JOINT AFFIDAVIT OF ARREST

I, PCI ARSENAL, EREBOY L. 38 years old married and a resident of Brgy. II of La Carlota City after having
been duly sworn to in accordance with law hereby and say,

That I am an active member if the Philippines National Police (PNP) presently assigned at La Carlota City
Police Station, Negros Occidental designated as Deputy Chief of Police.

That on April 1, 2014 at about 7:30 o'clock in the evening, I and my personnel together with the
members of RPSB 6 stationed at La Carlota City conducted checkpoint in Brgy. Ayungon, La Carlota City
in connection with our campaign against riding in tandem criminals and other illegal activities. We put
up our checkpoint signboard at the center of the national highway at Sitio Bucroz Dacu Brgy. Ayungon La
Carlota City, and conducted checkpoint thereat;

That at around 8:00 o'clock in the evening of the same date, while in the process of conducting
checkpoint at the national road at Sitio Bucroz Dacu, Brgy. Ayungon, La Carlota, we saw a motorcycle
driven by unidentified person approaching our location coming from the direction of Brgy. Ma-ao to the
direction of La Carlota City, Negros Occidental

That when said motorcycle was already near us, I signaled the driver to stop, which he complied. Upon
stopping, the driver of the motorcycle looked uneasy and terrified and I noticed that his motorcycle has
no plate number , so I advised him to park his motorcycle beside the road which he also compiled. The
driver was wearing a black fitted jacket;

That I asked the driver to present the pertinent document of his motorcycle and also his driver's license,
but he presented to me only his student's permit and I found out that his name Theodoro Valencia;

That out of nowhere and by my observation I noticed something bulky tucked in his waist the form of
which appears like of a short firearm. I requested him to unzip and raise his jacket and there I saw a
handle of a gun protruding on his waist. I immediately held the handle of the gun tucked in the waist of
the driver and took it from his possession and demanding him to present the pertinent documents
authorizing him to possess and to carry a firearm but instead he showed to me the firearm license card
of BOGART MAGITING of Pink St. of San Enrique, Negros Occidental;

That I ordered PAT Rommel Ricaplaza to conduct further body search upon the person of Theodoro
Valencia and we were able to recover from the left pocket of his jacket two(2) magazines of Cal. 45, one
magazine is loaded with six (6) ammunition and the other magazine is loaded with five (5) ammunition;
That we then informed Theodoro Valencia the violation he committed and arrested him and we also
informed him of his constitutional rights and brought him to La Carlota Police Station for further
investigation and its detention.
