COMPROMISE PETITION UNDER ORDER XXIII RULE 3 OF


THE CODE OF CIVIL PROCEDURE

The Plaintiffs and Defendants above named humbly beg to file


this Compromise Petition in the above suit as follows:

1. It is submitted that the Plaintiffs have filed the above suit


for the relief of partition and separate possession and
other consequential reliefs for permanent injunction
against the Defendants in respect of suit schedule
properties. Subsequent to filing of the above suit at the
intervention of relatives and well-wishers, the Plaintiffs
and the Defendants have settle the matter amicably
among themselves in the following terms.
2. The Plaintiff and the Defendants that they are the
members of the Hindu Undivided Joint Family, the
Plaintiffs and the Defendants admits that one Sri
Puttarangaiah is the propositor and he married to Smt.
Pillamma and out of their wedlock, they were having in
all 4 sons (1) P. Gangappa – who is the father of the
Defendants No. 6 to 13 and grand-father of Defendant
No.3 to 5, (2) P. Ramaiah who is the husband of the
Plaintiff No.1 and father of the Plaintiffs No.2 to 6, (3)
Honnagangappa – who died long back without marriage
and he succeeded by his other 3 brothers, (4) P.
Honnasiddaiah – husband of deceased Plaintiff No.7 –
Smt. Lakshmidevamma.

3. The Plaintiff and the Defendants admits during the life


time of Lakshmidevamma she has executed an un-
registered Will on 16.11.2008 in favour of the Plaintiffs
No.2, 4, 5 and 6 bequeathing her share over the suit
schedule properties in their favour, however now in
pursuance of the settlement arrived between the
plaintiffs and the defendants , the Plaintiff Nos. 2, 4, 5
and 6 have voluntarily given up their right of claim in
respect of share of Smt. L. Lakshmidevamma
bequeathed to them under the will dated 16.11.2008
and have agreed to effect the partition of her share
between the Plaintiffs No.2, 4, 5 and 6 and the
defendants as per this compromise petition.
4. The Defendants admits that the properties acquired by
the Plaintiffs out of their own efforts and hard earned
money out of their personal business activities and that
they have acquired separate properties which are not
subject matter of the above suit and that the Plaintiffs
are at liberty to enjoy as their separate and self-
acquired properties.

5. The Plaintiffs admits that the properties acquired by the


defendant No. 1, 2 & 7 to 13 out of their own efforts and
hard earned money out of their personal business
activities and that they have acquired separate properties
which are not subject matter of the above suit and that
the Defendants No. 1, 2 & 7 to 13 are at liberty to enjoy
as their separate and self-acquired properties according
to their convenience.

6. The Plaintiffs and the Defendant Nos. 1, 2 & 7 to 13


admits that the properties acquired by them personally
are treated as separate and self-acquired properties of
the Plaintiffs and Defendants Nos. 1, 2 & 7 to 13 are at
liberty to enjoy the said properties according to their
convenience.

7. It is agreed between the Plaintiff and the Defendants


there are existence of roads to the respective share
allotted to the Plaintiff and the Defendants and for which
both the Plaintiff and the Defendants have agreed that
they will enjoy the said access roads to reach their
respective properties without their being any
disturbance or obstructions to each other by having
access to their respective shares for better enjoyment of
the same.

8. The properties allotted to the share of the Defendants


No.7, 8, 10, 12 & 13 are described in the schedule
hereunder and referred to as ‘A’ Schedule Properties to
this compromise petition.

9. The Plaintiffs and the Defendants No.1 to 2 have today


delivered and put the defendants No. 7, 8, 10, 12 & 13 in
physical possession of the suit ‘A’ Schedule properties
to this compromise petition and accordingly, the
defendants No. 7, 8, 10, 12 & 13 have come in exclusive
possession of the same.

10. The Plaintiffs have no objection to the Defendants No. 7,


8, 10, 12 & 13 to get transfer the revenue records and
kathas of house properties pertains to ‘A’ Schedule
properties in their favour and to get Survey and to fix the
boundaries to the same.

11. The Plaintiffs & the Defendant No. 1 & 2 hereby


declares that the Defendants No. 7, 8, 10, 12 & 13 shall
be the absolute owners of ‘A’ Schedule properties to this
compromise petition and they are at liberty to enjoy the
same according to their convenience and that the
Plaintiffs and Defendant Nos. 1 & 2 have no manner of
claim over the same.
12. The properties allotted to the share of the plaintiffs and
Defendants No.1 & 2 are described in the schedule
hereunder and referred to as ‘B’ Schedule properties to
this compromise petition hereinafter-wards.

13. The Defendants No. 7, 8, 10, 12 & 13 have today


delivered and put the plaintiffs and Defendants No.1 & 2
in physical possession of the ‘B’ Schedule properties to
this compromise petition.

14. The Defendants No.7, 8,10, 12 & 13 have further


agreed to allot the share to the Defendant No.3 to 5 and
Defendant No. 6(a) to 6(e) and Defendant No.11 out of
their share allotted under this Compromise Petition
which more fully described in the Schedule ‘A’ Property.

15. The properties allotted to the share of the Defendants


No.3 to 5 are described in the Schedule hereunder and
referred to as ‘C’ Schedule properties to this Compromise
Petition.

16. The property allotted to the share of the Defendant Nos.


6(a) to 6(e) are described in the Schedule hereunder and
referred to as ‘D’ Schedule properties to this Compromise
Petition.

17. The properties allotted to the share of the Defendant


No.11 are described in the Schedule hereunder and
referred to as ‘E’ Schedule properties in this Compromise
Petition.

18. The Defendants No.7, 8 10,12 & 13 have today delivered


and put the Defendants No. 3 to 5 in physical possession
of the suit ‘C’ Schedule properties to this Compromise
Petition and accordingly the Defendants No. 3 to 5 have
came in exclusive possession of the same.

19. The Defendants No.7, 8 10,12 & 13 have today delivered


and put the Defendants No. 6(a) to 6(e) in physical
possession of the suit ‘D’ Schedule properties to this
Compromise Petition and accordingly the Defendants No.
6(a) to 6(e) have came in exclusive possession of the
same.

20. The Defendants No.7, 8 10,12 & 13 have today delivered


and put the Defendants No. 11 in physical possession of
the suit ‘E’ Schedule properties to this Compromise
Petition and accordingly the Defendant No. 11 has came
in exclusive possession of the same.

21. The Defendants No.7, 8, 10, 12 & 13 have no objections


to the Defendants No.3 to 5 and 6(a) to 6(e) & 11 to get
transfer the revenue records and katha of the schedule
‘C’, ‘D’ & ‘E’ properties respectively in their favour and to
get survey and to fix the boundaries to the same.

22. The Defendants No.7, 8, 10, 12 & 13 hereby declares


that the Defendant No.3 to 5 and 6(a) to 6(e) and 11 shall
be the absolute owners of ‘C’, ‘D’ & ‘E’ Schedule
properties respectively to this Compromise Petition and
they are at liberty to enjoy the same according to their
convenience and that the Plaintiffs and the Defendants
No. 1 & 2 and 7, 8, 10, 12, & 13 have no manner of claim
over the same.

23. The Defendants No.3 to 5, and 6(a) to 6(e) and 11


hereby declares that the Defendant No.7, 8, 10, 12 & 13
shall be the absolute owners of ‘A’ ‘Schedule properties to
this Compromise Petition and they are at liberty to enjoy
the same according to their convenience and the
Defendants No. 3 to 5, 6(a) to 6(e) & 11 have no manner
of right, title and interest over the same.

24. Both the Plaintiffs and the Defendants have agreed to


co-operate with each other for getting transfer of the
revenue records/kathas so also to get survey and to fix
boundaries to the respective shares allotted to them
pertains to the survey number properties and house
properties.

25. It is agreed between the plaintiffs and the defendants at


the time of conducting the survey, in the event if it is
found that the extent of the land of single survey no. and
house properties divided among the plaintiffs and the
defendants is lessor than the extent shown in the
revenue records, in such an event both the parties shall
agree for fixing the boundaries by reducing the lessor
extent proportionately allotted to their share under this
compromise petition.

26. The Plaintiffs and the Defendants have entered into this
compromise petition out of their own free will and volition
and there is no coercion or force against each other.

27. The Plaintiffs and the Defendants have affixed their


signature to this Compromise Petition before this Hon’ble
Court after knowing the contents of the Compromise
Petition on this day.

28. The parties agreed to bear their own costs.

Wherefore, the Plaintiffs and the Defendants


respectfully prays that this Hon’ble Court may be pleased to
pass Final Decree in terms of the Compromise Petition in the
interest of justice and equity.
