Roberts v.

Locke
304 P.3d 116, June 17, 2013
Ponente: Davis, J

FACTS:
Robert and Locke were married and now they wanted a divorce. Petitioner is stating that
they have equally divided properties and one of those is the beachfront property in Costa
Rica.

Locke proposed that the Court orders the sale of that property and that the proceeds be
used to pay their debts and the balance left is split into two.

Roberts proposed that the property be awarded to her with Locke paying the debts off
that property.

ISSUE: WON the district has the authority to order the conveyance of the Costa Rican
property

RULING:
THE COURT RULED IN THE AFFIRMATIVE. Wyoming decree does not have to yield to
Costa Rican law. Based on Wyoming Rule of Civil Procedure 44.1, neither Wyoming's
Courts nor those of the US Courts will take judicial notice of foreign laws without
pleading and proving it in accordance with the forum court. Since the petitioner did not
provide proof, it is Wyoming decree that should prevail.
