HISTORY, SOURCES AND APPLICATION OF PENAL LAW; FELONIES AND


THEIR CLASSIFICATION; CRIMINAL INTENT; DISTINGUISHING MOTIVE
FROM CRIMINAL INTENT

Specific learning objectives.

1. To trace the history of the Revised Penal Code, its sources, and
understand the rationale for its enactment;

2. To revisit the principle of territoriality as embodied in Article 2 of


the Revised Penal Code, with the end in view of clarifying the scope of the
application of the provisions of the Revised Penal Code, identifying cases in
which the provisions of the Revised Penal Code are applicable even with respect
to felonies committed outside of the Philippines, and to re-examine important
words and phrases employed in said article;

3. To introduce the students to the concept of felonies, their


classification according to the means by which they are committed, and to
sensitize them to the elements of felonies (concepts of dolo and culpa); and,

4. To underscore the importance of criminal intent in the perpetration


of criminal acts, distinguish criminal intent from motive, and identify instances
when criminal intent is deemed irrelevant in the determination of whether or
not a crime has been committed.
