A RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE, HON.

ARTH
BRYAN F. CELESTE TO ENTER INTO A MEMORANDUM OF AGREEMENT (MOA)
WITH THE NATIONAL COMMISSION FOR CULTURE AND THE ARTS (NCCA)
REPRESENTED BY ITS EXECUTIVE DIRECTOR, OSCAR G. CASAYSAY FOR THE
PROJECT TITLED, “PELIKULA: FILM DEVELOPMENT WORKSHOP AND THE 2 ND
HUNDRED ISLANDS FILM FESTIVAL.”

WHEREAS, pursuant to RA 7356, the NCCA is mandated to encourage the


continuing and balanced development of a pluralistic culture by the people, conserve
and promote the nation’s culture heritage, ensure the widest dissemination of artistic
and cultural products and preserve and integrate traditional culture and its various
creative expressions as dynamic part of the national cultural mainstream;

WHEREAS, the GRANTEE is a local government unit whose one of its mandates
is to promote the socio-cultural well-being of its people through the preservation and
protection of its cultural heritage and advancement of its creative expressions;

WHEREAS, the PROJECT titled PELIKULA: Film Development Workshop and


the 2nd Hundred Islands Film Festival aims to develop and enhance the film making
talent and creativity of the constituents of Alaminos City through a series of workshops;

WHEREAS, the project is particularly described in the project proposal attached


hereto as Annex “A” and the Approve Line Item Budget attached hereto as Annex “A-
1”,. The attached annexes are made integral parts of this agreement;

WHEREAS, the NCAA recognizes the true worth of the Project as contributory to
the development of Philippine culture and arts and has seen it fit, proper and convenient
to adopt the same for its own purposes;

WHEREAS, the Project, as proposed by GRANTEE was approved by the Board


of Commissioners under the Resolution Number 2023-092 dated November 29, 2022
supported by way of financial assistance in the amount of Four Hundred Thousand
Pesos (P400,000.00) chargeable to the Program on Advancing the Value of Creative
Excellence: Pagkamalikhain, a copy of which is attached hereto as Annex “B” and made
an integral part of this agreement;

WHEREAS, Sec. 22(c) of R.A. 7160, otherwise known as the Local Government
Code, provides, that:

Sec. 22. Corporate Powers. – (a) Every local government unit, as a


corporation, shall have the following powers: xxx xxx xxx (c) Unless
otherwise provided in this Code, no contract may be entered into by the
local chief executive in behalf of the local government unit without prior
authorization by the sanggunian concerned. A legible copy of such
contract shall be posted at a conspicuous place in the provincial capitol or
the city, municipal or barangay hall.
WHEREAS, the city mayor is empowered by the same Code to enter into
contracts on behalf of the city, based on Section 444(b)(1)(vi) thereof which provides:

Section 444. The Chief Executive: Powers, Duties, Functions and


Compensation. – xxx (b) For efficient, effective and economical
governance the purpose of which is the general welfare of the municipality
and its inhabitants pursuant to Section 16 of this Code, the municipal
mayor shall: (vi) Upon authorization by the sangguniang bayan, represent
the municipality in all its business transactions and sign on its behalf all
bonds, contracts, and obligations, and such other documents made
pursuant to law or ordinance.”

NOW THEREFORE, on motion of Councilor Carol Sison Dizon duly seconded by


all, it was;

RESOLVED as it is hereby RESOLVED by the Sangguniang Panlungsod to


authorize the Local Chief Executive, Hon. Arth Bryan F. Celeste to enter into a
Memorandum of Agreement (MOA) with the National Commission for Culture and the
Arts (NCCA) represented by its Executive Director, Oscar G. Casaysay for the project
titled, “PELIKULA: Film Development Workshop and the 2 nd Hundred Islands Film
Festival”.

RESOLVED, FURTHER, to furnish copies of this resolution to the Local Chief


Executive and all concerned, for their information and appropriate action;
