Azure Release and Waiver of Liability

I, the undersigned requester, understand and accept all risks associated with direct user connectivity to the live
production Azure server hosted by Office Gemini LLC.
In consideration of the services of Office Gemini LLC, its agents, owners, officers, or subsidiary corporations, I
hereby agree to release and discharge Office Gemini LLC on behalf of [CLIENT NAME] as follows:

Inherent Risks:  I acknowledge all risks entailed due to the requested direct user access by way of Remote
Desktop Service (port 3389) and Secured Filed Transfer Protocol (port 21&22) on the Office Gemini Hosted
Azure Server.

Express Assumption of Risk:  As lawful consideration for being provided access to the live production Azure
server offered by Office Gemini LLC, I expressly agree and promise on behalf of [CLIENT NAME] to accept
and assume all the risks existing in this activity. Participation in this activity was specifically requested and I/we
elect to participate in spite of the risks.

Indemnity:  Should Office Gemini LLC or anyone acting on their behalf, be required to incur attorney's fees
and costs to enforce this agreement, I agree on behalf of [CLIENT NAME] to indemnify and hold them
harmless (in other words, I agree to pay for...) for all such defense fees and costs.

Liability of Services:  EXCEPT WHERE PROHIBITED, THE SERVICES ENTITIES (OFFICE GEMINI

LLC) SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR
EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SITES/SERVICES OR ANY THIRD
PARTY’S USE OF THE SITES/SERVICES. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION,
DAMAGES FOR LOST PROFITS, LOST DATA, COMPUTER FAILURE, OR THE VIOLATION OF
YOUR RIGHTS BY ANY THIRD PARTY, EVEN IF THE SERVICES ENTITIES HAVE BEEN ADVISED
OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY
UPON WHICH THE CLAIM IS BASED.

By signing this document, I acknowledge for myself and on behalf of [CLIENT NAME], I/we may be
found by a court of law to have waived my/our right to maintain a lawsuit against Office Gemini LLC on
the basis of any claim from which I/we have released them herein.

I/WE HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I/WE
HAVE READ AND UNDERSTOOD IT, AND I/WE AGREE TO BE BOUND BY ITS TERMS.
