Petition u/s 13-B of the Hindu Marriage Act 1955 for

dissolution of Marriage by a decree of Divorce as amended

by the marriage law amendment act 1976.

Sir,

Petitioner submits as under:-

1 That the marriage between the petitioner no.1 and

petitioner no.2 was solemnised on 26/11/2006 by way

of Anand Karaj and other ceremonies at Village Maur

Mandi in the presence of relatives and respectable

person of the village and other relative. Affidavits are

enclosed herewith.

2 That the status and residence of the party prior to the

marriage and afer the marriage is / was as under :-

3 That after the marriage of the petitioner no.1, petitioner no1

and petitioner no.2 lived as husband and wife and co-habited

as such and no issue was born out of this wedlock.

4 That relation between the petitioners has been so strained,

that it has become very difficult for them to live together as

husband and wife however relative and panchayat and both the

parties persuaded to live together as husband and wife but no

effect.

5 That both the petitioner living separately from each other for a

continuous period of two year and they have not able to live

together as husband and wife during the said period.


6 That now the petitioners have mutually agreed that marriage

between them should be dissolved by a decree of divorce u/s

13-B of the Hindu Marriage Act 1955.

7 That the parties have settled their claim mutually and

petitioner 1 and petitioner no.2 shall not claim any amount

from each other. The petitioner no.1 shall not claim any

maintenance allowance from the petitioner no.2 in future.

8 That the present petitioner is being filed with mutual consent

of the parties.

9 That there has not been any unnecessary or improper to delay

the petition.

10 That there is no legal ground why the relief prayed for should

not be granted.

11 That there has not been any other previous proceeding with

regarding to the marriage by or on behalf of any of the parties.


12 That marriage of the parties was solemnized at Village Maur

Mandi and the lastly the petitioner no.1 is residing at village

Maur Mandi, Tehsil Talwandi Sabo Distt. Bathinda, within the

local limit of the ordinary civil jurisdiction of this Hon’ble Court

and the Hon’ble Court is competent to pass a decree for

divorce for the petitioner u/s 13-B of the H.M. Act.

13 That the corut fee stamp of rs. 20/- is affixed on the petition.

It is therefore prayed that the marriage between the

parties may kindly be dissolved by a decree of divorce u/s 13-

B of the Hindu Marriage Act 1955

AFFIDAVIT

Manpreet Kaur wife of Buta Singh s/o Lakha Singh r/o Village

Daliapur, Tehsil Budhlada, Distt. Mansal now residing at the house

of her father Balvir Singh at Village Maur Mandi Tehsil Talwandi

Sabo distt. Bathinda do hereby solemnly affirm and declare as

under:-

1 That the marriage between the deponent and petitioner no.2

was solemnised on 26/11/2006 by way of Anand Karaj and

other ceremonies at Village Maur Mandi in the presence of

relatives and respectable person and other relative

2 That after the marriage of the deponent, and petitioner no.2

lived as husband and wife and co-habited as such and no

issue was born out of this wedlock.

3 That both the petitioners living separately from each other for

a continuous period of three years and they have not able to

live together as husband and wife during the said period.
