III: For comprehensive understanding of R.A 7160, hereunder are the significant
provisions carefully chosen from the Rules and Regulations Implementing the
Local Government Code of 1991

What is Republic Act No 7160?


7160, otherwise known as the Local Government Code was enacted into
law, transferring control and responsibility of delivering basic services to the hands of
local government units (LGU). It aimed to enhance provision of services in the grass
roots level as well as improve the efficiency in resource allocation.

SECTION. 459. Role of the Province. - The province, composed of a cluster of


municipalities, or municipalities and component cities, and as a political and corporate
unit of government, serves as a dynamic mechanism for developmental processes and
effective governance of local government units within its territorial jurisdiction.

SECTION. 460. Manner of Creation. - A province may be created, divided, merged,


abolished, or its boundary substantially altered, only by an Act of Congress and subject
to approval by a majority of the votes cast in a plebiscite to be conducted by the
Comelec in the local government unit or units directly affected. The plebiscite shall be
held within one hundred twenty (120) days from the date of effectivity of said Act,
unless otherwise provided therein.

What is a provincial governor?
The Provincial Governor , as the.chief executive.of.the provincial government, is
mandated to exercise powers and perform.duties.and.functions.necessary to.promote
the.general welfare of the locality and its inhabitants.

The governor shall ensure.that the acts.of the component cities and municipalities of
the province and.of its officials and.employees are within the scope of.his prescribed

Passage of local laws belongs to its legislative council known as Sangguniang
Panlalawigan

Sangguniang Panlalawigan – as Legislative Body of the province. commonly known as


the Provincial Board, are the legislatures in Philippine Provinces. They are
the legislative branches of the provinces, and their powers and responsibilities are
defined by the Local Government Code 1991. Along with the provincial governor,
the executive branch of the province, they form the province's government.
Members are either called "board members" (BM) or "Sangguniang Panlalawigan
members" (SPM). In Tagalog-speaking provinces, they are informally called "bokal".
Basic Powers of Sangguniang Panlalawigan are:
1.Approve ordinances and pass resolutions necessary for an efficient and effective
provincial government.
2.Generate and maximize the use of resources and revenues.
3.Grant franchises, approve the issuance of permits or licenses, or enact ordinances
levying taxes, fees and charges.

SECTION 7, R.A 7160 - Creation and Conversion. - As a general rule, the creation of a
local government unit or its conversion from one level to another level shall be based on
verifiable indicators of viability and projected capacity to provide services, to wit: land
area, income , and population. The income of such LGU must be sufficient, based on
acceptable standards, to provide for all essential government facilities and services and
special functions commensurate with the size of its population, as expected of the local
government unit concerned:
