AGREEMENT FOR SELL AND PURCHASE


This agreement is made at Delhi on this 11th day of April, 2020 between MR. ABDUL AZIZ
S/o Mr. Abdul Rashid R/o 1017, Bijwasan, Palam Vihar, Near Seema Hospital, Delhi,
hereinafter cal. the first party of the one part

AND

MR. SIJAL KHAN S/o Mr. Maqubul R/o H. No.- C-2/181, New Ashok Nagar, Delhi-
110096, hereinafter called the Second Party of the other Part

The expression first and second party occurs in the body of this agreement shall mean and
include their respective legal heirs, Successors, legal representative, administrators,
executors and assigns.

Whereas the First Party is the absolute owner and in lawful possession of Residential
Property No.D-55, Old No.198-B, Measuring area 125 sq.yds., out of the Khasra
No.404/272, consisting of Two storey complete with basement with boundary walls,
fitted with electricity connection, with the rights of upper construction upto the last
story, Situated at in the area of Village Chilla Saronda Banger, in the abadi of Block-D,
New Ashok Nagar, illaqa Shandara. Delhi-110096, which is bounded as under -

East: Road
West: Property of Others.
North: Property of Others.
South: Property of Others

That the First Party for his legal needs and requirements has agreed to sell the said for a
sum of Rs. 1,25,00,000, (Rupees One Core Twenty Five Lakh Only) to the second party.
Both parties i.e. first & second have agreed to sale/purchase of the said property on the
following terms & conditions of this agreement.

NOW THIS AGREEMENT WITNESSES AS UNDER:-

1. That the entire consideration amount of the property is finalized for a sum of Rs
1,25,00,000/- (Rupees One Crore Twenty Five Lakh Only).

2. That First Party has received an amount of Rs.40,00,000/- (Rupees Forty Lakh
Only) as earnest money from the second party at the time of signing this agreement.

3. That Balance payment of Rs. 85,00,000, (Rupees Eighty Five Lakh Only) will be
paid by the second party to the first party on or after six months from completion of
complete lockdown or time can be further extended with mutual consent of the both
parties. (The time has been extended by the both parties due to Lock-down for
Corona Virus)

4. That First Party assured second party that the said property under sale is free from
all kinds of encumbrances, sale, gift, liens, legal laws court decree court injunctions,
attachments, whatsoever and no agreement to sell has been executed by the First
Party prior to this agreement with regards to the aforesaid property. If is proved
otherwise the first party shall be liable and responsible for the same.

5. That all the expenses of this transaction (i.e. registration) shall be borne by the
second party only.

6. That if the First Party shall be defaulter to comply any terms & conditions of this
agreement and fail to execute the concerned documents for transfer the ownership
of this said property in favor of second party in the office of concerned S.R. within
the fixed period by this agreement, then the first party shall have to pay double
amount of earnest money to the second party or the second party shall have full
right to get executed the same documents by the first party through court of law at
the cost and expense of first party.

7. Any disputes arising out of this transaction shall be within the Jurisdiction of Delhi
Courts.

8. That First Party shall pay the vacant land tax or house tax, water/electricity bill if
any, till the date of final transaction

9. That First Party undertakes to get the said property registered in the none of
second party or his nominee within the period mentioned in clause 3 above. If the
second party fails to arrange the payment of the balance amount as per clause 3
above, the transaction will be considered as canceled and the earnest money given
will be forfeited.

10. That the second party has full right to transfer the document in his/her/their own
name (s) as well as his/her/their nominees. legal heirs. successors, y relative and
any other person from the first party without any objection and challenges

IN WITNESSES WHEREOF the parties here to have set their respective hands on these
presents in the presence of the following witnesses -

WITNESS:-

2. Signature of Purchas/Second Party
