas

Quality & Workmanship

1 This is a serious issue on site for whatever quantum of works of concrete structure have
so far been carried out
2 Just by distant & close vision, defects are noticed at various locations
3 Photographs of many of all such locations were recorded / collected for including
exhibits
4 Requirement of concrete, per design is specified Fair Face
5 Production of Fair Face concrete is not an easy activity to be carried out
6 Many considerable locations speak that concrete pouring was not done, adopting /
conducting necessary quality supervision & surveillance
7 Columns exhibit honey combing at various locations, at various levels of columns heights
 8 Columns were cast in vertical stage shifts, keeping port height 1.2 M & up to not more
than 2m, which causes no issue, but joints between both vertical casts, old & new do
show joint issues, which at many locations are not acceptable & would certainly require
remedial measures
9 Various locations indicate that cold joints were allowed, which could be avoided
10 Indication are that concrete crew members, require further training to understand concrete
vibration, for over vibration has been caused leading to segregation of poured material
11 Vibration seems to have continued, even after bubble formations
12 Many locations indicate that columns are not in plumb within specified limits
13 Joint at junctions of various structural members indicate unprepared pours, where forms
were not managed, with due preparatory diligence
14 Suspended slabs also, indicate undulations, which require remedial measures
15 Various locations on columns surfaces indicate crack formations
16 Site after concreting has got a lot horizontal & vertical grinding areas, which shall
certainly consume time & cost
17 In certain post tensioned areas, cracks are noticed, which requires remedial measures
18 These cracks understandingly, have been caused by post tensioning reversal of stresses of
tendons containing cables
19 Structural Cables might have not been placed exactly in correct designed locations
20 Contractor requires to propose all method statements, pertinent remedial of concrete
defective areas
21 Contractor was advised on site, during Walkthrough to conduct all post concrete surveys
to find defective areas, so as to propose remedial measures for Project Engineer’s
approval
22 Quality representative informed that issues, related to site quality observations were
handed to site officials & respective Internal NCRs [NCR=Non Conformance Report ]
issued

1 EPC Contractor, TPC & / Client to complete project in defined time, maintaining joint
efforts project execution spirit
2 TPM / TPC raised a question regarding deliberations to be conducted for project
valuation, in line to revised schedule with project schedule completion date 30.04.2019
3 EPC Contractor refuted this schedule stating that they have planned to carry out works in
line to Impacted Schedule that defines milestone for completion dated 15.12.2019
4 TPM team & / Client stressed that revised programme schedule fixing milestone of
completion dated 30.04.2019 had already been adopted on all documentations, as issue
was agreed during certain meeting with EPC Project Coordinator
5 Therefore, it was final on part of EPC Contractor to accept completion milestone date
30.04.2019 for all contract monitoring & duration purposes
6 EPC Contractor disputed this issue, with absolute denial to accept referred date
30.04.2019, stating that it was scheduled to honour Client’s request only, whereas, it had
nothing to do contractually, for it does not constitute contract schedule, per contract
requirement
7 Further, EPC Contractor stated that this document was issued only for purpose to
expedite work, whereas, formally, Impacted schedule has been considered by EPC
Contractor as evaluation measurement ruling schedule for progress monitoring purpose
8 EPC Contractor, after having reciprocating many arguments from both ends, rejected
validity of so titled Crash Schedule for it has got no contract mandate on this project
9 EPC Contractor claimed that per its consideration, completion final date remains
15.12.2018, until Client’s certifies another date based on contract extension, due to fact
that they have so far not been issued any Extension of Time approval, which status
construes that contract duration has already expired, per original agreed Completion
Milestone definition
10 EPC stated that it shall stop work, which statement was later verbally withdrawn, when
EPC Project In-charge been cross questioned, about its legal consistency on contract
11 EPC stated that it could stop TPM team from its site activities of monitoring for EPC had
entered into contract with Client
12 EPC management shall decide about completion date, whereas Project In-charge was not
empowered, so as to decide on this administrative contractual issue

1 TPM raised a point with Project In charge EPC, in relation to schedule completion
date 30.04.2019, communicated by contractor, per crashed schedule vide

2 Contractor out rightly denied authenticity of said document, stating that there was no
contractual binding with submitted document.
3 Contractor stated that two schedules were submitted with that reference
Ref.No---------------------------------------------------. One schedule was submitted as
Impacted Schedule, showing project completion date on 15.12.2019 & another
schedule, which indicated completion date 30.04.2019, was submitted as a formality
to Client, without constituting any contractual binding on EPC contractor.
4 However, till date, contractor was complying to complete project on 30.04.2019 on
all progressive documentation.
5 EPC contractor has already submitted a recovery plan, based on date 15.12.2019,
which has been out rightly rejected.
6 Per EPC Contractor, project is scheduled to be completed by 15.12.2019 according to
impacted schedule.
7 EPC Contractor also, stated that because, no extension has been formally granted,
project duration stands expired since April 2018.
8 This has been a disputed contractual issue, for no agreed completion date exists as on
this day
9 EPC Contractor did not accept any mutual agreements made in past dated 08.05.2018,
during formal meetings with Contractor’s Project Coordinator cum Add. GM, TPM
team & PE Client
10 This issue has gone out of decision making jurisdiction of EPC Contractor site
representative, per his statement that he has no contractual authority to commit any
date, such as 30.04.2019.
11 Contractual completion date calculated, including extension has not been defined /
appointed till now, due to extending no cooperation by EPC contractor, which made
no meaning to continue this contractual progress monitoring meeting.
12 Project Manager EPC refused to disseminate any information related to this project,
until contract completion date is finalized. Through this mail, a request is made to
chart out an urgent Top Management meeting, between both parties to resolve this
issue.
13 Further contract progress meeting shall only be formally conducted, after this major
contractual disputed issue is resolved. Kindly, make arrangement for Top
Management meeting to further progress reviews.

indicated comprehensively
12 So many other contract issues have been included, without elaboration of project
requirements & future of contract prosecution
13 Contract must contain, either embedded Dispute Resolution section or a separately
defined part
14 In this case, embedded provision has been made, which does not give / expose any
problem, but procedure & requirements have not been explained
15 Dispute resolution must be included in full details to avoid aggressive procedure &

making even revised schedule inadequate to cope up with recovery of lost period,
keeping in view quantum of all ‘balance works to go’ uncontrollable
10 Enclosed progress abstract sheet exhibits actual delay, caused on various components &
gross overall delays, with indicative progress achieved percentage, percentages based on
revised schedule (progress sheet to be attached)
11 Progress achieved so far is unsatisfactory in each & every respect of schedule related

12 It evidences that EPC contractor has not prosecuted project execution to required degree
of diligence & seriousness, as should have been expected of an experienced EPC
contractor on such a Mega project of public infrastructure utility interest

14 EPC contractor has not applied required diligence / potential care to accelerate progress
pace, which could have been to augmenting available resources to meet additional
requirements
15 Current Project status suggests that completion milestone 30.04.2019 may not be
achieved at current moving speed, if existing slow contract work pace continues
16 Per Contract Provision Article 8.14 ‘Delays during Construction’ covers involves issue of
‘Comprehensive Recovery Plan’ document, which EPC contractor must propose ‘lost
schedule recovery plan’, giving all details, pertinent augmentation on all required
resources immediately for approval
17 EPC contractor may upgrade its speed by working in shifts round days & nights, if
feasible, with prior required permissions, and during this accelerated work prosecution
pace, frequency of Authority Client progress control, monitoring & review visit must be
increased for better performance at all levels
18 And, EPC contractor must submit its required resources augmentation details urgently to
owner Client for review & approvals / concurrence
19 And, if EPC contractor fails so to do, no other alternative for correction of critical
contract state is left, except imposing additional contract action, by operating balance
works to be carried out by Owner / Authority Client employing another suitable
 contracting party at Risk & Cost of EPC Contractor, in line to Article 9.5 ‘Power to
Client to undertake works’
20 Per Article 8.16 Quarterly video recording is required, if not effected, be conducted,
regarding which, according to feedback provided by Project Engineer, only 2 or 3 Video
records have been submitted by EPC Contractor, since commencement of works

1 It has been too seriously observed that Project Engineer acts in a professional manner
completely & remain heavily stressed, due to often drawing no sound & solid cooperation
from assistances, such as AEEs
2 Project engineer must be provided professional right support to manage controls in an
efficient manner, or else, quality & progress shall be further adversely impacted upon
3 Project assistance at senior level must be charted over for a professional deployment, so
that site head Project Engineer termed in Contract ‘Engineer’ be well supported to control
& monitor EPC Contractor’s lapses
4 An example is referred to that EPC Contractor has carried out remedial measures at
various locations of defects, without even site control engineers being aware of it, which
non control inactive state is out of our understanding, how it could be affected
5 No work of remedial measures can be carried out, without technical & engineering
proposal method statement submitted by EPC Contractor & sequential approval is
granted, prior to prosecuting such remedial actions, but this working principle has been
ignored by EPC Contractor & Project Controllers
6 Project requires intensive remedial measures almost everywhere, which activity shall take
lot time & if fact, this activity itself amounts to a sub project within a prime project
7 Even by resorting to surfaces grinding, further applications of chemicals would be
required, in line to Construction Chemical manufacturer’s recommendations, which is
required to be consulted with that manufacturer, to get method statements of each
considerable location
8 Project Site team of EPC Contractor is required to be firmly laced at its neck &
tightened/fastened adequately to bring them back to professionalism

Temperature / Materials Arrived both Permanent & Temporary / Preparatory, Equipment
 Movement to & fro site, Safety related issues, Work approvals, Works planned, Visitors,
other whatever recordable on issues
2 Material Submittals giving details of material, source, codal & specification compliance,
delivery issues, test reports,
3 Shop & Working Drawings submittals / coordination drawings / BBS etc.
4 Key personnel CVs submissions with complete details, including from Project
Coordinator, Project Manager, Senior Engineers all disciplines, Site Engineers, &
personnel posted on responsible positions, including key personnel from subcontractors,
if sublet with Client approvals

Suggestive Contractual Actions Required Currently

1 Financial Damages caused, due to completion delays can be operated by imposing on
contract progressive interim valuation/billing, per included EPC Contract Volume Part 2
2 In compliance to Applicable Contract Reference, Contract Volume Part 2 section
7.3.2/7.3.3/7.3.4 provides condition to impose delay damages #0.05% contract price each
day to a maximum 10% of contract lump sum, for delay on each milestone, respecting
which, a Prior notice is required to be given to contractor
3 In case, if in future within revised schedule Milestone date, delay recoveries can be made,
these deducted Liquidated damages sums could be released to EPC Contractor, without
allowing any interest on imposed deduction
4 But, provisionally, damages to an extent 10% contract sum can be made by withholding
to this extent, price from current valuation billing
5 Contractual provision 8.14 entitling ‘Delays during Construction ‘covers issue of

6 Regarding substandard works not conforming to contract documents & applicable

Quality Conformance Requirement Criteria Under Contract Article 8

contractor
2 Quality Plan is also, a part on Project completion Dossiers to be packaged & approved at
completion time
3 Quality audit required to be conducted by Owner, whether or not effected per contract
under this provision
4 Past progress has reported that quality has been impacted upon/lagged behind standards,
at various locations of buildings & other components
5 EPC contractor has been notified many times on record that adequate steps must have
been resorted to, to remedy bad quality works, wherever indicated
6 EPC contractor has not complied with required Quality procedures to conform to
applicable project specifications & acceptable workmanship
7 If contractor fails to conduct in conformance to Quality Requirement at whatever location
of whatever activities, a Non Conformance Report is required to be raised ‘open’ by
Resident Engineer / Engineer / Quality Engineer & issued to EPC contractor for adequate
action to remedy defects or substandard worked produced
8 It is suggested that all activities that have been devoid of required quality must be
produced on NCRs with sequence & issued to EPC Contractor immediately for carrying
out defects corrective measures
9 EPC contractor must immediately propose corrective actions/measures methods
statements for Resident Engineer’s approval & Management Consultant concurrence
10 All areas & further linked sequence activities must not be paid for, until these reports are
closed on NCRs
11 No time extension can be granted on such corrective acts & all these corrections are
required to be done by EPC contractor at its own complete expenses/cost
12 All areas must be inspected for general quality controls, so that whatever remaining
controls, if left could be secured from Quality viewpoint
13 Activity based work method statements must be produced by EPC contractor for
approvals
14 If project execution statement has not been approved till now, must be demanded for
approval

NCR Non Conformance Report

A non-conformance report or non-conformity report or NCR, is a construction related document
that addresses specification’s deviation or work that fails to meet quality standards.
1 This report is used in quality control processes by detailing relevant problem about, how
it occurred and how to prevent it from happening again.
2 NCR also, is used in determining a resolution with an owner / client and documenting
about, whatever corrective or remedial action is required on to non compliance /
deviating changes made.

Non-Conformance Report Items

A Non-Conformance Report must include at a minimum following information:
1 What is main reason for NCR or what went wrong?
2 Why work doesn't meet specifications?
3 What can be done to prevent problem from happening again?
4 Explanation of corrective action taken / to be taken
5 Key players involved in NCR and specs affected under NCR

When to Issue a Non-Conformance Report

There are many common scenarios in construction industry that require issuance of NCR:
1 Work that was not built, as indicated in approved ‘Issued for Construction drawings’
2 Work that fails to meet specified tolerances, as established in project specifications
3 Work that is being performed, using non-approved methods or standards
4 Failure to follow approved testing and inspection plan
5 Testing results demonstrate that product does not meet established and approved
standards
6 Material used that has not been approved, as a substitute (equal or similar) 
7 Design is not accurate and does not represent actual field conditions
8 Approved procedure was not followed and quality defects have been identified by project
team

Who Can Issue an NCR?

1 A non-conformance report can be issued by either of competent project team members.
2 Report must present a non-debatable fact and include clear and sufficient backup
information that supports claim.
3 NCR follows agreed-upon conditions for tracking and closing report, after appropriate
corrections are made.
4 Non-conformance reports often are used, as training tools for team leaders to train other
employees to help prevent similar situations from happening again.
5 It can be issued by quality controls within contracting site organization & also, by
consulting supervisor, employed by either owner or employer.

Non Conformance Report Consequences

 1 While NCRs are critical for quality control, they can introduce additional problems into
contract. Sometimes NCRs can be seen by financial institutions, as red flags or can be
identified as poor performance situations by contractor with potential for financial impact
on future projects.
2 In some situations, NCR's can open door to claims and even further arbitration processes.
3 NCR's can also, lead to delays in construction process, when additional resources are
needed correct situations or areas being affected by report.
4 There is a lot of paperwork and research associated / required with an NCR, as issuing
party must gather information, specifications, standards, and list procedures that were
affected by situation.

What to Do When You Receive an NCR

If you are recipient of an NCR, you must act promptly and at a minimum, follow these steps for
a quick resolution:
1 Meet with person issuing the NCR.
2 Implement corrective action and make sure through an inspection process that issue has
been solved adequately.
3 Respond with a formal letter or other document, outlining process that led to action that
triggered NCR, documenting action to solve issue and explaining steps taken to prevent
problem from recurring.
4 Make sure that your counterpart agrees and signs off on your action plan.

1 An Analysis by an ordinary citizen, related to BJP government performance since 2014

Macro Economics
1 When previous Congress government demitted office, economy was in good shape, with
considerable reserve of foreign exchange
2 Facts cannot be denied that new government always states that previous government
hollowed reserves, but records do speak of their own
3 It is true that worldwide economies have slumped, duo to bad state of its affairs
4 Internationally, oil price fall has contributed immensely to bad state of macro level
economy
5 New government had a plus benefit that savings on oil prices were not transferred to
consumers, but stoked in revenue, which saving by an approximations amounts to
2.5Lakh crores
6 It can conveniently be adjudged from percentage on FD being paid by banks
 7 During demitted government regime, FD was 9% for one year, where to for seniors 0.5 %
was augmented
8 Now this rate has come down to 6.7% per year only
9 Fall in FD interest rates explicitly indicates that no demand exists in market for
investment
10 Further augmented by additional funds with banks by all deposits arrived, due to scraping
notes action, which probably brought 15.5 Lakhs crores to nation
11 Banks shall have to pay at least saving interest on all these deposits, if these public funds
are not converted to FDs, which @ 4% / annum would cost an varying amount 250 crores
to 350 crores per day, means monthly 250 x 30 = 7500 crores
12 This invited liability shall certainly be imposed on public by taxes
13 This money shall be beneficial only, if public or companies are able to get loans for
progress in their businesses
14 So far, there has not been any sign that this collected money has been used satisfactorily
15 Of course, government forced more than 25 crores Jan Dhan accounts for poor, but that
has value only, if these accounts work, otherwise, this results in additional expenses on to
banks, which would add transaction charges to other accounts, which they have already
commenced with
16 Those poor, who opened these accounts may not get good benefit, but others non Jan
Dhan accounts shall certainly be impacted adversely
17 Most adversely impacted by reduction in interests are Senior & veterans, who have lost
considerable interest sums monthly, which state has added to their already hard &
difficult life

Job market
1 State of job market has deteriorated considerably, due to various factors
2 There appears to be no resting situation in country, due to arousing sentiments by certain
classes of citizens, who have left no act undone to create tension among various sections
of peace loving societies
3 Religious issues have started imposing relevant adverse effects on society, due to
scaling / scaring approach among certain sections.
4 Issue of cow slaughter, Ram Mandir construction & certain other issues like Hindu Rastra
have internally spread fire among large number of citizens
5 Law & order all over has been a failure to run easy life for every day news of murders,
rapes, loot etc. boil nation
6 To add fuel to fire, generally all leading national TV channels are contributing immensely
to arouse sentiments of those, who have nothing to involve with all such issues
7 Some TV channels have started broadcasting in a manner as DD used to work for GOI of
that time naming India is Indira & Indira is India
8 These channels were expected to broadcast positive activities, so that nation is helped,
public is educated, but these channels do not believe in such programs, which talk of
economic assistance & its development
9 All time every day, these channels just waste many hours of public by conducting debates
with empanelling same faces from various political parties & similar religion groups
 10 These TV channels belong indirectly to various political parties or otherwise are paid by
them, so that these channels work accordingly, while these least bother that such actions
are against journalism profession
11 Sabka Saath Sabka Vikas slogan has been lost in turmoil somewhere, though head of
council claims that he has been working on that slogan, which is not seen to me at least
12 Public pay taxes for getting facilities from developments, so that nation develops & kept
well secured, but it is not seen working in right spirit
13 Taxes are being misused, by applying freebies to public in name of poor persons
development
14 It seems that GOI has been unable to understand thoroughly complexity of national
economics
15 Public had voted this government mainly for eradication of corruption & remitting black
monies, which had been accused by its political party, parked overseas by politicians,
business people & all others
16 One SIT was constituted to resolve this issue, but it has been now 3 years, since SIT has
just been sitting with no concrete results
17 All feel that future of jobs is not in good state of affairs, for thousands have been
retrenched even from IT Sector
18 Service sector too has deteriorated for it moves, when economy moves, but now economy
has stopped that rapidly, as it did in past years
19 Indeed this government has continuously been winning election, but that state does not
prove that it / election victory is due to its performance, but due to live hope that people
still trust or that there is no option left for them, like they vote negatively sometimes

Government Servants
1 They continue to perform as they used to do in past regimes, with no efficiency
2 Corruption is still existing, while works are not moving, as should move
3 Of course, when no major decisions, pertinent projects are taken, no bad records can be
created
4 Same has happened with this government for no work, no mistakes or caused errors or
malpractice
5 In spite of their being inefficient & unproductive, like previous regime, this regime too
increased their salaries considerably, putting undue burden on revenue / taxes

New projects / New Assets!!

1 Nothing added, all same, rather delayed progress
2 No major employment on growing curve
3 Crime magnitude has enhanced for those, who got no jobs self force to commit crime like
loot, rape or otherwise, howsoever to make money
4 No new assets in form of Industries added
5 Money has been spent on non productive activities

National security
1 Nothing changed-terrorism continues-border issues continue
2 Relations with neighbours are net very admirable
3 Education
 4 Well we cannot expect dynamic changes on education in 3 years period, but public
schools have been looting parents, leaving no point of consideration
5 Lot of improvement is required on professional education around pan India Bharat, so
that it matches international standard
6 Engineering education was reached to ‘Washington Accord’ by previous regime, while
new Regime needs maintain & upgrade that
7 Very bad quality ‘Engineers’ from private universities & colleges have been entering
profession, but with no value, for they are not suitable for jobs, which quality less
universities must be either closed or improved, but most of these could be owned by
leaders from all political parties & industrial houses

any Institution recognized, under a law or is registered, as an ‘engineer’ under any law
for time being in force

1 That 70% of amount released for real estate project from allottees from time to time shall
be deposited in a separate account to be maintained in a scheduled bank to cover cost of
construction & land cost & shall be used only that purpose
2 Provided that promoter shall withdraw amount from separate account to cover cost of
project in proportion to percentage of completion of project
3 Provided further that amount from separate account shall be withdrawn by promoter,
after it is certified by an ‘engineer’, by an ‘architect’ & a chartered accountant in practice,
that withdrawal is in proportion to percentage of completion of project

Section 19(1) Rights & duties of allottees

1 Though it is not specifically included as a mandate within RERA, yet customer as
allottees have got a right to get independent advice & information through a self
certification, an alternative authority
2 This advice & functional information includes a third party scrutiny over all works
conducted & prosecuted by promoter directly or through employing certain contractor,

 3 Allottees Association so constituted or to be constituted may appoint an ‘engineer’ Civil
to supervise all project activities on behalf of said association, who would review all

8 In no case, promoter hired engineer & architect can be entrusted by allottees for
reliability, for they would not be working independently
9 It shall be in an interest of buyers / allottees to expend a little sum on this protective
arrangement, which would stand in a way to eliminate substandard works
10 Chartered Engineer (India) & Professional Engineer (India) would constitute best choice
for quality protective activity including operations under RERA provisions
11 All schedule banks should keep in their respective considerations, when deciding to
recommend Engineers for statutory purpose of certifying percentage of work achieved
that Chartered Engineer (India) & Professional Engineer (India) be invited for such a
significant function.

5 Communication is a significant part of project management / organization
6 Those, who do not have excellent knowledge about professional fields, but possess good
communicative powers, instantly impress others & get credits for knowledge that they do
not have of course, they talk to those, who got knowledge & then transfer this acquisition
through communication like a journalist works or a lawyer works
7 Various sorts of persons are involved in professional fields
8 Those who can talk loudly & at length
9 Those who can talk point to point
10 Those who can talk very descriptively & repetitively
11 Those who can write clearly & at length
12 Those who can write with details & with length
13 Those who can write point to point
14 Those who can write very descriptively & repetitively
15 Those who talks a lot, often forget after few minutes, about what was talked to someone,
but feel pleased that someone heard them

Pakistan & Bharat Relations?
1 Can they be friends? Never!!!
2 Whole world knows about never ever existed cordial relations, between these two nations
since 1947, when Pakistan was borne as a new nation on earth
3 Two brothers from same parent or by domination same mother know very well that they
belonged to one family & one culture for long during unknown history
4 Blood of these two brothers is same group & same soul, yet they would not be friendly,
as it is by nature that two separated brothers can never live in complete cooperation, can
never respect to each other & cannot act benevolent to each other
5 Had they certain characteristics to live as such as said, there would have been no reason
that separation might have occured
6 Separation in such a killing manner explicitly indicates that they were not in fact brothers
by souls, but by bodies only
7 When, it has now been more than 70 years that these brothers have generated enough
enmity played for & against each other, for how long more, they should afford such state
of killing each other?
8 It is an ignorant term to use that they are neighbours, for this neigbourly relation is made
by geography only, which can be dealt with perfectly, but in this case, it cannot work for
this relation does not dominate
9 Then what should be done, so that hatred occupying souls could be eliminated?
10 As a person & citizen of one of these two states, I think that Bharat is wasting time in
contemplating that relations shall improve / turn cooperative & cordial one day, which
day would never appear in many millenium/s
11 Relations can improve, if thoughts are reliable, pure & for good, but in this case, there are
thoughts, based on capturing each other to rule over other
12 I think religion does not play that part, as society belonging to both brotherly nations
contemplate
13 Religions that are criticised for, do not value for these are mixed in religious characters
14 These religions do not claim that these are true, but just forced by certain circumstances
& by certain intruders, yet culture could not be changed, excepting style of worship
15 For time being, let us forget consideration of religious factor, which does not weigh that

16 There was a thought in some contemplative school that these be reunited to constitute a
major power, but I think that concept in current scenario is a complete illogical
17 In this case, complete foundation is based on superiority & inferiority, where superiority
weighs much higher than other

limit, where to stop all this adverse conducts
23 By such actions of fire, people located on both geographies turn boiling & situation keep
on worsening from fire to shot fire to blasting explosives, then to jungle fire & then to
chemical fires
24 They are bound to follow international agreements in letter & spirits as well, while there
are bipartite agreements
25 None of these is so strong to go oppose whole world
26 General public does not think logically, but instantly covered under blanket of sentiments
& emotions, while TV channels & politicians add fuel to fire, throwing away minds
operations to deep pits
27 Public are aroused for few weeks & then public is understood to forget all burning issues,
since they have to work as well to eat
28 Youth does not analyse each & every issue per norms / standards & laws
29 Then, war is also, not an appreciable option, whereas, continued casualties as well are not
acceptable
30 One should avoid competition that they kill one, we shall kill 10 or more
31 Such statements can be good in politics to win elections, but, practically fail to move
beyond that
32 Public is too easy to be aroused by these useless performing politicians for they can do
anything to win votes, but forget welfare of people & nation after that scene, when they
enter into political offices, from which time all promises & assurances are kept in lockers,
whose keys are lost forever & would have capacity to justify their non performance as
well & act, as if they are only patriots
33 Best solution is to conduct talks between both nations & try out solutions one after other
34 Are we ready for wars also, another point to be considered?
35 No, we are not ready for nuclear wars, which shall destroy us in addition to other normal

36 It is also, not possible to avoid nuclear wars, when normal war breaks, for who shall
prevent such nuclear wars not to break during formal wars?

6 Do not hesitate to talk to even lowest profile people, who could assist one better than
other profiles
7 Obtaining assistance from higher profile is a hard nut, not so easy, for they do not help
8 They shall be able to help one, when one is successful
9 All projects are advanced & realized, using minds direction
10 Mind works very successfully, as it is singly used
11 If two minds sit together to confer, problems start pouring in & lead to term
brainstorming
12 Do not care for brainstorming in commencement of your plan
13 Just start working on project making hundreds of mistakes, but those would be edited, as
are done on Word
14 Use other sources as editors of project, once work has been done with many wrongs
15 Once direction is allowed by self & movement is gained, further direction shall be
dependent on whatever right or wrong has been achieved
16 It is like a medico, who prescribes a medicine as trial & then after lapse of 3 days,
changes medicine for a better performance
 17 No profession is difficult one, when one has a clear concept & a lead idea, how to move
further gradually
18 Logical activity shall reach one to logical results, of course parameters or resulting
attributes may not match required or specified one
19 Every further step based on previous step & current one automatically guides that step
20 Do work & do not concern about result for result is not in ones control, while each further
step is a result or fruit of back steps
21 When Sun rises, everybody views!!!
22 When one is able to commission start up of project, many others shall certainly try join,
support idea & project
23 Try to do all activities self, using ones mind
24 Do not think that one is specialist of this & shall not do that
25 Work makes a person specialist & expert
26 Education just shows a door to enter room & nothing else, even if it is highest
educational degree
27 Engineers are not made by, either universities or institutions, but are made by themselves
& also, delivered by nature
28 Try to record all acts that are done
29 Do not just talk, but walk on work
30 Talking too lengthy does not have any measurement in engineering & quality deliveries
31 Talk to points, because results would talk self
32 Engineering means deliveries & nothing else
33 Engineering does not mean a certification, a car, a bungalow & while colour
34 Better develop idea for self & for self presentation first & then for implementation & then
for presentation results to others
35 Better not to talk one issue many times to whoever one meets
36 I suggest write whatever specific experience one has to give to others, give by writing,
rather than by speech wasting self & others time
37 It is not easy to hear & listen what speaker presents, but it is much easy to read writing
whenever, it suits reader
38 Therefore, all seniors & veterans should transfer respective knowhow to successors,
using whatever media available

1 Issue of Professional bodies conducted examinations & approved equivalent engineering
degrees
 2 Just for purpose of logistics information, I am pleased to write to you my information,
pertinent attending educational classes for purpose to appear in IEI examinations in
1978/1980, when I was a student of IEI for passing Section A & Section B examinations
3 Section A classes
a Mathematics 1 & 2 attended classes conducted by professor I B Prashad in Connaught
Place Delhi
b Applied Thermodynamics & Modern Physics classes, conducted by Professor B L
Thareja
c in Connaught Place Delhi
d Electrical Engineering classes also, attended in Connaught Place Delhi
e Attended drawing classes as well on Sundays
f All these classes were conducted during evening, after doing formal job work
g These classes were attended for 6 months
h I did not attend any class for Social Science
4 Section B classes
a Theory of Structures
b Designs of Structures- RCC-PSC-Structural Steel
c Fluid Mechanics
d Soil Mechanics
e Construction & Foundation Engineering
f All foregoing classes were attended for 6 months under authority of Prof
Rammamurtham @ Patel Nagar
5 All foregoing classes amount to many hundred hours, based on 3 hours per evening
6 Studied Self
7 Water resources studied self
8 RRB studied self
9 Water Supply & Sewerage
10 There appears to be some degree of mixing up among authorities that students do not
attend classes for all such studies
11 If these classes were not attended, in 10 years Section A & B could not be qualified
12 I qualified in 2.5 years in addition to 3 years Civil Engineering diploma in 1974 with
76% marks

What purpose of education is all about?
1 To get degrees & hang on wall or
2 To develop mind & use education in life or
3 To get carried away & use its money convert value or
4 To use it for marriage market value or
5 To write many titles with name or
6 To express that person is VIP or
7 To use it to develop god’s created earth
8 Current scenario unfortunately measures value of education in terms of degree & its
equivalent market fiscal value or so called professional or occupational package earned
9 In case, education does not earn a silver lined package, that education is considered
complete waste
10 Evident is from high profile professions that are learned with great hard work &
difficulties for example Engineering & Medical, but are required further to be covered by
degree of management or IT etc.
11 This is what / where society has reached to!!!
12 Education has converted professional religions of those educated to bumper of money
making machines & not to develop & apply mind for development of this world
13 Examples are redundant force in IT sector as well as, in management
14 Real field that are required to make up world to better state, such as science, engineering
have been condoned in general
15 Everybody intends to make money only, ignoring use of natural power of mind that has
been chipped in everybody’s brain skeleton
16 If Sun thinks same way that it is not getting required pay back from earth, what would
have resulted, has someone thought about
17 If all other natural elements & components do think same way, where would we live in,
when all these elements, including solar system go off work for they are not paid
18 Human born with small as well as, big mind intends to get each & every prosperity in life
& gather all kinds of materials in mundane planet
19 One knows that all is going to be left here under care of no controls of possessors, even
then blind race to ocean of no waters continues
20 All professions have been laid as such, there s no proportion to requirement
21 A day is not far away, when we shall not find good engineers, who know work
22 We shall not find doctors, who understand humanity
23 We shall not find other professionals, who know humans
24 Whole world shall be by all such virtues be, by itself converted to a state of jungle, where
ghosts & animals habitat
25 Man is a social animal was studied long back, but man shall remain only an animal!!!
26 Then it needs no explanation that how shall god treat all such animals, like stray dogs are
treated?
27 Wise can understand indications, while others may not
