COMPLAINT
COMES NOW, the plaintiff, by the undersigned counsel, and unto this
Honorable court, most respectfully alleges:

1. That plaintiff is of Legal age and resident of No. 123 Barrio Salam, MSU,
Marawi City, while defendant is also of legal age and resident of No. 456
Banggolo, Marawi City where he may be served with summons and other
court processes.
2. That plaintiff and defendant were lawfully married in accordance with
Muslim rites on January 1, 2000. (Copy of their Marriage contract is
hereby attached as Annex “A”).
3. That plaintiff and defendant begot two children during the existence of
their marriage, namely Mohammad, Jr. and Bai Asiah. (Copy of
Certificates of Live Birth of the two children are hereby attached as
Annexes “B” and “C”, respectively).
4. That sometimes on February 14, 2008, defendant abandoned the
plaintiff and their children without any lawful cause and from then,
defendant failed and refused to provide support to the plaintiff and their
children, notwithstanding the fact that defendant is earning sufficient
income as administrative staff of the Mindanao State University.
5. That starting December 25, 2008, plaintiff made repeated demands from
the defendant of support but such demands were ineffectual as
defendant refused to give support without any lawful reason.

WHEREFORE, forgoing considerations, it is respectfully prayed unto this

Honorable court that, after notice and hearing, judgment be rendered in favor
of the plaintiff and ordering the defendant:

1. To give the plaintiff and their children a monthly support of P 5,000.00

payable every 15th day of every month.
2. To give the plaintiff and their children as support pendent lite, a monthly
support of P 5,000.00 every month that defendant failed to give to the
 plaintiff and their two children, to be counted from February 14, 2008 up
to the filing of this action.
3. An Attorney’s fees of P30, 000.00 and P2, 000 per court Appearance, and
he cost of this suit.

Other reliefs just and equitable are also prayed for.
