I, Brijendra Rai, S/o Jagdeesh Prasad Rai R/o Sun Flower Apartment 56 Civil
Lines, PS Navabad, District Jhansi hereby submit here as under;
1. That instant application is being moved for Recall of NBW issued vide
orde dated 28.04.23 for appearance on 15.05.2023; the absence of
applicant was not deliberate a his condition was critical due to prolonged
fever which is also stand corroborated from the fact that applicant who due
to his ill health fainted in the court on the previous date of hearing is with
continued ill health. The medical prescription of Govt hospital is being
annexed as Annexure No. 01 to this recall application.
2. That the instant matter comes within the purview of category A offences
in light of law laid down vide order dated 07.10.2021 in the matter of
Satendra Kumar Antil v CBI & Another (Annexure No. 02), because of
the following reason;
i. The maximum punishment in the offences is of less than 7 years.
ii. The applicant himself appeared before the next date of listing.
3. That applicant undertake that he will appear on the next date of listing for
which he is ready to furnish Personal bond if any.
Prayer
In view of above this Hon’ble Court is requested recall Recall of NBW
issued vide orde dated 28.04.23 for appearance on 15.05.2023
Any other order or direction in present circumstance may please also be
passed.

Application for Adjournment

I, Brijendra Rai, S/o Jagdeesh Prasad Rai R/o Sun Flower Apartment 56 Civil
Lines, PS Navabad, District Jhansi hereby submit here as under;

1. That instant application is being moved for adjournment because of

the reason that applicant who due to his ill health fainted in the
court on the last date of hearing is with continued ill health.
Moreover on point of trail together a revision was filed which was
admitted by Honble Session Court and now fixed for hearing on
25.05.2023 and as such judicial propriety demands that this matter
may also please be heard after 25.05.2023. Arguing counsel is also
out of station today. The copy of latest medical prescription as well
as order passed in Criminal Revision is being annexed herewith as
Annexure No. 01 to this application.
Prayer
In view of above this Hon’ble Court is requested to fix any date after
25.05.2023 in the interest of justice.

Any other order or direction in present circumstance may please also be

passed.
