CUSTODY OF A CHILD

Two houses, two homes

Two kitchens, two phones

Two couches where I lay, two places that I stay

Moving, moving here and there

From Monday to Friday, I’m everywhere

Don’t get me wrong, it’s not that bad

But often times it makes me sad

Splitting up isn’t easy. Entire novels and pop songs have been written about it. And when children are
involved, divorce can be an especially sensitive situation.

First of all, the Prophet (peace and blessings be upon him) said:  “Among lawful things, divorce is the
most hated by Allah.” (Reported by Abu Dawud).

‫’’ ہللا کے ہاں حالل کاموں میں سب‬: ‫ نبی ﷺ نے فرمایا‬، ‫محارب بن دثار حضرت ابن عمر رضی ہللا عنہما سے روایت کرتے ہیں‬
‫ “سے ناپسندیدہ کام طالق ہے ۔‬dawood 2178

Thus, spouses should avoid divorce to the best of their abilities, and if they have difficulties and
problems, they should try to work out their differences and seek help from their relatives, friends, or
professional counselors(Mallams and Imams/ even Christian Counselors). They should also consider and
think of the future of their children and the destructive effects of divorce on their children’s future.

However, if the differences are irreconcilable, divorce is then permissible, but it should be done in a
decent manner.

‫اور جب تم عورتوں کو (دو دفعہ) طالق دے چکو اور ان کی عدت پوری ہوجائے تو انہیں یا تو حسن سلوک سے نکاح میں رہنے دو‬
‫یا بطریق شائستہ رخصت کردو اور اس نیت سے ان کو نکاح میں نہ رہنے دینا چاہئے کہ انہیں تکلیف دو اور ان پر زیادتی کرو۔ اور‬
‫جو ایسا کرے گا وہ اپنا ہی نقصان کرے گا اور خدا کے احکام کو ہنسی (اور کھیل) نہ بناؤ اور خدا نے تم کو جو نعمتیں بخشی ہیں‬
‫اور تم پر جو کتاب اور دانائی کی باتیں نازل کی ہیں جن سے وہ تمہیں نصیحت فرماتا ہے ان کو یاد کرو۔ اور خدا سے ڈرتے رہو‬
۲۳۱﴿  ‫﴾اور جان رکھوکہ خدا ہر چیز سے واقف ہے‬

Surah Baqrah 231

The Prophet (peace and blessings be upon him) says,
“No harm shall be inflicted or reciprocated in Islam.

‫’’ نہ ( پہلے پہل ) کسی کو نقصان پہنچانا‬: ‫ رسول ہللا ﷺ نے فیصلہ دیا‬، ‫حضرت عبادہ بن صامت رضی ہللا عنہ سے روایت ہے‬
‫ نہ بدلے کے طور پر نقصان پہنچانا اور تکلیف دینا ۔‬، ‫اور تکلیف دینا جائز ہے‬

ALISHA’S PART (As for male kids, they should remain with their mother until they reach the age of
puberty, and then shifted to their father in order to get acquainted with the traits of manhood.)

Third, the maintenance of children is obligatory upon the father according to scholarly consent, whether
he keeps his wife or divorces her, and whether the wife is poor or rich.

So she is not obliged to spend on the children if the father is around. If the children are in the custody of
a divorced woman, then their father must support them, and the mother who has custody of a child who
is still breastfeeding has the right to ask for payment for nursing the child.

‫صاحب وسعت کو اپنی وسعت کے مطابق خرچ کرنا چاہیئے۔ اور جس کے رزق میں تنگی ہو وہ جتنا خدا نے اس کو دیا ہے اس کے‬
‫موافق خرچ کرے۔ خدا کسی کو تکلیف نہیں دیتا مگر اسی کے مطابق جو اس کو دیا ہے۔ اور خدا عنقریب تنگی کے بعد کشائش‬
۷﴿‫﴾بخشے گا‬
